Procedure

The Councillors present, qualifie themselves, and took the Oath de fideli

The Lords of her Majesties privy Councill Considering That her Majestie Queen Anne had assumed the Government by Signeing the Coronation Oath, Reported to the Councill and by them appointed to be Recorded; The saids Lords Judged is fitt and necessary for them; Being now Authorized to sitt and act as her Majesties privy Councill (2Be vertue of her Letter for that effect to qualifie themselves by takeing the oath of alledgance and assurance and the oath de fideli; And Therfore the saids Lords of her Majesties privy Councill; By five and fyve as they were present Did Swear the Oath of alledgance to her Majestie and the oath de fideli and Subscrybed the assurance, The Clerk Reading the words of the Oath of alledgance to them And the Chancelor administrating the oath defideli Which oath of alledgance and assurance was Subscrybed by the whole Members present Except the Lord Ross and the Laird of Grant who declyned to Swear the oath of alledgance or Signe the assurance untill first her Majestie were proclaimed Queen of this realme

Proclamation by Queen Anne for Authorizeing all persones to act by vertue of their former Commissiones untill new ones Sent

Followes the Proclamation by Queen Anne, for Authorizeing and Continueing all Judges and officers and Civill and Military to act be vertue of their former Commissiones untill new ones were Sent.
Sic Supra Scribitur Anne Regina
Anne by the Grace of God Queen of Scotland, England France and Ireland defender of the faith etc. To all and Sundrie our2 good Subjects whom these presents doe or may concerne Greeting Wheras It hath pleased God this day to call out of this Life; from the possession of ane Earthly diadam to the function of ane Eternall Crown of Glory; His late Majestie Our Royall and most dearly beloved brother King William; Wee have thought fitt to publish our Royall pleasure; That all our officers of State Privy Councillors; Magistrates and all other officers whatsomever both Civill and Military within our ancient Kingdome of Scotland, Do and they and every one of them respectively are hereby authorized and requyred to act in all things Conforme to the last Commissiones and instructions They had from his Said Late Majestie of Blessed Memory Untill New Commissiones from Us, can be prepaired and Sent down to them; And for their So doeing; This Shall be to them; and every one of them respectively a full Warrand, Given at our Court at St James’s The Eight day of March 1701/3 And of our Reigne the first year. Proclamation for proclameing Queen Anne, Queen of Scotland

Ther being a proclamation prepaired for proclameing Queen Anne, Queen and Soveraigne of Scotland; Which being Read to the Councill The Samen was voted approven and Signed; And Ordained to be published and recorded. Which this day betwixt thrie and four in the afternoon was proclamed from the Cross by the Mouth of the Lord Chancelor; The Clerk of Councill Giveing him the words. The Lyon King at armes and his bretheren Heraulds Macers of privy Councill Pursevants etc being present and after proclamation of her Majestie, Ther was proclaimed by the Lyon King at Armes The Clerk of Councill Giveing him the words; A proclamation allowing, All Ministers of State; And other officers Civill and Military To act and doe be vertue of their offices and Commissiones for the Samen and instructions given to them for that effect from his deceast Majestie King William in that Same way and maner as they were in use to doe by the Commissions from his said deceast Majestie the time of his life untill new Commissiones were granted by her Majestie for that effect Both which proclamationes were appointed to be printed and published And the whole Lords and others present at the Sederunt who Subscrybed the Samen were Likewayes ordained to be prefixed.

Forasmuchas It hath pleased almighty God, to to2 Call by death our late Soveraigne Lord King William of Glorious and blessed Memory from this Mortall Life and a temporary Crown to inherit ane Eternall in the heavens: Wherby the undoubted right of Succession to him in the Emperiall Crown of this Realme Is Immediatly devolved and doeth descend upon the person of his Royall Sister Queen Anne Our present Soveraigne According to the Declaration of the Estates of this kingdome Contained in the clame of Right; Setleing the Succession to the Crown And that our Said Soveraigne Lady hath Sworne the Coronation Oath, Conforme to the said clame of Right, In presence of the two principall Secretaries of State and the other Lords of privy Councill at present at Court in England; as is fully Certified by her, Majesties Signed oath, and attestation made therupon transmitted to the Lords of privy Councill And by their order Recorded in the books therof Therfore Wee the Lords of her Majesties privy Councill Authorized in that Capacity by her Majesties Letter bearing date at St James’s the Eight of March instant; Doe with the Concurance of Severall other Lords, Barons and burgesses of this realme Declare and proclame out said Soveraign Lady Queen Anne to be by Lawfull and undoubted right and Succession Queen of Scotland; and alone Soveraigne of this kingdome hereby asserting recognizeing and acknowledging her Majesties Royall power and authority over the Said Kingdome; And her undoubted right and title to the Imperiall Crown therof, Promiseing That wee Shall bear true and faithfull alledgance into our said Sacred Soveraigne, And adhere to Mantaine and defend her Royall person and Government with our Lives and fortunes against all deedly, And Wee ordaine this our declaration and proclamation to be Immediatly published at the Marcat Cross of all the Shyres Stewartries Bailliaries and Regalities within this Kingdome with all due and usuall Solemnities And Ordaines these presents to be printed and published.
