Act anent Duke of Hamiltouns petitione

Annent The petition given in and presented to the Lords of Her Majesties privy Councill By James Duke of Hamilton Shewing That where as at the desire of a Committee of your Lordships The petitioner hes delyvered up to the Clerks of Councill a Letter of great Importance wrytten to the petitioner By David Baillie now prisoner in the Tolbuith of Edinburgh And Therfore humbly Creaving Their Lordships for the petitioners Exoneratione To Exhibite the said Letter to the said prisoner and Interrogatt him whitther It be his hand wrytting and signed by him and that previous to any other proceedings in that affair lest the petitioner ly under the Imputation of given in a fals paper as the said petition Bears The Lords of Her Majesties privy Councill Haveing considered the above petition given into them by his Grace James Duke of Hamiltoune and the samen being read in their presence The saids Lords In respect That the Lord Advocat Declaired He was to raise a lyble and Insist against David Baillie befoir their Lordships Refused the desire of the Bill.

Act Liberating John and Donald Frazers

Anent The petition given and presented to the Lords of Her Majesties privie Councill By John and Donald Frazers prisoners in the Tolbuith of Edinburgh Shewing That her Lordships poor petitioners Being most unfortunatly troubled and put to ane Expence above their condition By the bringing of the petitioners from their houses in Inverness and mean Imployments first to Inverlochie and then to Edinburgh upon suspicion of ill practices againest the Government from which Their Lordships after Examination have found them Innocent And Notwithstanding off the orders given to sett the petitioners at Libertie yet Because we have noe money to Extract ane act for our Liberation nor the ordinary fies to the Good man of the Tolbuith and his servants wee are still detained howbeit He the said John Frazer is Extreamly deseased and boeth of the petitioners in extream want of all necessaries for lyfe And seeing without any crime or guilt in the petitioners They are put to the Charige of comeing Two hundered myls in the worst season of the year and most return and hes been keept here a moneth and haveing noething of our owen to defray all this Chairges and it hes been allwayes the Laudable custome off this and all weell Governed Nationes to defray the Chariges that the leidges are put to By publict authority without the least guilt in them And Therefore Craveing their Lordships To consider the petitioners misfortune and mean Circumstances and to ordaine such a soume to be given to the petitioners As their Lordships shall think reasonable for defraying their necessary Expence and for Exrtacting ane act of Liberation and the other dues for setting the petitioners at liberty or other wayes to give such effectwall orders theranent as their Lordships shall think fitt As the said petitione Bears The Lords of Her Majesties privy Councill Haveing Considered the above petition Given into them By John and Donald Frazers prisoners in the Tolbuith of Edinburgh and the samen being read in their presence The saids Lords Recommends the keepers of the Tolbuith of Edinburgh To the Lords Commissioners of Her Majesties Theasaurie for the petitioners house dues and dischairges the keepers of the said Tolbuith to keep in or detain the petitioners.

Sir James Steuart Her Majesties Advocat Haveing Represented to the board That John, Robert, and Thomas, Hendersones now prisoners in the Tolbuith of Edinburgh Hade been apprehended and Incarcerat for stealling of horses on the border And that Archbald Doulgass off Cavers Sherriff principall of the sherriffdome off Roxburgh was desirous that they should be transmitted to Jedburgh Tolbuith to be tryed there In respect witnesses could be more conveniently had at that place The crimes haveing been Committed thereabout The Lords of Her Majesties privie Councill Doe heirby Give order and warrant to the Magistrats off Edinburgh and keeper of their Tolbuith To delyver the persones off John, Robert, and Thomas, Hendersones to the said Archbald Douglass off Cavers sherriff principall of the sherriffdome of Roxburgh or any haveing his order To be by him transmitted under a saife guard to the Tolbuith of Jedburgh and ordaines the magistrats of Jedburgh and keepers of their Tolbuith To receave and detaine them prisoners therin and the said Sherriff principall and his Deputs To judge and his Fiscalls of Court To prosecute them for the saids Crimes with all convenient dilligence as they will be answerable at their perrill.

Proclamation adjourning the parliament Being read, was approven and signed and ordered to be Recorded Wherof the tenner followes
Anne By the Grace of God Queen of Great Brittan France and Ireland defender of the faith To our Lyon King at arms And his Brethren heraulds, Macers of our privy Councill pursevants Messengers at armes Our Shirriffs in that pairt Conjunctlie and seaverallie speciallie Constitute Greeting Forasmuch as the Circumstances of our affaires doe requyre a further delay of the meeting of our parliament of this our antient Kingdome of Scotland soe soon as the Two and tuentieth day of February Instant to which it was last adjourned We are Therfore Resolved to continow the said adjournment to the Fourth day of Apprill nixt and that the members may not be put to the trouble and Chairges of meeting upon the said Tuo and tuentieth day of February Wee with advice of the Lords of our privy Councill Have adjourned and heirby adjourn our said Currant parliament From the said Tuo and tuentieth day off February Instant To the said fourth day of Apprill nixt to come Requyring heirby all the members therof to attend at Edinburgh the said day in the usuall manner and under the accustomed Certeficatione’s By Law appoynted Our Will is Herefore and wee chairge yow strictly and Command That in continent thir our Letters seen ye pass to the mercat cross at Edinburgh And to the mercat crosses of the remanent head Burghs of the severall shyres and steuartries within this our antient Kingdome and there in our name and authoritie Make publict Intimation that our parliament is adjourned to the said Fourth day of Apprill nixt to come and ordaines thir presents to be printed and published.
