Act Reponing James Dunbar against a Certificat

Anent a Petition given in to His Majesties high Commissioner and Lords of his Majesties privy Councill be James Dunbar of Dalcross shewing That wher the Lady Strowan for her self and as assigney to Margarat Robertson her daughter, and to John Robertson alias Gilibreck her ground officer with concourse of his Majesties Advocat hade raised a Complaint before the said Lords against Duncan Robertsone her sone, and others his accomplices for severall Ryots alleadged Committed by the said Duncan on the said Lady and her Cedents, Which Complaint makes mention that the petitioner became Cautioner of Laborowes acted in the saids Lords books for the said Duncan under the paine of one Thousand merks Bot bears no warrand to cite the petitioner, notwithstanding quherof the petitioner gott ane full Copie of the said Complaint given him to Compear before the saids Lords upon the Threttie day of July last by past, and though the petitioner was nowayes concerned with the matter of the Complaint, yet he did wait in the Councill outter room upon the said Threttie day being Tuesday and the Thursday therafter at either of which dyets the said Complaint was not called or insisted in, Bot on the Frayday therafter the said Lords haveing sett the said Complaint was called, Tho the pursuer was absent and Certification granted against the petitioner Against which it was not doubted Bot the Lords would repone the petitioner Because primo the petitioner would make it appear that the subject of the Complaint does nowayes concerne the petitioner as actor Airt or part Secundo the Letters bears no warrand for citeing of the petitioner as his copie therwith produced would testifie Tertio the petitioner could instruct by severall famous witnesses and servants about the Councill Chamber that the petitioner attended the forsaid two dyets of Councill and that same day the forsaid Complaint was called the petitioner was ready to have Compeared hade the petitioner knowen what the saids Lords would have medled in any privat Bussines, and besides the petitioner could instruct that the petitioner had stayed in toune of Edinburgh because of the Citation given the petitioner on the said Complaint more then thir twenty dayes And Therfore Humbly supplicating the saids Lords to the effect aftermentioned as the said petition bears His Majesties privy Councill haveing Considered the above petition given in to them be James Dunbar of Dalcross They have Reponed and hereby Repones the petitioner against the above Certificaitone dated the second day of August instant and discharges the Extracting of the said Certificatione against the petitoner

Anent the petition given in to the Lords of his majesties privy Councill be Margaret Lady Naper Shewing That upon the petitioners brother the late Lord Napers death ther were two trunks of papers Consigned in the Councill office, And after the petitioner was served heir, the petitioner in the year Jaj vjc Eightie Eight a Warrand for getting up the petitioners papers Bot throw mistake the petitioner gott up only one trunk and the other Lyes thir still, which by the saids Lords Order, The Lord Aberuchill has gone thorow and found therin no other papers Bot what are the petitioners Bot the Inventaring being a work of time, And the Clerks servants not haveing so much to spare as to do it with that exactnes as is requyred, And the petitioner being willing to give her recept of the Trunk and papers therin contained Consigned as a forsaid in amplar And Therfore humbly Supplicating the saids Lords to the effect aftermentioned as the said bill bears His Majesties high Commissioner and the Lord’s of his Majesties privy Councill; Haveing Considered this petition given in to them by the above Lady Naper Craveing up a trunk with papers, Which are in the Clarks of Councills hand They hereby Grant the desyre therof, and Allowes the papers to be given up upon the Ladies oun recept or her factors.

Follows the Tenor of his Majesties Letter which being read was ordered to be Recorded.
His Majesties most Gracious Letter, Directed To his Grace James Duke of Queensberry, His Majesties high Commissioner and the privy Councill of Scotland.

