Act Mr James Adamson for stipend

Anent the petition Given in to the Lords of there majestyes privie Councill be Mr James Adamsone minister of the Gospell at Etrick Shewing That whereas the petitioner hes given obedience unto the Law relateing to ministers And ame yet still willing to doe it upon which the saids Lords of there majestyes privie Councill did repell the unjust accusationes of some persones who without all ground Compleaned upon the petitioners2 to them and by ane express act granted the petitioner there protectione Yet notwithstanding the petitioner hes been both interrupted in the exercise of his ministrie by the violent attacques of those persones Contemning the sentence3 of Councill And lykewayes to the great prejudice of the petitioner Haveing wyfe and numerous familie Lyen out of his stipend since the year Jaj vjc and nyntie altho there be no other that doeth or can pretend any interest into it Nether is the petitioner aither suspended or deposed by synod or presbitrie and the patrone Sir Frances Scott of Thirlestain, Drumelziar and other heretors being willing that the petitioner should enjoy the stipend untill he be Legallie4 depryved and therefore Craveing that the saids Lords would be pleased5 according to Justice and there Lordships wonted Clemencie and gracious protectione to ministers who are Leised to Interpose there authority by ane act in the petitioners favours That he may have access into and be in a capacitie to uplift his stipend and have the benefite of the manse and gleib out of which he wes violently and contrair to all Law ejected As the said petitione beares The Saids Lords of there majestyes privie Councill haveing considered this petitione given in to them be the above Mr James Adamsone with the consent of the above Frances Scott of Thirlestain patrone of the above kirk of Ettrick They hereby allow to the petitioner the stipend of the above kirk of Ettrick for the haill cropt and year of God Jaj vjc nyntie ane years And allowes him the benefite of the manse and Gleib for that year And ordaines him to be readiely ansuered obeyed and payed of the said years stipend be the heretors fewers wodsetters titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning under the Signet of Councill to be direct at his instance againest them for that effect he produceing a decreet of Locality And in case there be no decreet of Locality ordaines the persones Lyable To make payment of there respective proportiones according as the samen shall be decerned be the Judge ordinarie In respect the petitioner hes given in to the clerks of Councill ane obleidgement subscryved be him Binding and obleidgeing himself that for the future he shall pray for there majetyes King William and Queen Mary as King and Queen of this Realme.

Act to Mr James Adamson for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr James Adamson, minister of the Gospel at Ettrick, showing that whereas the petitioner has given obedience unto the law relating to ministers, and am yet still willing to do it, upon which the said lords of their majesties’ privy council did repel the unjust accusations of some persons who without all ground complained upon the petitioner to them, and by an express act granted the petitioner their protection, yet notwithstanding the petitioner has been both interrupted in the exercise of his ministry by the violent attacks of those persons contemning the sentence of council, and likewise to the great prejudice of the petitioner having wife and numerous family lying out of his stipend since the year 1690 although there be no other that do or can pretend any interest into it, neither is the petitioner either suspended or deposed by synod or presbytery, and the patron Sir Francis Scott of Thirlestane, Drumelzier and other heritors being willing that the petitioner should enjoy the stipend until he be legally deprived, and therefore craving that the saids lords would be pleased according to justice and their lordships wanted clemency and gracious protection to ministers who are leased to interpose their authority by an act in the petitioner’s favour that he may have access into and be in a capacity to uplift his stipend and have the benefit of the manse and gleib out of which he was violently and contrary to all law ejected, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr James Adamson with the consent of the above Francis Scott of Thirlestane patron of the above kirk of Ettrick, they hereby allow to the petitioner the stipend of the above kirk of Ettrick for the whole crop and year of God 1691, and allow him the benefit of the manse and gleib for that year, and ordain him to be readily answered, obeyed and paid of the said year’s stipend by the heritors, feuers, wadsetters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the same, and ordain letters of horning under the signet of council to be directed at his instance against them for that effect, he producing a decreet of locality, and in case there be no decreet of locality ordain the persons liable to make payment of their respective proportions according as the same shall be decerned by the judge ordinary, in respect the petitioner has given in to the clerks of council an obligement subscribed by him binding and obliging himself that for the future he shall pray for their majeties King William and Queen Mary as King and Queen of this realm.

