Act

Act Mr Andrew Guthrie for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr Andrew Guthrie, now minister at Edrom, showing that the petitioner having in 1690 before Whitsunday the said year upon the call of the people and parishioners of Edrom and by the appointment of the presbytery of Chirnside preached in the parish kirk thereof as a testificat of the same under the hands of the reverend moderator and clerk of the said presbytery produced with the said petition has testified, and that the petitioner is now the actual and ordained minister of the said parish and continues in the exercise of the ministry thereat, by which and conform to their lordships’ late act of council made in favour of Presbyterian ministers it is humbly conceived that the petitioner has and ought to have right to the late half year’s stipend of the said parish of the said crop 1690 (being yet undisposed of) especially seeing the heritors and parishioners of the said parish are willing and consent that their lordships give the petitioner a right thereto as their declaration and consent under their hands produced with the said petition has testified, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr Andrew Guthrie with the certificate and consent mentioned therein and produced therewith, they hereby find and declare that the petitioner has right to the stipend of the above kirk of Edrom for the last half of the crop and year of God 1690, and ordain him to be readily answered [and] obeyed thereof by the heritors, feuers, wadsetters, liferenters, fermerers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the said stipend for the said half year. And ordain letters of horning to be directed hereon at the petitioner’s instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain the heritors and others foresaid liable in payment of the said stipend to make payment thereof to the petitioner for the foresaid half year according as they shall be discerned be the judge ordinary.
