Act William Anderson against John Crafurd agent for Roscoby

Anent the petition given in to the Lords of his Majesties privy Councill be William Andersone later Dean of Gild of Dumermling Shewing That in the proces depending before the saids Lords at the petitioners instance Against Allan Walkinshaw for the highneous Ryot and Manifold oppressions Committed by him against the petitioner of sett purpose and designe to reduce him to beggery by Screwing up a pretended debt against the petitioner for a farr greater Soume then ever the petitioner was due And Compelling the petitioenr to acknowledge the Same, For accomplishing of which wicked designe of his he took this most oppressive and Sinistreous methode amongst severall others, First gave order to James Muttray his attorny as he is designed in the executione produced by Walkinshaw himself to Seaze all the petitioners wrytes and papers under pretence of poynding the petitioners houshold goods, and in the nixt places least any of the petitioners papers might have Escaped their Malicious hands at the said pretended poynding they broke open the petitioners Latron and Cabinet and Suffered the petitioners wrytes and other papers to be dispersed and Scattered in the house upon the Stairs and Streets ther to be trampled upon torne and Caried away at the pleasure of all Comers and gangers, Which is not only clearly proven by the depositiones of severall witnesses taken before the Committie of the saids Lords number, Bot also that Walkinshaw himself and his agent produced before the petitioner in prisoner in the Cannogate Tolbooth at their instance severall bonds and other principall wrytes of the petitioners Which they hade most unwarrantably Seazed upon in maner forsaid, and their forced the petitioner to dispone the same to Walkinshaw And albeit the petitioner could have made it appear by discharges and other Documents in wryt that all the debt the petitioner was owing to Walkinshaw was not above Fiftie fyve pounds Sterling if the petitioners papers hade not been Imbazled in maner forsaid, And yet the petitioner was able to prove by witnesses above all exception that Walkinshaw acknowledged the same with the great Imprecationes upon himself if it was more according as the petitioner hade Lybelled But that the Committie demurr to examine witnesses upon this point of the petitioners Lybell untill they Imbazleing of the petitioners papers were proven And the saids Lords acquainted therwith Which is now fully and clearly done seing then that Walkinshawes Letter to Moultrey are in the hands of John Crafurd wryter his Agent And that Moultrey himself being cited as a witnes went away before his oath was Concluded, As also that the petitioner hade Clearly proven how the petitioners papers hade been Imbazled wherby it was absolutely necessary the witnesses be examined as to the forsaid point of the petitioners Lybell for Clearing how greivously the petitioenr hade been wronged and oppressed by Walkinshaw and Likewayes that he might not reap such unjust advantadge by his oun fraud and oppression And Therfore humbly Craveing the saids Lords would be pleased To ordaine the said John Crafurd Agent for Moultrey to exhibit and produce the Letters in the Clerks hands directed by Walkinshaw to him for seazing and Imbazleing the petitioners papers As Likewayes Grant Warrand to Seize and apprehend the said Multrey that he might come here and answer such Interrogators as should be put to him in the said matter before his oath be Concludit And in the mean time to allow the Comittie to take the Oathes and depositiones of the witnesses already cited upon the forsaid point of the Lybell against Walkinshaw As the said petition bears, The Lords of his Majesties privy Councill Haveing Considered the above petition given in to them by the above William Andersone and another by Allan Walkinshaw by way of answers therto They hereby Ordaine the above John Crafurd mentioned in Andersones bill Agent for Murray of Roscobie to exhibit and produce the Letters in the Clerks hands directed by Walkinshaw to Moultray of Roscoby for seazing and Imbazleing of Andersones papers, And Likewayes Grants Warrand to maccers of privy Councill or messengers at armes to seaze and apprehend the persone of the said Moultrey of Roscoby untill he Compear before the Committie appointed in the above process, and answer to such Interogators as shall be put to him in the above matter, And in the mean time delayes answers to the takeing the oathes and depositiones of the witnesses already cited upon the above point of the Lybell against Walkinshaw as to his acknowledging the quota of the debt is

