Warrant

Warrand for takeing the oaths of the late Register and his deput and servants anent the Records

Sir James Steuart her Majesties Advocat having represented to the Board that Since her Majestie had been graciously pleased to appoynt the Lord Philiphaugh to be Lord Register, It would be necessary that the Records, warrands and papers belonging to the office of Register now in the custody of James Johnstoun Esquire or his deput keeper of Louer parliament house, Should be given and delyvered to the present Register, Therfor his Grace her Majesties high Commissioner, and the Lords of her Majesties Privie Councell, Doe heirby Nominat and appoynt the Earle of Lauderdale, Lords President of the Session, Advocat, Justice Clerk and Phesdo To be a Committie to See the Saids Registers, warrands and other papers belonging to the office of Clerk Register, The keyes of the Louer parliament house, and other keyes wher the saids Registers and records are keept, delyvered up to the said Lord Philiphaugh now Register, By the said James Johnstoun Esquire late Register or his deputs and servants in the said office and the keepers of the warrands, Registers and other papers under him wpon oath, and who are also to declaire upon oath that they neither have2 nor had any other records, warrands or papers belonging to the said office of Register than what they then delyver, And recommends to the said Committie to meet at Such tymes as they shall think convenient, And declairs any three a Quorum, With power to the said Committie or ther said Quorum to doe every other thing requisite and necessary to the effect forsaid, And his Grace and the saids Lords Doe heirby give Commission and warrand to Mr Alexander Wedderburne Secretary deput to take the oath of the said James Phistoune Esquire late Register in the termes abovewrytten, And his Grace and the saids Lords declairs that upon delyverie of the saids records, warrands and others as aforsaid, and report of the said James Johnstouns oath, They will grant a Sufficient exoneration of the Same to them late Clerk register and his said deputs and servants, And appoynts the said Secretary deput to report to the Councill theranent betuixt and the twentieth fourth day of May nixt to come.

Sir James Stewart, her majesty’s advocate, having represented to the board that since her majesty had been graciously pleased to appoint the Lord [Sir James Murray of] Philiphaugh to be lord register, it would be necessary that the records, warrants, and papers belonging to the office of register now in the custody of James Johnston, esquire, or his depute keeper of lower parliament house, should be given and delivered to the present register, therefore his grace [John Campbell, duke of Argyll] her majesty’s high commissioner, and the lords of her majesty’s privy council, do hereby nominate and appoint [John Maitland], earl of Lauderdale, [Sir Hew Dalrymple] lord president of session, [Sir James Stewart of Goodtrees] lord advocate, [Adam Cockburn] lord justice clerk and [Sir James Falconer] Lord Phesdo to be a committee to see the said registers, warrants, and other papers belonging to the office of clerk register, the keys of the lower parliament house, and other keys where the said registers and records are kept, delivered up to the said Lord Philiphaugh now register by the said James Johnston, esquire, late register or his deputes and servants in the said office, and the keepers of the warrants, registers, and other papers under him upon oath, and who are also to declare upon oath that they neither have nor had any other records, warrants, or papers belonging to the said office of register than what they then deliver. And recommend to the said committee to meet at such times as they shall think convenient, and declare any three a quorum, with power to the said committee or their said quorum to do every other thing requisite and necessary to the effect foresaid. And his grace and the said lords do hereby give commission and warrant to Mr Alexander Wedderburn, secretary depute, to take the oath of the said James [Johnston], esquire, late register, in the terms above written. And his grace and the said lords declare that upon delivery of the said records, warrants, and others as aforesaid, and report of the said James Johnston’s oath, they will grant a sufficient exoneration of the same to them late clerk register and his said deputes and servants. And appoint the said secretary depute to report to the council thereanent between [now] and 24 May next to come.

Queens Letter to the Councill adding the Lord Register to the Councill

Letter from the2 Queens Majestie to the Councill for adding the Lord Register to the Councill Being read was ordered to be recorded, and his lordship being present did qualifie himselfe to her Majestie by swearing the oath of alleadgance and signeing the same with the assureance, and the Lord Chancellor did tender to his Lordship the oath de fidelii, and therafter his lordship took his place att the Board accordingly; off which letter the tenor follows.

Right trustie and Right well beloved Cousine and Councellor, Right trustie and Right well beloved Cousins and Councellors, Right trustie and well beloved Cousins and Councellors, Right trustie and well beloved Councellors, And trustie and well beloved Councellors, Wee Greet yow well, wheras in consideration of the Loyaltie and eminent abilities of our right trustie and well beloved Sir James Murray of Philiphaugh our Register, Wee have thought fitt to add him to our privie Councell ther; These are therfore to authorize and requyre yow to admitt and receive him into that our privie Councell In the ordinary forme and methode in Such cases accustomed, For doeing wherof this Shall be your warrand; And se wee bid yow heartily farwell. Given at our Court at St James’s the Sevinth day of Apryll 1705. And of our reigne the fourth year, By her Majesties Command Sic Subscribitur Alexander Wedderburne.