Anent the petitione given in to the Lords of there majestyes privie Councill be Mr John Fraser minister at Woodhouslie, Shewing that where the petitioner did preach in the Kirk of Woodhouslie at the Invitatione and Call of the patrone and heretors of that paroch a Considerable tyme in the year Jaj vjc nyntie one befor he wes settled minister thereof or could have access to the Legall stipend And there being some vacand stipends Lyeing over in the hands of the heretors The aforsaid patrone Judges most equitable that one half years stipend of the cropt and year Jaj vjc nyntie one be disposed of to the petitioner And hes testified his willingnes and Consent to that effect under his hand As the samen produced with the said petitione more fully bears And therefore Craveing that the saids Lords would be pleased In regaird that the petitioner did preach a considerable tyme in the paroch of Woodhouslie befor his setlement there And that he is the present minister of that place To pass ane act for the petitioner obtaining the aforsaid half years stipend of the cropt and year Jaj vjc nyntie one of the said paroch of Woodhouslie in a Legall way As the said petitione bears The Saids Lords of there Majesties privie Councill haveing considdered this petitione given in to them be the above Mr John Fraser with the consent of the patrone produced therewith They allow the petitioner the stipend of the above Kirk of Woodhouslie for the last half of the cropt and year Jaj vjc nyntie one And ordaines the heretors fewers wodsetters Lyfrenters titulars tacksmen of teynds tennents possessors and others Lyable in payment To make payment thereof to the petitioner And ordaine Letters of horning to be direct at his instance against them for that effect upon production of a decreet of Locality And in case there be none ordaines these Lyable To make payment of there respective proportiones according as they shall be decerned be the Judge ordinarie And ordaines the saids Letters of horning to be direct under the signet of Councill In respect the petitioner hes given in to the Clerks of Councill ane obleidgement under his hand That for the future he shall pray for there majestyes King William and Queen Mary as King and Queen of this Realme.

Act to Mr John Fraser for stipend

Concerning the petition given in to the lords of their majesties privy council by Mr John Fraser, minister at Woodhouselee, showing that where the petitioner did preach in the kirk of Woodhouselee at the invitation and call of the patron and heritors of that parish a considerable time in the year 1691 before he was settled minister thereof, or could have access to the legal stipend, and there being some vacant stipends lying over in the hands of the heritors the aforesaid patron, judges most equitable, that one half year’s stipend of the crop and year 1691 be disposed of to the petitioner, and has testified his willingness and consent to that effect under his hand, as the same produced with the said petition more fully bears, and therefore craving that the said lords would be pleased in regard that the petitioner did preach a considerable time in the parish of Woodhouselee before his settlement there, and that he is the present minister of that place, to pass an act for the petitioner obtaining the aforesaid half year’s stipend of the crop and year 1691 of the said parish of Woodhouselee in a legal way, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr John Fraser, with the consent of the patron produced therewith, they allow the petitioner the stipend of the above kirk of Woodhouselee for the last half of the crop and year 1691, and ordain the heritors, feuers, wadsetters, liferenters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment to make payment thereof to the petitioner, and ordain letters of horning to be directed at his instance against them for that effect upon production of a decreet of locality, and in case there be none ordain those liable to make payment of their respective proportions according as they shall be decerned by the judge ordinary, and ordain the said letters of horning to be directed under the signet of council in respect the petitioner has given in to the clerks of council an obligement under his hand that for the future he shall pray for there majesties King William and Queen Mary as King and Queen of this realm.

Act Mr George Purvis for stipend

Anent the petitione Given in to the Lords of there majesties privie Councill be Mr George Purvis minister at Glencorss Shewing That albeit the petitioner did give all obedience to the act of the Estates the threetteint day of Apryll Jaj vjc Eighty nyne and all other acts emitted by authority Enjoyneing fasts and thanksgivings by reading these acts from the pulpitt and constantly prayeing for there majesties King William and Queen Mary And accordingly obtained ane act of the Comittee of estates in his favours upon the seventh of Maij Jaj vjc Eighty nyne produced with the said petitione bearing that he did give obedience to the said proclamatione of the dait the said thretteint day of Apryll Jaj vjc Eightie nyne And ordaining some of the heretors to protect him in the exercise of his ministrie not with standing of all which a few of the meanest of the people of that pariochine did violently upon a sabbath day, pull the petitioner out of the pulpitt and discharge him preaching further there under the pain of death And sieing the stipend for the cropt Jaj vjc nyntie one is as yet due and undisposed of, and the petitioner in verie great straitts and difficultyes and hes not whereupon to Subsist And sieing the patrone of the paroch hes consented that the petitioner gett that stipend as the consent Lykewayes produced with the said petitione hes testifyed and therefore Craveing that the saids Lords would be pleased to ordaine the heretors and others Lyable to make payment to the petitioner of the said stipend for the said year Jaj vjc and nyntie one And ordaine Letters upon production of a decreet of Locality at his instance for that effect And in case there be none to ordaine these Lyable to make payment to him of there respective proportiones of the said stipend according as they shall be decerned be the Judge ordinarie As the said petitione bears The Saids Lords of there majesties privie Councill Haveing Considered this petitione given in to them be the above Mr George Purvis with the act of Convention of Estates and consent of the patrone produced thereith They allow to the petitioner the stipend of the above kirk of Glencorss for the first half of the cropt and year Jaj vjc nyntie one And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers Lyfrenters titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning to be direct at his instance againest them for that effect upon productione of a decreet of Locality And in case there be none ordaines these Lyable To make payment of there respective proportiones according as they shall be decerned be the Judge ordinary And ordaines the saids Letters of horning to be direct under the Signett of Councill In respect the petitioner hes given in to the Clerks of Councill ane obleidgement under his hand Binding and obleidgeing himself That for the future He shall pray for there majesties King William and Queen Mary as King and Queen of this realme.

