Act
The Lords of his Majesties privie Councell Doe heirby appoint and ordaine all the horses which are seased from persons refuising the oath of alleadgance and assurance to his Majestie uithin the shires or burghs or others follouing viz the shire of Jedburgh the Toune of Culross Regality of Glasgow Regality of Culross shire of Linlithgow shire of Fife Touns of Couper Air and Stirling shires of Kinross Stirling Edinburgh and steuartry of Falkland and shire of Drumfreis From whom reports are Come to the Councell Anent the seasing of such horses or arms To be rouped and publickly sold to the persons who shall offer most for the saids horses To be caryed and publictly sold to the persons who shall offer most for the saids horses2 The pryce of each horse being above ane Hundred merks at Least And appoints the shirreffs of the saids shires and the magistrats of the head burgh of each shire To Cause make publick Intimation at the mercat Croce of the head burgh therof upon the first mercat day after thir presents shall Come to their hands That the roup of the saids horses in ther shire shall be upon the nixt mercat day Imediatly after the said day of Intimation And appoints the saids magistrats of the head burgh and shirreffs to see the saids horses rouped and sold at the pryce forsaid and to take care that the pryces of the horses which shall be sold by them or at their sight as said is uithin their respective shires be transmitted Immediatly after they are sold to the Lords Commissioners of his majesties Thesaury or any other persone whom their Lordships shall appoint And in case any of the saids horses shall not be sold uithin the saids shires at the tyme and pryce above sett doune Then appoints the shirreffs and magistrats of the head burghs to transmitt these horses to the toune of Edinburgh and putt them into stables uithin the said toune And to delyver to the magistrats of Edinburgh a List of these horses and of the names of the stablers In whose stables they are putt And appoints the Magistrats of Edinburgh and the shirref of the shire of Edinburgh upon the first horse mercat day After the Lists Comes to their hands To Cause make publict Intimation that these horses are to be rouped and sold in the Grass mercat of Edinburgh upon the first horse mercat day Immediatly therafter And appoints the magistrats of Edinburgh and shirref of the said shire of Edinburgh to see the saids horses rouped and sold And to take care that the pryces of them be payed in to the saids Lords Commissioners of Thesaury or any they shall appoint In manner above set doune And appoints the shirreffs and magistrats of the shires and burghs and others forsaids who Conforme to the Act of parliament and proclamatione of Councell have seased the arms of persons not qualified To Cause3 transport the arms seased by them to any of the garrisons of Edinburgh Stirling Dumbartoun Blacknes Invernes or Dunottar which are nighest to the place wher the seased arms are Lying To be made furthcoming for the service of his Majestie and the Government whensoever the same shall be Called for

The Earle of Annandale Having acquanted the Lords of his Majesties privie Councell That Conform to their Lordships order He had Caused apprehend […] Irving of Stank whom he hes Committed to the tolbooth of Drumfreis And that he is Informed that the said […] Irving of Stank is not able to mantaine himself in prisone The saids Lords doe heirby Give order and warrand to the Magistrats of Drumfreis and Keeper of their tolbooth to sett the said […] Irving of Stank at Libertie furth therof He first suearing and signing the oath of alleadgance and subscribing the assurance appointed to his Majestie King William by Act of parliament and that in presence of any of the saids magistrats of Drumfreis And appoints the saids magistrats to transmitt the said oath of alleadgance and assurance to the Clerks of his Majesties privie Councell Immediatly after the same shall be suorne and signed by the said Irving of Stank And the magistrat in whose presence the same is done Doe also subscribe the samen

