Patent of Honour In Favors of Archibald Marques of Douglas to be Duke of Douglas etc Being presented by Lord Charles Kerr the samen was read by Sir Gilbert Elliot one of her Clerks and appointed to be recorded and therafter delyvered by the said Sir Gilbert to the Lord high Chancelor and by his Lordship delyvered to his Grace her Majesties high Commissioner who delyvered the samen to the said Duke of Douglas, and who received the patent upon his knee2 as use is.
Followes the tenor of the said patent.

Commission In Favours of David Grahame to be one of the Macers of privy Councill

Commission under her2 Majesties privy Seall of this kingdome In Favors of David Grahame brother german to the Laird of Balgowan to be one of the Macers before the Lords of privy Councill Exchequer and Commissioners and a Serjant at armes being read the samen was ordered to be Recorded; and the said David Grahame being called in Did qualifie himself to her Majestie by Swearing the oath of alledgance and Subscryveing the Same with the assurance And the Lord Chancelor did tender to him the Oath de fideli.
Followes the tennor of the Said Commission.

Act In Favors of Major Generall Thomas Buchan

Anent the Petition given in to his Grace her Majesties high Commissioner and Lords of her Majesties privy Councill by Major Generall Thomas Buchan Shewing That wher his Grace and the saids Lords were pleased most favorably by their Last delyverance to allow the petitioner the benefitt of the toune of Edinburgh and of a myle ther abouts for which the petitioner cannot bot give his humble thanks, But Seing that the petitioners affairs and any thing he has Lyes in the North in Aberdeen Shyre wher he could not be since his comeing to this nation So that he hade gott nothing done therin By which he sustained great prejudice and for want therof cannot Subsist himself any Longer, And Likewayes Seing the petitioner was formerly resolved to Live peaceably under her Sacred Majesties auspicious Government And to have no Converse or Corrospondance with any person whatsoever ill affected therto And Therefore humbly Craveing his Grace and the saids Lords to Consider the present Circumstances and to allow the petitioner the benefite of ane opportunity to order the petitioners bussines and affairs untill the first of March nixt upon the petitioners finding sufficient Caution to present his person before his Grace and the saids Lords when called for and in the mean time that he should Live and behave himself peaceably under her Majestie and have converse with no rebells or any ill affected to her Majestie and Government as the petition bears. His Grace his Majesties high Commissioner and the Lords of her Majesties privy Councill haveing Considered the above petition given in to them by Major Generall Thomas Buchan and the samen being Read in their presence His Grace and the saids Lords Doe hereby prorogate the time formerly appointed for the petitioner to depart furth of her Majesties dominions untill the first day of January nixt to come And appoints and Ordaines the petitioner to give bond and find Sufficient Caution acted in the books of privy Councill That he shall depart furth of her Majesties dominions betwixt the date hereof and the said first day of January nixt to come and shall not returne therto without Libertie granted by her Majestie or the privy Councill to him for that effect. And in the mean time that he shall Live peaceably under and with all Submission to her Majesties Government, And that he shall not Consult nor Contrive any thing in prejudice therof nor Converse or Correspond with any rebells and that under the penalty of two Hundred pounds Sterling in caice he transgress any pairt of the premisses.

The Patent of honour underwritten, Under the great seall of this Kingdome In favors of George Viscount of Tarbat To be Earle of Cromartie Being presented by his Lordship The Samen was Read and appointed to be Recorded. and therafter delivered by the Clerk to the Chancelor who delivered the Samen to the said Viscount of Tarbat and who received the samen from his Lordship upon his knees as use is.

Anent the petition given in to his Grace her Majesties high Commissioner and Lords of her Majesties privy Councill by John Murray brother german to Charles Murray of Barnhurry Shewing That the petitioner in a process pursued against him before the Lords Commissioners of Justiciary at the Instance of Adam Craik of Ardbiggland being fyned in the Soume of Twelve hundred merks wherof nyne to be payed to the pursuer and thrie to her Majesties use and ordained to Lye thrie moneths in prison and to find Caution to keep the peace and for that effect to enact himself in the books of adjurnall under the pain of One hundred pounds Sterling The petitioner haveing satisfied the pursuer, And Likewayes Found Caution to keep the peace as is fully instructed by the declarationes produced Wherby the pursuer does express his being fully Satisfied with the petitioner and how Sorrie he is for the petitioners present Calamity and misfortune, And the petitioner being a young man of no Stock Bot who by his industrie and Credit in Traficqueing with Merchandize provided a very honest Subsistance to himself Which he would be altogither deprived of if the petitioner was continued under his present Circumstances, And the saids Lords being in use to mittigate and even to Change sentances of the Lords of Justiciary especiallie wher no privat partie was prejudged Bot their intrest fully satisfied as in this caice, and that it will be no benefitt to the publict that the petitioner be ruined by continueing in prison nor was it in his power tho all the substance he hade in the world were rouped to satisfie the thrie hundred merks appointed to be payed to her Majestie which he humbly conceived was raither ad terrorum then upon any prospect that it could ever be payed And Therfore humbly Craveing his Grace and the saids Lords in Consideration of the premisses And that the petitioner hade been already a moneth in prison and that the Lords of Justiciary would concurr in the premisses to appoint the petitioner to be Sett at Libertie furth of the Tolbooth of Edinburgh, And to Recommend to the Lords of her Majesties thesaury to discharge and declare the petitioner free of the forsaid thrie hundred merks appointed to be payed to her Majestie in Consideration of his hard Circumstances as the petition bears; His Grace her Majesties high Commissioner and the Lords of her Majesties privy Councill Haveing Considered the above petition given in to them by John Murray brother german to Charles Murray of Burnehurrie and the same with ane Consent of Liberation under the hands of James Campbell younger of Arkindlas and Captain Robert Johnstoune Late provost of Dumfrees in name and behalf of Adam Craik of Ardbigland their brother in Law, being Read in their presence His Grace and the saids Lords Doe hereby Declare the petitioner free of the rest of the thrie moneths time he was by the Sentence of Justiciary appointed to Lye in prison and gives order and warrand to the Magistrates of Edinburgh and keeper of their Tolbooth instantly to sett the petitioner at Libertie furth therof upon his payment of the house dues, And Recommends him to the Lords Commissioners of her Majesties thesaury to discharge him therof, And Declare him free from all payment of the thrie hundred merks of fyne appointed by the said Sentence of the Lords of Justiciary In Regaird before extracting hereof hath produced ane Testificat under the hand of James Baird, That he hath enacted himself in the books of Adjournall to keep the peace in the termes and under the penalty mentioned in the said Sentence of the Lords of Justiciary.