Concerning the petition given in to the lords of their majesties’ privy council by Mr George Purvis, minister at Glencorse, showing that albeit the petitioner did give all obedience to the act of the estates 13 April 1689 and all other acts emitted by authority enjoining fasts and thanksgivings by reading these acts from the pulpit and constantly praying for their majesties King William and Queen Mary, and accordingly obtained an act of the committee of estates in his favour upon the seventh of May 1689 produced with the said petition bearing that he did give obedience to the said proclamation of the date the said 13th day of April 1689 and ordaining some of the heritors to protect him in the exercise of his ministry notwithstanding of all which a few of the meanest of the people of that parish did violently upon a sabbath day, pull the petitioner out of the pulpit and discharge him preaching further there under the pain of death, and seeing the stipend for the crop 1691 is as yet due and undisposed of, and the petitioner in very great straits and difficulties and has not whereupon to subsist, and seeing the patron of the parish has consented that the petitioner get that stipend as the consent likewise produced with the said petition has testified, and therefore craving that the said lords would be pleased to ordain the heritors and others liable to make payment to the petitioner of the said stipend for the said year 1691, and ordain letters upon production of a decreet of locality at his instance for that effect, and in case there be none to ordain those liable to make payment to him of their respective proportions of the said stipend, according as they shall be decerned by the judge ordinary, as the said petition bears. Act Mr James Buchanan for stipend

Anent the petitione Given in to the Lords of there majestyes privie Councill be Mr James Buchanan minister at Balfrone Shewing That where the petitioner wes called to be minister at the said paroch by the unanimous consent of the haill heretors and pariochiners and served the cure thereat upwards of Tuenty fyve years And gave obedience to the act of the meeting of the Estates daitted the thretteint day of Apryll Jaj vjc and Eightie nyne whereby the petitioner wes under the protectione of the government Notwithstanding whereof within a short tyme there after The petitioner and his haill family wes most violently thrust from his duelling house by the rabble who broke and destroyed his plenishing and books beatt his wyfe and servants In Consideration whereof William Viscount of Strathallan undoubted patrone of the said paroch Gave and disponed the vacand stipend thereof to the petitioner for the half of the year Jaj vjc nyntie and wholl year Jaj vjc nyntie one with the product and benefite of the Gleib As the said Gift produced with the said petitione hes testified And sieing there is no persone can pretend right to the said years stipend or to the product of the gleib And that the samen wes granted to the petitioner in remuneratione of the manse and office houses and Improvement of the Gleib By which (2If nead were The petitioner can depone he wes at as much Loss and expenses as the years stipend and benefite of the gleib will amount to And therefore craveing to the effect underwreitten as the said petitione bears The Saids Lords of there majesties privie Councill haveing considdered this petitione given in to them be the above Mr James Buchanan with ansuers made thereto be the heretors of Balfron and wreitts produced for aither pairty They hereby allow the petitioner the stipend of the above kirk of Balfron for the half of the year Jaj vjc nyntie and Jaj vjc and nyntie one and benefite of the gleib and ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers Lyfrenters titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning to be direct at his instance againest them for that effect He produceing a decreet of Locality and in case there be no decreet of Locality ordaines the persones Lyable to make payment to him of there respective proportiones according as the samen shall be decerned be the Judge ordinary In respect the petitioner hes given in to the Clerks of Councill ane obleidgement subscryved be him obleidgeing himself That for the future he shall pray for there majestyes King William and Queen Mary as King and Queen of Scotland.

