Anent the petitione given in to the Lords of his majesties privie Cownsell be the witnesses efternamed addwced in the process persewed before ther Lordships at the instance of The Lairds of Kinnffauns and Belthaick Against The Laird of Phinhaven viz James Blair of Ardblair Patrick Lyon of Ballgallie Gilbert Ramsay baillie of Forfar John Fallconer of Balmeshannar James Blair of Glasglowne Alexander Blair of Inchsra Mr John Lyon Shirreff Clerk of Forfar William Beattiesone towne clerk therof William Wre wryter ther Alexander Jaffrey towne Thesaurer ther James Dall writer ther George Cwthbert writer ther Alexander Cook writer ther Shewing That wher the petitioners are cited and called befor ther Lordships as witness in the forsaid actione and obleidged to come to Edinburgh and attend the Samen Since the twentie nynth of October to the Sixtein of november instant inclwsive Dureing which tyme the petitioners for themselvs horses and Servants have bein at very considerable charges and expensses which Conforme to ther Lordships dayly practicq and custome the petitioners ought to be payed and satisfied of by aither of the saids pairties And therfore humbly craveing Ther Lordships might ordaine aither of the saids pairties to make payment instantly to the petitioners or to Alexander Aliesone writer in Edinburgh ther factor for that effect of what expenss ther Lordships shall think reasoneable for them considering ther stationes and time of attendance abovewritten And that Summarly without necessitie of extracting ane act therfor As the said petitione Bears Which being this day red and considered be the saids Lords of privie Cownsell They doe heirby modifie the Soume of Sixtein Shilling Scotts per diem to be payed to ilk ane of the foirnamed persones wittness from the twentie nynth day of October Last bypast inclwsive to the Sixtein day of November also Last bypast inclwsive In respect they are all horsemen And decernes and ordained Mr James Carnegie of Phinhaven to make payment to the above named witnesses petitioners foirsaids of the expenss above written And ordaines Letters of horneing on twentie four houres wairneing and others needfull to be direct heiron

Anent the petitione given in to the Lords of his majestie privie Counsell be Patrick Cownt Lessly Shewing That wher the petitioner haveing obtained ane Decreit at his instance befor The Commissioners of Justiciarie for the Northerne district against James Donaldsone younger merchand in Elgine Decerning and ordaineing him to make payment to the petitioner of the Soume of Four Hwndereth and […] pwnds Scotts money as the price of ane horse Stollen from the petitioner in the moneth of Jwlly Last And alsoe in Satisfactione of the expenss and Dammadge expended and Sustained by the petitioner in recovering the said horse who was fownd in custodie of the said James Donaldsone And the petitioner haveing by vertue of the said decreit caused chairge the said James Donaldsone to make payment of the said Soume he hath presented a bill of Suspensione upon certaine frivolows and callwmmows reasones And which bill was ordained by ther Lordships interloquitor to have bein sein and ansuered by the petitioner But he not being upon the place himself and his procurators not being Sufficiently instrwcted in the said mater they delayed to give in answers till the petitioner Should be acqwainted But befor his return could be back at Edinburgh ther Lordships were pleased to pass the bill upon Sufficient Cautione And ther being no Cawtione yet fownd and this Suspensione being only intended to frustrat and delay the petitioners payment who is content Sumarly to discuss the reasones therof And Seing the petitioner hes reasone to beleeve that the decreit is not extracted Conforme to the warrands and that Severall depositiones are omited therin And that the prodwctione of the warrands would cleare the whole mater to ther Lordships And therfore humbly craveing ther Lordships to Stopp all furder expedny of the said Suspensione and to allow the petitioners answers to the reasones therof to be yet given in that soe the reasones may be discust on the bill And that the whole mater may be Laid open befor ther Lordships to grant warrand for citeing […]Donaldsone clerk to the process for exhibiteing in ther Lordships clerks hands the warrands and grownds of the said decreit As the said petitione bears The saids Lords of his majesties privie Cownsell haveing considered the above petitione They heirby ordaine […] Donaldsone clerk to the Commissioners of Justiciary for the northerne district to exhibite and prodwce in the hands of the clerks of the privie Counsell the haill grownds warrands and minwts of the Decreit obtained at the instance of Cownt Lessly petitioner against James Donaldsone And that wpon the tenth day of Febrwary next to come And allowes Letters of dilligence to be direct heiron to the effect foirsaid and assignes the said tenth Day of Febrwary next to come to the petitioner and the said James Donaldsone Suspender to debate the reasones in the said bill of Suspensione and appoints them to have ther Lawwers readie at the Cownsell barr and to debaite as said is at the day forsaid And in the mean tyme Stopps the giveing owt of the Suspensione alreadie past at the Suspenders instance against the chairger upon the decreit charged on

The Lords of his Majesties privy Councill Doe heirby Recommend To Colonell Sir John Hill Commander of the Garrisons att Fortwiliam To Reduce Each Company of the number of Twelve Company’s and one Company of Grenadiers of the Regiment belonging to the said Garrison To the number of Twenty Centinells for Each Company as is appointed by his Majesty’s new Establishment of the forces within this Kingdom dated att Kensingtoun the Last day of November Jaj vic nyntie seven years.

Anent the Petition Given in to the Lords of his Majesties privy Councill by Dame Margaret Scrimzeour Spouse to Sir Eneas McPhersone Shewing That ther Lordships hade by ther sentence banished the Kingdom severall years since the Petitioners husband and she was Left by him destitute of all means of subsistence and have been still necessitat to leave upon the Charity of Good Christians and the petitioner Being now Resolved to Goe abroad to her husband where she is Informed he presently Is And the Petitioner being altogether destitute of means for her Transportation And Therfore Humbly Craving to the Effect underwrittin as the said Petition Bears. The saids Lords of his Majetsies privy Councill having Considered the above Petition Givin in to them be the above Dame Margaret Scrimzeour They doe heirby Recommend to the Thesaury To Consider the Petition and to allow to the petitioner such Charitable supply for her Transportation as ther Lordships shall find Convenient.
