Petitione Captaine Slezer read and recomends to the Earle of Leven The Lord Justice clerk and Sir Archibald Mwire present proveist of Edinburgh being the Comittie Last named upon John Adaires petitione to meet with the Lord Chancellor at his Lordships Lodgeing and to consider this petitione and what methods are fittest to be fallen upon for the Speedie and compleat inbringing of the tunnage imposed be act of parliament and how much therof is to be payed aither to the said John Adair or Captaine Slezer and by what proportiones and to consider how farr both these persones workes have proceeded and what will be resting to aither of them for compleateing and perfyteing ther respective works and recomends to the said Comittie to meet tomorrow at ten in the foirnoon And declaires any two of the foirsaid Comitie to be a Sufficient qworwm

Act Anent magistrats in Old Aberdeen

Anent the petitione given in to the Lords of his majesties privie Counsell be The Late magistrats and towne Counsell of the old towne of Aberdeen Shewing That wher in the tyme of Episcopacie the said towne being the Bishups Seat of the bishuprig of Aberdeen The magistrats were chosen at the sight of the Bishup then resideing on the place Conforme to the Constant custome And Since the revolutione the said towne hes at severall tymes bein in great disorder and confwsione for want of magistrats for rwleing and governing the same And ther severall yeirs bygone ther hath bein no magistrats in the said towne except four baillies who were nominat by ther Lordships for the space of ane yeir for observeing the said towne And for seing of the publict orders of the governement putt to dwe executione And als for qwartering the Souldiers in ther passing and repassing the Same And the yeir being Long agoe expyred So that ther are no2 magistrats at present in the said burgh through want wherof ther are daylie disorders and confwsiones falling out amongst the inhabitants and the Samen certainlie will more and more incresce without ther Lordships provide remeid therto And therfor humblie craveing to the efect eftermentioned as the said petitione bears which being this day read and considered be the saids Lords of privie Counsell with the report of his majesties advocat and Solicitor therupon they heirby allow the Last nominat magistrats and towne Counsell of the said burgh to exerce ther saids officers as if the yeir for which they were chosen were not yet elapsed nor rwn owt And appoints the saids old magistrats and towne Counsell of the said burgh to meet and consider amongest themselves what persones are fittest to be magistrats and towne counsell of the burgh of old Aberdeen for the ensweing yeir and to transmit the names and designationes of these persones fitt to be Counsellers and a List of there for each baillie to the privie Cownsell betuixt and the first day of Jwne next to Come to the effect the saids Lords may choice one for each baillie And appoints and authorizes the saids old magistrats and Counsell to exerce ther offices as said is ay and while new ones be appointed by the saids Lords of privie Counsell Conforme to ther act to be past theranent

Anent the petition given in to the Lords of his Majesties privie Councill By Leivtenant Alexander Cazett Sheuing That wher notwithstanding of his Majesties gracious pardon and absolute remission in favoures of the petitioner anent the Casuall Slaughter of Ensigne John Skeen The relations of the said defunct seemed not only to Grudge at the apprehension of the petitioners resolutiones to stay in Scotland But Lykewise propose the removing of him by ane bond of Banishment of the most extravogantly Dishonourable tearms that they Could devise And which uould doubtles render the petitioner Incapable of Imployment amongst Gentlemen abroad And so utterly evacuat the designe of his Majesties said Gracious pardone and remission The petitioner nevertheless being noe uayes Inclyned to prove ane occasion of offence to any man farr Less to the defuncts relations Did as yet does firmly purpose to remove himself outwith the Kingdome and dominions therof uithin such Competent tyme as their Lordships shall be pleased to allow And In order therto humblie offers to Subscrybe ane bond of banishment of the tenor given in with the said petition which It is humblie hoped their Lordships will sustaine as sufficient from a persone in the petitioners case and Cloathes with his Majesties absolute remission as said is And ther being about Fourteen months arrears due to the petitioner as Leivtennant And that for defraying his expences hitherto uith what may be necessar for dispatching his affairs and Carrying him off the kingdome It may be thought reasonable that the Lords Commissioners of his Majesties Thesaury should order the payment of the petitioner his saids arrears And therfore humblie Craving their Lordships would be pleased to accept of the petitioners Subscryving a bond of the tenor of that which is given in with the said petition And allow him tyme for his necessary dispatches untill the recruites be Shipped off And in the mean tyme recommend him to the Lords Commissioners of the Thesaury for payment of his saids arrears And in respect the petitioner has in the petition Subscryved the bond as appears by the samen in the Clerks hands It is humbly begged that their Lordships would ordaine him to be sett at Libertie for the ordering and dispatch of his finall and necessary affairs before his departure as the said petition bears The saids Lords of his Majesties privie Councill having Considered this petition given in to them by the uithin Alexander Cazett and another by the Lord Mersingtoun and Mr Thomas Skeen against the same with the bonds produced with each petition They heirby Decerne and ordaine the said Leivtennant Alexander Cazett to signe and subsryve the bond presented and Given in by the said Lord Mersingtoun and Mr Thomas Skeen And in respect the said Leivtenant Alexander Cazet hath signed the samen Gives order and warrand to the Magistrats of Edinburgh baillies of the Cannongate and Keeper of their tolbooth to sett the said Leivtennant Alexander Cazet at Libertie furth therof The said Leivtennant aluayes departing furth of this Kingdome uithin Fourteen dayes nixt after signing of the said bond And In the mean tyme the saids Lords have Confyned And heirby Confyne the said Leivtennant Alexander Cazett to his oune Chamber And discharges him to goe uithout the same untill the said day that he depart furth of this Kingdome.

The Lords of his Majesties privie Councell has resolved that the Militia foot are to be armed in manner following Viz That each regiment which is to Consist of Eight Companies shall have tuo of these Companies armed with Lochaber axes and all the other Companies uith fyre armes And The Councill Recommends to the Lords Commissioners of his Majesties Thesaury Instantly to Cause prepare and buy up fifteen hundreth Lochaber axes uith all dilligence at as easie rates as they Can be had.