Anent the petitione given in to the Lords of his Majesties privie Councell By Alexander Taite Skipper in Leith Sheuing That wher the petitioner hath been detained closs prisoner uithin the tolbooth of Edinburgh since the first day of March Last till within these very few dayes By which Long and closs restraint not only he is prejudged as to his affairs and bussiness But he hath also therby Contracted bodily distempers which dayly Increasses And by a Continowed Imprisonment may prove mortall And seing the petitioner Hath found Caution beyond exceptione to Live peacably under the Government as he alwayes Did and does Inclyne to doe And is Content to renue the samen And therfore Humbly Craving their Lordships would be pleased to ordaine the petitioner to be sett at Libertie or otherwayes that their Lordships would be pleased to Grant him ane Act of Banishment And to allow some Competent tyme For ordering his affairs which are in very great Confusione and in the mean tyme during his abode in this kingdome He shall find sufficient Caution to Live peacably and to goe abroad at such tyme as their Lordships shall think fitt as the said petitione bears The saids Lords of his Majesties privy Councell Having Considered this petitione given in to them by the said Alexander Taite They heirby Give order and warrand to the magistrats of Edinburgh and Keeper of their tolbooth To sett the petitioner at Libertie furth therof He first appearing before Sir James Steuart his Majesties Advocat and Enacting himself in the books of his Majesties privy Councell In such tearms and under such penaltie as his Lordship finds he hes allowance for from his Majestie That he shall depart furth of his Majesties dominions and that within such a tyme as the Lord Advocat shall appoint And also first Giving bond and finding sufficient Cautione acted in the books of privie Councell That he shall Live peacably under and uith all submission to the present Government of his Majestie King William And that he shall not Act Consult nor Contrive anything in prejudice therof nor shall not Converss or Correspond uith any rebells And that he shall appear before the saids Lords of his Majesties privie Councell whensoever he shall be Called for or requyred therto In caise he shall be Called for before he Depairt the dominions And that under the penaltie of tuo Hundred pounds sterling In caise he shall transgress in any pairt of the premisses And upon Giving new bond appoints the Last bond to be Given up Before Extracting of this Act Compeared the said Alexander Taite In presence of his Majesties Advocat Conform to his Lordships report after insert wherof the tenor Followes Att Edinburgh the Eighteenth day of Apryll Jaj vjc nyntie six years Compeared before Sir James Steuart his Majesties Advocat Alexander Taite skipper in Leith And ther conform to ane ordinance of the Lords of his majesties privy Councill of the date the sixteenth day of Aprile instant Band obleidged and Enacted himself in the Books of privy Councell That he shall depart Furth of this Kingdome and of his majesties haill other dominions betuixt and the Tenth day of June nixt to Come or sooner at any tyme after the fifth day of may nixt In caise the Lords of his majesties privy Councill shall think fitt That he depart before the said tenth day of June nixt As Lykeuayes that being furth of this Kingdome and his majesties other dominions He shall not goe to any of the dominions of the french King uith whom his Majestie is in present open warr But shall abyde furth of this Kingdome and his majesties other Dominions and not goe to the dominions of the French King uithout his Majesties express warrand As Lykewayes that during his forsaid abode abroad as said is He shall not Contrive or Act against his Majestie his government forces or allayes directly or Indirectly in any sort and that under the pains Contained in the act of parliament Jaj vjc nyntie three against Corresponding uith France And Farder the said Alexander Tait as principall and […] as Cautioner with and for him bind and obleidge them Conjunctly and severally and as Enacted in the forsaids books of Councell That he the said Alexander Tait shall in the mean tyme Live peacably uith all submission to the present Government of his Majestie King William and shall not Act Consult nor Contrive anything in prejudice therof nor Converss or Correspond uith any rebells And farder that the said Alexander Tait shall appear before the Lords of his majesties privy Councill when Called for or requyred therto at any tyme before his said departure And that under the penaltie of Tuo Hundreth pounds sterling To be payed by the principall or Cautioner In caise he shall transgress in any pairt of the premisses

Anent the petition given in to the Lords of his Majesties privie Councell By William Hamilton of Orbiestoune Sheuing That wher the petitioner hes Continoued these severall weeks prisoner in Dumbartoun Castle To the Evident prejudice of his privat affairs and of his health Having been some tyme valitudinary And seing he hes still Lived peacably And is most heartily willing to Continow to Live with respect and quiet under the Government And that their Lordships had been pleased of Late to Liberat severall others who were Committed about the same tyme And therfore Humblie Craving to the effect underuryten as the said petition bears The saids Lords of his Majesties privie Councell Having Considered the said petitione given in to them by William Hamilton of Orbiestoune They heirby Recommend to Mr Frances Montgomery Governor of the Castle of Dumbartoune one of their Lordships oune Number And In his absence Gives order and warrand to the nixt Commanding officer ther To sett the petitioner at Liberty furth therof In respect He Hath Given bond and found sufficient Caution acted in the books of privy Councell That He shall Live peacably under and uith all submission to the present Government of his Majesties King William And that he shall not Act Consult nor Contrive any thing in prejudice therof nor shall nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords of privie Counsell whensoever he shall be Called for or requyred to that effect under the penaltie of Five Hundred pounds sterling In caise he shall transgress in any pairt of the premisses

The Lords of his majesties privie Councell doe heirby add Sir John Maxuell of Pollock to Mr Frances Muntgomery for taking tryall anent a meeting said to have been at a place called Innersnait uithin the Lands of Craigroston with full pouer and Commission to the said Sir John in the terms of and as if he had been Insert in the Recommendation by the Councell to the said Mr Frances of the date the tenth day of Apryle instant And Recommends to Sir Thomas Livingstoun Commander in cheiff of his Majesties forces uithin this kingdome to furnish the said Mr Frances Montgomery and Sir John Maxuell with parties of his Majesties forces for seasing and transporting the persons to be examined from the places they shall be att to the places wher they shall be examined if they shall requyre the same.