Right Trusty and Entirely beloved Cousin and Councellor Right Trusty and Right welbeloved Cousin and Councellor Right Trusty and welbeloved Cousins and Councellors, Right Trusty and welbeloved Councellors, and Trusty and wellbeloved Councellors. We greet yow well. We heartily wish, That the last meeting of Parliament, hade proveeded so as that the Kingdom, might have been made partakers of these advantages For which our Commissioner was so Fully Instructed, If It hade been possible for us, To have agreed to the Resolve offered To assert, The Right of the African Companys Colony in America, Tho That Method hade appeared to us more unnecessary yet we hade from the beginning Readily done it att the Earnest desyre of our ministers and for our peoples Satisfaction all other Considerations set apairt, But now That Things are much Changed wherin we are Truly Sorry for the Nations Loss, And we being most willing to grant what may be needfull for the Releiff and Ease of the Kingdom, and the Advancement of its wellfare in all its Concerns, We have Thought Fitt To declare this our good mind to be made Known to all our Loving Subjects, And for the Company’s Concernes We assure yow That we will be so Ready to Concurr with our Parliament, In Every Thing That Can be Reasonably Expected of us, for aiding and Supporting their Interests and Repairing their Losses, That our good Subjects shall have Just grounds to be Sensible of our hearty Inclinationes, To Advance the Wealth and prosperity of that our ancient Kingdom And as for Captain Pincartoun and the other prisoners in Spain, we have already and we hope Effectually Interposed for their Liberation. In the next place as we did Fully Instruct our Commissioner, so we are Still Resolved To pass all such Laws as shall be offered for the better Establishing the True Protestant Religion, and the Presbeterian Government of the Church, which yow att present Enjoy for the more Effectuall preventing The Growth of Popery Justly Feared for the Repressing of vice and Immorality, For the preserveing and Secureing the Liberty of mens persons, for the Encouradgeing and advancement of Trade, and Manucatories and Generally to give our assent to such other Laws, as shall be brought in For furder Clearing and Secureing mens civill Rights and properties, promoting the Administration of Justice, and Setleing the peace and Quiet of the Kingdom demanding nothing on our pairt, Save what shall be necessary To maintain That our ancient Kingdom, In so happy a Setlement against our and their Enemies, And This Declaration we are Confident will be satisfying to all good men, who will Certanly be Carefull, both of their own preservation and Interest and Honour of the Government, and not to Suffer themselves To be misled, nor to give any advantadge to Enemies, and ill designing persones Ready to Catch hold of Every opportunity as their practices do too manifestly Witness. The Proclamation underwritten being prepared was Read voted approven and Signed. and ordered to be published and Recorded, wherof the Tenor Follows.
William By the Grace of God, King of Great Brittain France and Ireland defender of the faith, To our Lyon King att armes, and his Bretheren Herualds, macers of our privy Councill, Pursevants, Messengers at armes our Sheriffs in that pairt Conjunctly and Severally Specialy Constitute Greeting. Forasmuchas, We be our Proclamation of the date, The First day of July last by past did adjourn this Current Parliament of this our ancient Kingdom of Scotland, To the Thirteenth day of August then next to Come now Instant: And Whereas The Circumstances of our affairs, doe Still Continue such as will not allow of the sitting of our Parliament on the said Thirteenth day of August Instant, unto which it was last adjourned: And we Judging That it may be necessary, we should Return to Brittain before the meeting thereof; Therfore and That the members of our said Parliament, may not be put to unnecessary, Trouble, Charges and attendance. Right Trusty and Entirely beloved Cousin and Councellor Right Trusty and Right welbeloved Cousin and Councellor Right Trusty and welbeloved Cousins and Councellors, Right Trusty and welbeloved Councellors and Trusty and welbeloved Councellors. We greet yow well. Whereas The Circumstances of our affairs doe still Continue such as will not allow of the Sitting of our Parliament on the Thirteenth day of August next to which it was last adjourned, And we Judgeing, That It may be necessary We should Return to Brittain, before the meeting there-of That the members may not be put To unnecessary Troubles and Charges, We doe authorize and Require yow To Issue forth a Proclamation in our name, adjourning our said Parliament from the said Thirteenth day of August, To the Two and Twentieth of october next, And we being Firmly Resolved, The Parliament shall then meet, yow are to order all the members to attend that day att Edinburgh in the usual way and upon the accustomed Certificationes, For doing wherof This shall be your warrand So we bid yow heartily farewell, Given att our Court at Loo The Twenty Sixth of July i700. And of our Reign the 12th year. By his Majesties Command. Sic Subscribitur Robert Pringle.