Act In favours of Alexr Maxwell Post-master at Air

Anent The Petition given in to the Lords of his Majesties privy Councill By Alexander Maxwell Post-master att Air Shewing That their Lordships by their act of the Fifteen of December Jaj vic nynty Eight, having granted Commission to him To put the Acts and proclamationes made against the Importing of Irish Cattle to due Execution. And To Seaze and apprise such as should be Imported after his Commission att any pairt betwixt the Firth of Sillway and the Sound of Mull, and to Exact Ane Hundered merks from the Importer or Resetter of Each Beast, The one half wherof to be furthcoming to the Lords of Thesaury; And For hes Encouragement not only allowed him the Kings half of the Said Seafares; But likeways Recomended2 him to the Saids Lords of Thesaury for Ane Hundered pound Sterling, And he having Found Sufficient caution, For his faithfull Executeing the said Commission under the pain of Two Hundered pound Sterling, And having accordingly used his outmost Endeavors, and all the diligence that man was Capable to use; And having severall tymes gone over the whole Bounds of his Commission, and Established waiters and Spyes over all the Coast, which put him to Considerable charge and Expenses. And upon the notice or discovery of any Irish Cattell having procured parties sometymes of Souldiers, and at other tymes of Countrey men and Servants to his assistance he always made or Endeavoured to make Seazure of all Such Cattell, as he could discover to be Imported, To the hazard oftimes of his own and the lives of these Imployed by him, And many tymes after Seasures have been made and the horse gott into his Custody, He and those Imployed by him, have been assaulted by greater numbers and Force and their selves wounded and the horse rescued, whereof many Instances can be given, Particularly once at the Gorbells of Glasgow, his pairty was besett by a great number of men and discharged by them, and Four horse taken from them and another tyme att Lochwinzeoch his pairtie mett with the same Treatment, and Two Horse were Taken from them, and many other Instances could be given, So That albeit he rides always in the night time, and is att great charge with pairties whom he must carry along with him, and hes been Sometymes five or Six Weeks absent from his house att one tyme, and all that space scarce Three or Four night in his Bed, yet when any Seazures is gott, he runs Less hazard in keeping therof, unless he have considerable force, for his Security, and there preservation, And Seing the saids Seazures are not Sufficient to defray the Expenses he is thereby necessarly put to; And Seing also Severall other persones take upon them, to make Sham Seazures, and upon pretence thereof, and for small Compositiones being neither lyable to any diligence nor accountable for these actiones connive att and Encourage the Importation and Render his Endeavours both more odious and In Effectuall And Seing also the Souldiers oftimes decline, To give their assistance, albeit he mantains them and defrays all their Charges whom he Employs and he being Resolved by all means possible to make the Restraint Effectuall, So that dayly he is to Expect fewer Seasures. Sir James Stewart His Majesties Advocat Having Represented to the Lords of his Majesties privy Councill That John Burg ane Irishman is prisoner in Edinburgh Tolbooth for Thift, and having lyen Twenty Two moneths in prison, Is not yet brought to a Tryall, And That Being a Stranger he is willing to undertake Banishment and not Return under the pain of death, The Saids Lords doe heirby of Consent of the said John Burg, Banish him furth of the Kingdom of Scotland, And appointes him to depairt Furth of the Samen, Betwixt and the Twenty fifth of January Instant, And discharges him to Return therto in tyme coming without his Majesty or the Councills Warrand for that Effect and that under the pain of death, And ordaines the magistrats of Edinburgh and keeper of their Tolbooth, To set him att liberty in order to his Banishment In Respect of the said John Burg hes before Extracting heirof Enacted himself in the books of privy Councill, That he is willing to be banished furth of the Kingdom of Scotland, and hes oblidged himself, To depart Furth of the Same Betwixt and the Said Twenty Fifth day of January Instant, And never Return thereto, under the pain of death as said is.

Wee greet yow well. We have considered the petition offered to us by John Frazer of Miggavie and Hugh Frazer of Leuchloin, Wherin they Represent That haveing been forfeited in absence and condemned to dy, For their accession to the Convocation of our Subjects raised by Captain Simeon Frazer. And haveing been afterwards taken, they are at present under Sentence of death, to be Executed the First day of December next; And Craving That in Consideration of their having been Sentenced to die in absence, and of other circumstances which pleads for our Royall mercy, We would think fitt To Reprive them, untill we may be fully Informed of their caice, It is therfore our will and pleasure, and we heirby authorize and Require yow, To grant a Reprive to the Said John and Hugh Frazers of the forsaid Sentence of death, till the Twentieth day of January next; And in the mean tyme yow are to Transmitt to us the full and clear State of that affair and of their concern therin That we may give Such further orders as well Shall Judge necessary, For doing wherof this Shall be your Warrant And so we bid yow heartily farewell. Right Trusty and right welbeloved Cousin and Councillor Right trusty and Entirely beloved Cousin and Councellor, Right Trusty and welbeloved Cousines and Councillors, Right trusty and welbeloved Councillors, And Trusty and welbeloved Councellors. Wee greet yow well. We have considered the petition offered to us by John Frazer of Miggavie and Hugh Frazer of Leuchloin, Wherin they Represent That haveing been forfeited in absence and condemned to dy, For their accession to the Convocation of our Subjects raised by Captain Simeon Frazer.