Letter from the queen’s majesty to the council for adding [Sir James Murray of Philiphaugh] the lord register to the council being read, was ordered to be recorded, and his lordship being present did qualify himself to her majesty by swearing the oath of allegiance and signing the same with the assurance, and [James Ogilvie, earl of Seafield] the lord chancellor did tender to his lordship the oath de fidelii, and thereafter his lordship took his place at the board accordingly. Of which letter the tenor follows:

Right trusty and right well beloved cousin and counsellor, right trusty and right well beloved cousins and counsellors, right trusty and well beloved cousins and counsellors, right trusty and well beloved counsellors, and trusty and well beloved counsellors, we greet you well. Whereas in consideration of the loyalty and eminent abilities of our right trusty and well beloved Sir James Murray of Philiphaugh our register, we have thought fit to add him to our privy council there. These are therefore to authorise and require you to admit and receive him into that our privy council in the ordinary form and method in such cases accustomed. For doing whereof this shall be your warrant. And so we bid you heartily farewell. Given at our court at St James’s 7 April 1705. And of our reign the fourth year. Commission to the Lord Philiphaugh to be Lord Register

Commission under the great seall In favours of Sir James Murray of Philiphaugh one of the Senators of the Colledge of Justice to be Lord Register, Being presented by his Lordship The samen was read and ordered to be recorded, and therafter delyvered by the Lord Chancellor to his lordship who received the samen upon his knee as use is, and therafter his lordship did qualifie himselfe to her Majestie by swearing the oath of alleadgance and subbeing the same with the assureance as Lord Register, and the Lord Chancellor did tender to his lordship the oath de fideli. Off which Commission the tenor follows
Anna dei Gratia Magnae Brittaniae , Franciae et Hyberniae Regina fidei defensor, Omnibus probis hominibus ad quos praesentes Literae nostrae pervenerint Salutem . Commission to the Lord Philiphaugh to be lord register

Commission under the great seal in favour of Sir James Murray of Philiphaugh, one of the senators of the college of justice, to be lord register being presented by his lordship, the same was read and ordered to be recorded, and thereafter delivered by [James Ogilvie, earl of Seafield] lord chancellor to his lordship, who received the same upon his knee as use is, and thereafter his lordship did qualify himself to her majesty by swearing the oath of allegiance and subscribing the same with the assurance as lord register, and the lord chancellor did tender to his lordship the oath de fideli. Of which commission the tenor follows:
Anne by the grace of God queen of Great Britain, France, and Ireland, defender of the faith, to all good men to whom our present letters will have come, greetings. Since it is abundantly satisfied to us as much about the fidelity and distinguished qualities of character as of the sincere integrity of our most faithful and loved Sir James Murray of Philiphaugh, especially indeed as far as he is entirely trained for performing the duty and office of clerk of our registers and rolls in our said kingdom; know therefore that we have nominated, constituted and ordained, just as by the tenor of the presents we nominate, constitute and ordain the said Sir James Murray, during our pleasure only, clerk of our registers and rolls of our council, session and exchequer and also of all commissions of parliaments and conventions of estates in our said kingdom. By giving and granting to him the same duty and office, during the aforesaid interval, with all honours, dignities, liberties, profits, immunities, privileges and casualties whatsoever pertaining to it, or which according to the law and practice of our said kingdom are known to pertain to it. With full and absolute power and authority to him, during our pleasure as is said, of choosing and appointing clerks substitute or depute, one or several, in the said offices or any part of it, and that for the life of such substitutes, who will obtain their offices, with all emoluments of them during all the days of their life respectively. Finally, we ordain and hand over authority to him to do and provide all and single competent to the said office according to the law and practice of this our kingdom, or provided previously by any other in the said office. In testimony whereof, we have ordered our great seal to be appended to the presents. At our court of St James’s on 7 April 1705, and in the fourth year of our reign. By the sign manual of our supreme lady the queen abovewritten.

Letter from the Queens Majestie to the Councell for adding Lord Archbald Campbell brother to the Duke of Argyle to the Councill being read was ordered to be recorded, and the said Lord Archbald being called in, His lordship did qualifie himselfe to her Majestie by Swearing the oath of alleadgance, and subscribeing the Samen with the assureance, and the Lord Chancellor did tender to his lordship the oath de fidelii; and thereafter his lordship did take his place at the Board accordingly; off which letter the tenor follows.

Letter from the queen’s majesty to the council adding [David Boyle] earl of Glasgow to the council being read, the same was ordered to be recorded, and the said earl being called in, his lordship did qualify himself to her majesty by swearing the oath of allegiance, and subscribing the same with the assurance, and [James Ogilvie, earl of Seafield] the lord chancellor did tender to his lordship the oath de fideli, and thereafter his lordship took his place at the board accordingly. Follows the tenor of the foresaid letter:
