Recomendation to Sir Thomas Livingstoun anent the Castle and Garison of Dumbartoun

The Lords of there Majesties privie Councill doe hereby Recomend to Sir Thomas Livingstoun Comander in cheiff of there majesties forces within this Kingdome to take tryall In what case the Castle of Dumbartoun is and the garisone within the same And what number of souldiers are therein And what officers doe Comand them And to take care to furnish the said Castle with such souldiers and officers as he shall find the same to stand in nead of in the present Circumstances of effairs.

Warrand for transporting Navalpain from Edinburgh to Blackness

The Lords of there Majestyes privie Councill being acquanted by the Lord Chancellour that he hade warrand from his majesty for removeing Henrie Navalpain from the castle of Edinburgh to the Castle of Blackness To Remaine Closs prisoner there for some tyme The saids Lords doe hereby Recomend to Sir Thomas Livingstoun Commander in cheif of there Majesties forces within this Kingdome to cause transport the persone of the said Henrie Naval Pain once this day or the morrow forenoon from the Castle of Edinburgh to the castle of Blackness under a sufficient guaird And discharges the guaird to permitt Mr Pain to speak or converse with any persones from the tyme they receave him at Edinburgh Castle untill they delyver him in to Blackness Castle and Recomends to the Earle of Leven Governour of the said Castle of Edinburgh And in his absence Gives order and warrand to the next Comanding officer there to delyver the said Henry Naval Pain to the officers of the pairty to be sent by Sir Thomas Livingstoun And Recomends to the Earle of Linlythgow governour of the said Castle of Blackness and in his absence Gives order and warrand to the Leivetennent Governour or next Comanding officer there to receave and detaine the said Naval Paine Closs prisoner in the said Castle and suffer none to have access to him to speak or Converse with him without speciall warrand from there majestyes or the Councill.

Warrant for transporting Neville Payne from Edinburgh to Blackness

The lords of their majesties’ privy council being informed by the lord chancellor that he had a warrant from his majesty for removing Henry Neville Payne from the Castle of Edinburgh to the Castle of Blackness, to remain a close prisoner there for some time. The said lords hereby recommend to Sir Thomas Livingston, commander in chief of their majesties’ forces within this kingdom, to transport the person of the said Henry Neville Payne today or tomorrow forenoon from the Castle of Edinburgh to the Castle of Blackness under a sufficient guard, and they forbid the guard to permit Mr Payne to speak or converse with any persons from the time they receive him at Edinburgh Castle until they deliver him in to Blackness Castle, and they recommend to the earl of Leven, governor of the said Castle of Edinburgh, and in his absence they give order and warrant to the next commanding officer there, to deliver the said Henry Neville Payne to the officers of the party to be sent by Sir Thomas Livingston, and they recommend to the earl of Linlithgow, governor of the said Castle of Blackness and in his absence they give order and warrant to the lieutenant governor or next commanding officer there, to receive and detain the said Neville Payne as a close prisoner in the said castle and suffer none to have access to him to speak or converse with him without special warrant from their majesties or the council.

Order to the Sollicitor to Lybell Doctor Oliphant and David Robertson

The Councill haveing Considered the examinationes anent Doctor Oliphant and David Robertsons Drinking of King James’s health and Doctor Oliphants assaulting Doctor Dicksone who revealled this effair to some of the Councill efter the revealling of it with the report of the Comittee who took the examinations They ordered the Macers of Councill Imediatly to goe to the said David Robertsone his house and taverne and shutt and Lock up all the roumes in the said taverne and house and all the Cellars thereof Except so much roume in the house as may be sufficient for the Lodgeing of the family only And discharges the vending or selling any meatt drink or Liquor at the said house or Cellars untill the Councills further order And appoints the macers to bring to the Councill boord the keyes of all the said David Robertsones Cellars and the keyes of the other roumes in his house besydes these which are necessary for the Lodgeing of the family only. And Appoints there majestyes sollicitor Instantly to raise a Lybell againest the saids Doctor Oliphant and David Robertsone to appear the morrow at four of the Cloack in the afternoon And Lykewayes to raise a Lybell againest Charles Oliphant father to the said Doctor and William Johnstoun late3 bookseller in Edinburgh for assaulting the said Doctor Dicksone after the said Charles hade Engadged himself for his sons peaceable behaviour and for Informing the Councill according as probation Can be found.

Order to the solicitor to libel Doctor Oliphant and David Robertson

The council having considered the examinations regarding Doctor Oliphant and David Robertson’s drinking of King James’s health and Doctor Oliphant’s assaulting Doctor Dickson who revealed this affair to some of the council after the revealing of it, with the report of the committee who took the examinations, they ordered the macers of council immediatly to go to the said David Robertson’s house and tavern and shut and lock up all the rooms in the said tavern and house and all the cellars thereof, except so much room in the house as may be sufficient for the lodging of the family only, and they discharge the vending or selling of any meat, drink or liquor at the said house or cellars until the council’s further order, and they appoint the macers to bring to the council board the keys of all the said David Robertson’s cellars and the keys of the other rooms in his house, besides those which are necessary for the lodging of the family only. And they appoint their majesties’ solicitor instantly to raise a libel against the said Doctor Oliphant and David Robertson to appear tomorrow at 4 o’clock in the afternoon, and likewise to raise a libel against Charles Oliphant, father to the said Doctor, and William Johnston, former bookseller in Edinburgh, for assaulting the said Doctor Dickson after the said Charles had engaged himself for his son’s peaceful behaviour and for informing the council according as proof can be found.

Order for Levyeing tuo regiments in Lanerkshyre

The Lords of there Majestyes privie Councill haveing Considered a proposeall made to them anent the sending Leivetennent Colonell Lumsden and Captain Wishart with there Companies to Make up tuo regiments of men willingly offering themselves in the shyre of Lanerk to serve there2 majestyes againest any papists or any forraigne Invasione or Intestine Insurrectione Together with the report of a Comittee of there oune Number to whom it wes remitted to Consider the saids proposealls They allow the said Leivetennent Colonell Lumsden and Captain Wishart with there tuo Companyes to be sent to Lanerk shyre and to make up tuo regiments each of these Companyes a wholl regiment of such persones as shall willingly offer themselves to serve there majesties againest papists or any forraigne Invasione or Intestine Insurrectione And that they exercise the persones who shall so voluntarly offer and List3 themselves and moddell them in Companyes and regiments And appoints the Commissioners of Supplie to Recomend to the Councill the persones as they think fittest to comand these Companyes and Regiments And the said Lords recomends to Sir Thomas Livingstoun Comander in cheiff of there majestyes forces within this Kingdome To Give orders to the said Leivetennent Collonell Lumsden and Major Wishart to March with there tuo Companyes from there present quarters to the shyre of Lanerk to the effect forsaid.

Order for levying two regiments in Lanarkshire

The lords of their majesties’ privy council having considered a proposal made to them for sending Lieutenant Colonel Lumsden and Captain Wishart with their companies to make up two regiments of men willingly offering themselves in the shire of Lanark to serve their majesties against any Catholics or any foreign invasion or internal insurrection, together with the report of a committee of their own number to whom it was remitted to consider the said proposals. They allow the said Lieutenant Colonel Lumsden and Captain Wishart with their two companies to be sent to Lanarkshire and to make up two regiments each of those companies, a whole regiment of such persons as shall willingly offer themselves to serve their majesties against Catholics or any foreign invasion or internal insurrection, and that they exercise the persons who shall so voluntarily offer and enlist themselves, and model them in companies and regiments, and they appoint the commissioners of supply to recommend to the council the persons they think fittest to command those companies and regiments, and the said lord recommend to Sir Thomas Livingston, commander in chief of their majesties’ forces within this kingdom, to give orders to the said Lieutenant Colonel Lumsden and Major Wishart to march with their two companies from their present quarters to the shire of Lanark to the effect foresaid.

Comittee anent Doctor oliphant and David Robertsone

Wpon Informatione that David Robertsone ventner in Edinburgh and Doctor Charles Oliphant sone to Charles Oliphant of Langtoun did within these few dayes in a publict company drink the late King James his health and were urgent with others to drink the same Tuo macers of Councill were Imediatly ordered to search for these persones and Committ them prisoners till further of Councill And Recomends to the Lords Fountainhall and Enstruther to Examine them and to report to the Councill.

The lords of their majesties’ privy council hereby give order and warrant to their majesties’ solicitor instantly to raise letters against the horse dealers in Edinburgh, Glasgow and other places and to cite those persons to appear before the council so that they may be examined and give account of what horses they or any of them have imported and brought from England to this kingdom or bought from such who have imported the same since 1 April last in the terms of the proclamation of council of 13 April last and they recommend to the Lords Cardross and Belhaven, Sir John Lauder of Hatton and Sir Archibald Murray of Blackbarony or any two of them to examine the said horse dealers and report to the council.

The Councill Appoints a letter to be written to the Lord Marqueis of Douglas as wes formerly wreitten to the Lord Duke of Hamiltoun Acquanting the Marqueis That the Councill hes appointed him to Command the heretors in Lanerk shyre In place of the Lord Duke of Hamiltoune formerly appointed for that Comand with power to the Marqueis to Name his oune officers.

The council appoints a letter to be written to the [James Douglas], marquis of Douglas as was formerly written to the [James Hamilton], duke of Hamilton, informing the marquis that the council has appointed him to command the heritors in Lanarkshire in place of the lord duke of Hamilton, formerly appointed for that command, with power to the marquis to name his own officers.

The Counsell haveing Considered a petitione Given in to them be Philip Daulx prisoner Representing that he haveing been Incarcerat at Carleisle for tuo years since the revolutione and efter tryall being acquytt of all hes receaved his pass and being destitute of means of transportatione for Flanders his Native Countrey with difficulty he hes gott his bread at this place by makeing of periwigs till now that he is Comitted prisoner And therefor craveing that he may be examined and Liberate They Recomended to ane Comittee of there oune Number to call for and examine the petitioner who haveing accordingly mett and examined him upon the Eighteint of Maij instant2 And haveing considered his tuo passes and the declaration of the Ensigne of the toun of Edinburghs guaird who seized him They ordaine the said Philip to be sett at Liberty In regaird they Find nothing proven to be a ground of his further detainment.

Committee and liberation for Philip Daulx

The council having considered a petition given in to them by Philip Daulx, prisoner, representing that he having been incarcerated at Carlisle for two years since the revolution and after trial, being acquitted of all has received his pass, and being destitute of means of transportation to Flanders his native country with difficulty he has got his bread at this place by making of periwigs till now that he is committed prisoner, and therefore craving that he may be examined and liberated. They recommended to a committee of their own number to call for and examine the petitioner, who having accordingly met and examined him upon 18 May instant2 and having considered his two passes and the declaration of the ensign of the town of Edinburgh’s guard who seized him, they ordain the said Philip to be set at liberty in regard that they find nothing proven to be a ground of his further detention.