Act to Mr James Buchanan for stipend

Concerning the petition given in to the lords of their majesties privy council by Mr James Buchanan, minister at Balfron, showing that where the petitioner was called to be minister at the said parish by the unanimous consent of the whole heritors and parishioners and served the cure thereat upwards of twenty five years, and gave obedience to the act of the meeting of the Estates dated 13 day of April 1689 whereby the petitioner was under the protection of the government, notwithstanding whereof within a short time thereafter the petitioner and his whole family was most violently thrust from his dwelling house by the rabble who broke and destroyed his plenishing and books, beat his wife and servants, in Consideration whereof William [Drummond] Viscount Strathallan, undoubted patron of the said parish gave and disponed the vacand stipend thereof to the petitioner for the half of the year 1690 and whole year 1691 with the product and benefit of the gleib as the said gift produced with the said petition has testified, and seeing there is no person can pretend the right to the said years’ stipend or to the product of the gleib, and that the same was granted to the petitioner in remuneration of the manse and office houses and improvement of the gleib by which (if nead were) the petitioner can depone he was at as much loss and expenses as the years’ stipend and benefit of the gleib will amount to, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr James Buchanan with answers made thereto by the heritors of Balfron and writs produced for either party, they hereby allow the petitioner the stipend of the above kirk of Balfron for the half of the year 1690 and for 1691 and benefit of the gleib and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuers, liferenters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the same, and ordain letters of horning to be directed at his instance against them for that effect, he producing a decreet of locality, and in case there be no decreet of locality ordain the persons liable to make payment to him of their respective proportions according as the same shall be decerned by the judge ordinary in respect the petitioner has given in to the clerks of council an obligement subscribed be him obliging himself that for the future he shall pray for their majesties King William and Queen Mary as King and Queen of Scotland.

Liberation Porterfield of Comistoun

Anent the petitione Given in to the Lords of there majesties privie Councill be Patrick Porterfield of Comistoun Shewing That the petitioner haveing been by there Lordships warrand keept prisoner within the tolbooth of Edinbrugh these severall weeks bypast True it is that by reasone of the seasone of the year and unwhollsomenes of that prisone the petitioners health is so Impaired that In case he shall be any Longer keept from the benefite of the free air, His recoverie may prove aither doubtfull or desperate as does appear by the certificat produced with the said petitione under the hands of tuo phisicians Doctor Burnet and Doctor Trotter And therefor Craveing that the saids Lords would be pleased to considder the premises and ordaine the petitioner to be sett at Liberty upon finding sufficient Cautione to appear befor there Lordships when called for As the said petitione bears The Saids Lords of there majesties privie Councill haveing considered the within wreitten petitione Given in to them be the within Patrick Porterfield off Comistoun with the certificat mentioned therein and produced therewith They hereby give order and warrand to the magistrats of Edinburgh and Keeper of there tolbooth to sett at Liberty the said Patrick Porterfield furth of the same In respect he hes found sufficient Cautione acted in the books of privie Councill that he shall Live peaceablie and with all submissione under the present government of there majestyes of there majestyes2 King William and Queen Mary And that he shall not act consult nor contryve any thing in prejudice thereof nor converse nor correspond with any rebells And that he shall appear befor the saids Lords of privie Councill upon the second day of August next to come under the penalty of Fiftie pound sterling In case the petitioner shall transgress any pairt of the premises.

Liberation of Porterfield of Comiston

Concerning the petition given in to the lords of their majesties’ privy council by Patrick Porterfield of Comiston showing that the petitioner having been by their lordships warrant kept prisoner within the tolbooth of Edinburgh these several weeks bypast, true it is that by reason of the season of the year and unwholesomeness of that prison the petitioner’s health is so impaired that in case he shall be any Longer kept from the benefit of the free air, his recovery may prove either doubtful or desperate as does appear by the certificate produced with the said petition under the hands of two physicians Doctor Burnet and Doctor Trotter, and therefore craving that the said lords would be pleased to consider the premises and ordain the petitioner to be set at liberty upon finding sufficient caution to appear before their lordships when called for, as the said petition bears. The said lords of their majesties’ privy council having considered the within written petition given in to them by the within Patrick Porterfield of Comiston with the certificate mentioned therein, and produced therewith, they hereby give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to set at liberty the said Patrick Porterfield furth of the same, in respect he has found sufficient caution acted in the books of privy council that he shall live peaceably and with all submission under the present government of their majesties King William and Queen Mary, and that he shall not act, consult or contrive anything in prejudice thereof, nor converse or correspond with any rebels, and that he shall appear before the said lords of privy council upon the second day of August next to come, under the penalty of fifty pounds sterling in case the petitioner shall transgress any part of the premises.
