Act Infavours off Walter Ross and others

Annent The petition given in and presented to His Grace Her Majesties High Commissioner and the Lords off Her Majesties privie Councill By Walter Ross present provest off the Burgh of Tayne, and George Viscount off Tarbat heretable Baillie therof for themselves and as Representing the Councill and Community off the said Burgh Shewing That the Tolbuith and Stiple of the said Burgh being in a ruinous Condition thir severall years by past apairt therof Did laitly fall in the night tyme Wherby the prisoners therin wer in great hazerd of ther lives and the fabrick off the petitioners Church much damnefied therby Soe that the Toun being necessitat To take doun their Stiple and Tolbuith and have entred to the said work in August last And not being in any Conditione to Rebuild the samen unless their Lordships ordaine ane volentar Contribution By all noblemen, Gentlemen, and others who will be plased to assist the said work And Therfor Creaving His Grace and Lordships To grant warrand to the said Burgh To transport their prisoners To Inverness or any other Adjacent Burgh and to Dischairge any prisoners to be offerred to them till their Tolbuith be rebuilt or for the space off five years time and to grant warrand for ane volentar Contribution By all Noblemen, Gentlemen, and others That will be plased to assist the said work for Rebuilding therof As His Grace and Lord Ships Shall please to Direct As the said petition Bears His Grace Her Majesties High Commissioner and the Lords of Her Majesties privie Councill Haveing considered the petition given into them By Walter Ross present provest of the Burgh off Tayne and George Viscount off Tarbat Heretable Baillie therof for themselves and as representing the Toun Councill and Community off the said Burgh And the samen Being read in ther presence His Grace and the saids Lords Doe heirby Grant warrant To the Magistrats off the said Burgh and ther successors in office To Intimat to and Requyre the Creditors at whose Instance the prisoners are Incarcerat withine the Tolbuith of Tayne To transport them to the nixt Adjacent publict prison or to the Tolbuith or prison off Inverness with certefication to the Creditors iff they failzie It shall be leisum and Laufull to the saids Magistrats or their successors To transport them to the said Tolbuith off Inverness And allowes and ordaines The Creditors off the prisoners to use the arristments ane their Captions after the saids prisoners are transported as accords And in the mean tyme Declaires the saids Magistrats noewayes lyable To receave other prisoners nor to be lyable for their saiff Custody For the space off Five years affter the date heirof And His Grace and the saids Lords Doe Heirby Grant to the petitioners ane volentar Contribution To be Collected From all Noblemen Gentlemen, and others, That are pleased to assist there building off the said Tolbuith and prison house off Tayne within all the paroch Churches off this Kingdome upon such dayes as the petitioners shall appoint after Intimation at the paroch Churches the Sabbath day befoir collecting therof either at the Church doors off the respective paroches or in such other manner as shall be Collected and aggreed upon by the petitioners And that for rebuilding the Tolbuith and prison of the said Burgh of Tayne And ordaines the collection to be payed into […] He allwayes befoir exacting heirof giveing bond and finding Caution acted in the books of privy Councill That the contribution sua to be collected shall be applyed to the use forsaid and that at the sight and by direction of the petitioners.

[Committee anent the Laird of Clackmannan’s canon]

The viscount of Tarbat Lord Secretary of State haveing Represented to the Councill that ther were thrie Iron and two Brass Cannon belonging to the Laird of Clackmannan which were formerly taken from him and are now Lying at Blacknes and that their were Likewayes thrie Cannon belonging to his Lordship now Lying at Invernes His Grace her Majesties high Commissioner and the Lords of her Majesties privy Councill Doe hereby Nominat and appoint the Marques of Annandale Lord President of privy Councill; The Marques of Atholl Lord privy Seall The viscount of Tarbat Lord Secretary of State, Lord Boyle Thesaurer depute, Lords Register, Advocat and Justice Clerk to be a Committie to examine the Matter above represented take tryall therof and to report, And Recommends to the said Committie to meett Munday nixt at ten of the Cloak in the forenoon, And Declares any thrie a Sufficient quorum.

Act Inlargeing Major Generall Buchan his Confinement

Anent a Petition given in to his Grace her Majesties high Commissioner and the Lords of her Majesties privy Councill by Major Generall Thomas Buchan Shewing That wher his Grace and the saids Lords were pleased to ordaine the petitioner to continue in his Chamber upon his parroll of honor which the petitioner hade with all duty obeyed And seing that there the petitioner health was much Impaired and that the petitioner was not able any longer to continue so without manifast danger therof; The petitioner doeth therfore most humbly adventure to Lay the petitioners caice before his Grace and the saids Lords That they would be pleased to reconsider the same; And Therfore humbly Craveing his Grace and the saids Lords would consider his Circumstances and to allow him Such Libertie as the present danger of his health and present Circumstances of his affairs requyred as the petition bears His Grace her Majesties high Commissioner and the Lords of her Majesties privy Councill Haveing Considered the above petition given in to them by Major Generall Thomas Buchan, And the same being Read in their presence His Grace and the saids Lords Doe heirby inlarge the petitioners confynement from his Chamber to the Toun of Edinburgh and ane myle about the same untill the twenty third day of September instant (being the day formerly appointed to him that he shall depart furth of her Majesties dominions and not to return therto without Libertie granted to him for that effect) In regaird before Extracting hereof He hath given his parroll of Honour in wryteing That he shall not exceed the bounds of his said confynement And in the mean tyme shall Live peaceably under and with all Submission to the present Government; and that he shall not act Consult nor Contrive any thing in prejudice therof; nor Converse nor Corrospond with any Rebells.
