Att Edinburgh the Tenth day of Augwst Jaj vic nyntie Seven yeirs

Decreet

Interloquitor Dwke and Dutches of Gordon

The petitione The Dwtches of Gordon wherupon ther is a deliberance of the fifth of August instant being this day red againe and ane additionall petitione for the said Dutches and a petitione By the Dwke of Gordone by way of answer therto being all this day red in presence of The Lords of his majesties privie Cownsell And the advocats for both pairties being called Compeared Sir Patrick Home as Advocat for the said Dwke of Gordone And Sucklyke Compeared Sir James Stewart his majesties advocat as Advocats for the Dwtches And the saids Lords haveing at Lenth heard both pairties Lawuers They heirby Stopp the forsaid interloquitor pronunced by them upon the said fifth of Augwst instant and discharges the bookeing or extracting therof And remitts the point of aliment to be insisted in and discust before The Lords of Cownsell and Sessione upon and according to the process depending befor ther Lordships at the instance of the said Dwtches

Act Samuell McClelland to be steuart and justicar of Orkney

Anent the petition Given in to the Lords of his Majesties privie Councill By Samuell McClelland merchant burges of Edinburgh Sheuing that the petitioner having taken a tacke of the Croun rents of orkney and zetland from the Lords of his Majesties Thesaury and Exchequer It is necessar for the more effectuall Inbringing therof that he be authorized to exercise the office of Steuartie and Justicary depute uithin these Isles and haill bounds belonging therto as hes usuallie been done to the former Tacksemen and their Lordships being in use to dispose upon these offices when requisite for the Interest of these Concerned And therfore Humblie Craving to the effect underwryten as the said petitione bears The saids Lords of his Majesties privie Councill Having Considered this petitione given in to them by the said Samuell McClelland They heirby appoint and authorize the petitioner to be steuart and Justicar of orkney and zetland During the tyme of his tack with pouer to him or his Deputes For whom he is to be ansuerable to sitt Fence Keep and hold Courts And to administrat Justice In all Causes Civill and Criminall And to doe Every other thing relating to that office sicklyke and also freely In all respects as any former steuart and Justicar did or might Laufullie have done.
