Act Thomas Stewart

Anent a Petitione given in to the Lords of their Majesties privy Councill be Thomas Stewart prisoner in the Tolbooth of Edinburgh Shewing That quher he being taken prisoner in the west and sent to this toune by the duke of Hamiltone with ane partie of horse guards his Grace was pleased to send four pound sterling of Current money which he at the tyme had of his oun upon him, And cause seall it in a Purse and gave it to the Captaine of the partie to be delivered be him to the saids Lords for the petitioners mantinance whill the petitioner should be tryed of the cryme laid to his charge, And now being fully perswaded that the said Captaine would not Disobey the Duke his Order in delivering the same to the saids Lords to be bestowed upon the petitioner that he therby might be preserved from starving for since the petitioner came to prisone he hade gotten nothing less nor more to save his Lyfe these dour dayes by past wherby he is in the point of starving And Therfore Humbly Craveing the saids Lords aither to give a part or all his money to the bearer in his name seing his Conditione was miserable and indigent and beggs for god sake to grant his desyre and Consider his Starving condition and prevent it as the petition bears The Lords of their majesties privy Councill Haveing Considered this petition given in to them be the above Thomas Stewart They Appoint the Clerks of Councill in whose hands the said money is to deliver to the petitioner such Current money belonging to him as they received from the Comander of the partie who brought him to this place.

Decreet

Sentence againest some ministers

The Councill haveing Called befor them these ministers following viz Mr Andrew Auchinlect, Mr William Fyff and Mr Alexander Gregorie who were Cited and Compeareing in the Lybell Called againest them and other Ministers on Saturday last for not prayeing for there Majestyes King William and Queen Mary as King and Queen of this Realme The said Mr Andrew Auchinlect hes engadged by his promise under his hand That how soon and whensoever he preaches He will pray for there saids Majestyes as King and Queen of this Realme And therefore the Councill assolzies him And the saids Mr William Fyff and Mr Alexander Gregorie haveing Refused to promise that they will pray for there saids Majestyes in tyme comeing in the above termes The Councill Banishes them from the toun of Edinburgh Suburbs thereof and Jurisdictione of the same And ordaines them to remove therefrom once this this week And ordaines Letters to be direct againest them for that effect.

Decreet

Sentence against some ministers

The council having called before them these ministers following, viz: Mr Andrew Auchinleck, Mr William Fife and Mr Alexander Gregory who were cited and appearing in the libel called against them and other ministers on Saturday last for not praying for their majesties King William and Queen Mary as king and queen of this realm, the said Mr Andrew Auchinleck has engaged by his promise under his hand that as soon as and whenever he preaches he will pray for their said majesties as king and queen of this realm, and therefore the council absolves him, and the said Mr William Fife and Mr Alexander Gregory having refused to promise that they will pray for their said majesties in time coming in the above terms, the council banishes them from the town of Edinburgh, suburbs thereof and jurisdiction of the same, and ordains them to remove therefrom once this this week, and ordains letters to be directed against them for that effect.

The Lords of there Majestyes privie Councill doe hereby recomend to Sir William Lockhart to report to the Councill what what2 evidence he hes againest Andrew Mcapie and John Mclachlan tuo prisoners in the tolbooth of Edinburgh for robbery And whom the Earle of Leven Informe doe voluntarly offer them selves to goe to Flanders and serve there majesties as souldiers in his Lordships Regiment

Recommendation to Sir William Lockhart concerning McApie and McLaughlan

The lords of their majesties’ privy council hereby recommend to Sir William Lockhart to report to the council what evidence he has against Andrew McApie and John Mclaughlan, two prisoners in the tolbooth of Edinburgh for robbery and whom the earl of Leven intimates voluntarily offer themselves to go to Flanders and serve their majesties as soldiers in his lordship’s regiment.

Report and order anent captain Johnstoun and Ensigne Dunbar

The Lord Beilhaven haveing reported that In obedience to the Councills Comands he went with Sir Robert Sinclair of Steivenstoun to the tolbooth of the Canongate And examined what persones were guiltie of seizing the keyes of the said prisone and keeping out the same And they found none to have ane hand in that matter but Captain Johnstoun and Ensigne Dumbar who in there examinationes now read befor the Councill doe acknowledge that they violented the key from the Clerk But declared they did it to be heard And that they might have from the Goodman the aliment that the Councill allowed them And my Lord further reported that they caused transport the said Captain and Ensigne from the Canongate tolbooth to the Ironhouse in the tolbooth of Edinburgh And put them in Irons there The Councill approves of the report and what the Comittee have done And it being represented for Captain Johnstoun that his Legg is swelled with the straitnes of the Iron put thereon The Councill called for one of the Bailzie and the maister of the tolbooth of Edinburgh and finding the representation to be a trueth. They gave order to the maister of the tolbooth to take the Irons from off Captain Johnstouns Leggs and to putt Irons upon his hands And to detain him and the Ensigne prisoners till further order

Report and order regarding Captain Johnston and Ensign Dunbar

Lord Belhaven having reported that in obedience to the council’s commands he went with Sir Robert Sinclair of Stevenson to the tolbooth of the Canongate and examined what persons were guilty of seizing the keys of the said prison and holding the same, they found none to have a hand in that matter but Captain Johnston and Ensign Dunbar who in their examinations now read before the council acknowledge that they forced the key from the clerk but declared they did it to be heard and that they might have from the keeper the aliment that the council allowed them, and my lord further reported that they transported the said captain and ensign from the Canongate tolbooth to the iron house in the tolbooth of Edinburgh and put them in irons there. The council approves of the report and what the committee have done, and it being represented for Captain Johnston that his leg is swollen with the tightness of the iron put thereon, the council called for one of the bailie and the master of the tolbooth of Edinburgh and, finding the representation to be a truth, they gave order to the master of the tolbooth to take the irons off Captain Johnston’s legs and to put irons upon his hands, and to detain him and the ensign as prisoners till further order.

Order for Incamping the Forces

The Lords of there Majesties privie Councill Find it convenient that there be ane Encampment of the horse and dragoons in Tranent muir And appoints the shyres of Edinburgh and Haddingtoun to provyde them corne and straw proportionally according to there valuationes or monethly assessment which keeps the same proportione And appoints the provisiones to be furnished for a fourtnights tyme And that they come fresh every day to the Camp And there be Four Chalders of oatts and a thousand stone of straw furnished each day And appoints the Comissioners of Supplie within the saids shyres of Edinburgh and Haddingtoun to meet and set pryces Conforme to the act of parliament upon the corne and straw to be furnished to the forces dureing there Encampment at the said place

Order for encamping the forces

The lords of their majesties’ privy council find it convenient that there be an encampment of the horse and dragoons in Tranent Muir, and appoint the shires of Edinburgh and Haddington to provide them corn and straw proportionally according to their valuations or monthly assessment which keeps the same proportion, and appoint the provisions to be furnished for a fortnight’s time, and that they come fresh every day to the camp and there be four chalders of oats and 1,000 stone of straw furnished each day, and appoint the commissioners of supply within the said shires of Edinburgh and Haddington to meet and set prices according to the act of parliament for the corn and straw to be furnished to the forces during their encampment at the said place.
