Act Infavours off Brigadeir James Maitland

Annent The petition given in and presented to His Grace Her Majesties High Commissioner And the Lords of Her Majesties privie Councill By Brigadeir James Maitland Shewing That wher Her Majestie Haveing Granted to the petitioner under Her Royall Hand ane warrand For a Commission to be Governour of Her Majesties Fort off Fort William daited the Tenth day off Apprill Last In which the secretaryes servants have ommitted to insert a warrand For passing the same per saltum upon which account The Director off Her Majesties Chancellary Scrouples to Extend the same without their Lordships warrand For that effect And seeing their Lordships are in use to interpose their authoritie in the high court And Therfor creaving to the effect aftermentioned as the said petition bears His Grace Her Majesties high Commissioner and Lords off Her Majesties privie Councill Haveing considered the above petition given into them By Bridgadeir James Maitland And the samen being read in their presence His Grace and the saids Lords Doe heirby ordaine the Commission Granted by Her Majestie Infavours off the petitioner To be Governour off Her Majesties Fort off Fort William Daited the Tenth of Apprill Last To pass the Great seall per saltum And Grants warrand to the Director off Her Majesties Chancellary and his Deputs For wrytting therof and to the keeper off the Great seall and his Deputs For appending the same therto without passing any other Register or seall.

Act continugeing Mr Robert Douglas brother to the Earle of Mortoune and Stewart of Burrow in possession of the office of Admirality of Orkney and Zetland

Anent the Petition given in to her Majesties high Commissioner and the Lords of her Majesties privy Councill By Mr Robert Douglas brother german to the Earle of Mortone and Sir Archibald Stewart of Burray admirall deputes of Orkney and Zetland Shewing That wher the admirality of Orkney and Zetland hath still belonged to and been in the possession of Our Kings and Queens to dispose upon at their pleasure And that by the act of Parliament 1669 this admirality together with the saids Issles of Orkney and Zetland is expressly annexed to the Crown nor hade the Duke of Lennox who pretends to be admirall of Scotland ever any right or possession of the admirality of the said Issles of Orkney and Zetland Wherupon it pleased her Majesty by her Gift under the great Seall of the date the twenty fifth day of August 1702 to nominat and appoint the petitioners to be Stewart of her Majesties Stewartrie of Orkney and Zetland and Justiciars within the whole bounds and Isslands therof As also to be admirralls and Judges of admirality within the forsaid Isslands According to which gift the petitioners hath been and were in possession of the saids offices Notwithstanding wherof the Lord Blantyre as pretending to be vice Admirall of Scotland under the Duke of Lennox pretended high admirall therof had given a gift and Commission of admirality of the saids Issles of Orkney and Zetland to Sir William Craigie of Gairsey who therupon hath qualified himself before the deputs of the said principall admirall albeit the whole be of a piece and nether the Duke of Lennox as principall admirall nor the Lord Blantyre vice Admirall nor the said Admirall deputs have the Least pretence to the said Admirality of Orkney and Zetland and that this Commission was only given to Gairsey to make disturbance in these remott parts and to hinder the petitioners her Majesties admirall deputes in due execution of their office And Therfore Humbly Supplicating his Grace and the saids Lords to the effect aftermentioned His Grace her Majesties high Commissioner and the Lords of her Majesties privy Councill Haveing Considered the above petition given in to them by Mr Robert Douglas brother german to the Earle of Mortoune and Sir Archibald Stewart of Burray Admirall deputes of Orkney and Zetland and the Same being read in their presence His Grace and the saids Lords Doe hereby ordaine the petitioner to continue in possession of the office of admirallity of the Isles of Orkney and Zetland conforme to her Majesties gift and Commission of the date the twenty fifth day of August Jaj vijc and two years, And Discharges Sir William Craigie of Gairsey or any other person whatsomever to mollest or hinder the petitioners in the execution of their said office or to pretend to exerce the Samen in any sort without prejudice to all parties concerned to dissmiss their rights and pretensions in Law before the Judge ordinary as accords.

Letter from the Queens Majestie to the Councill adding William Morison of Prestongrange to the Councill Read and ordered to be recorded and the said William Morison being Called in did qualifie himself to her Majestie by Swearing the oath of alledgance and Subscryveing the Samen with the assurance; as one of her Majesties privy Councill and the Lord Chancelor did tender to him the oath de fideli and therafter he did take his place at the board accordingly. Off the which Letter the tenor followes
