Recommendation to the Lord Advocat

The Lord Chancellor having produced to the Board the declarations of Israell Phippeny and others taken in London in relation to Captain Drummond, and transmitted to his lordship by Mr Wedderburne the Secretary deput, And the Samen being Read in ther presence, His Grace her Majesties high Commissioner, And the Lords of her Majesties privie Councell Doe heirby Recommend to Sir James Steuart her Majesties Advocat with the Solicitor to prepare and bring in to Councill nixt Councill day ane Commission to be granted to Some persons in London for takeing the oaths and Testimonies of the said Israell Phippeny and others In relation to the Said Captain Drummond.

The lord chancellor [James Ogilvie, earl of Seafield] having produced to the board the declarations of Israel Phippeny and others taken in London in relation to Captain Drummond, and transmitted to his lordship by Mr [Alexander] Wedderburn, the secretary depute, and the same being read in their presence, his grace [John Campbell, duke of Argyll] her majesty’s high commissioner and the lords of her majesty’s privy council do hereby recommend to Sir James Stewart, her majesty’s advocate, with the solicitor to prepare and bring in to council next council day a commission to be granted to some persons in London for taking the oaths and testimonies of the said Israel Phippeny and others in relation to the said Captain Drummond.

His Grace her Majesties high Commissioner, and Lords of her Majesties privie Councell Doe heirby Recommend to the Earle of Levine, Governour and Constable of the Castell of Edinburgh To Sett the persone of George Haynes one of Greens Crew at liberty furth of the said Castell, And gives order and warrand to the Magistrats of Edinburgh and Keepers of ther Tollbooth, To Sett the persone of […] Lintsteed one of Captain Greens Crew at Liberty furth therof.

His grace [John Campbell, duke of Argyll] her majesty’s high commissioner and lords of her majesty’s privy council doe hereby recommend to [David Melville] earl of Leven, governor and constable of the castle of Edinburgh, to set the person of George Haynes, one of [Thomas] Green’s crew, at liberty forth of the said castle, and gives order and warrant to the magistrates of Edinburgh and keepers of their tolbooth to set the person of [Thomas] Lintsteed, one of Captain Green’s crew, at liberty forth thereof.

Recommendation to Lord Advocat anent Haynes

His Grace her Majesties high Commissioner, and Lords of her Majesties privie Councell Doe heirby Recommend to Sir James Steuart her majesties Advocat to reduce into wryting the confession of Haynes one of Greens Crew in relation to money or Gold offerred to him to be ane evidence in the tryall against Green and his Crew and to report the Samen to the Councill.

His grace [John Campbell, duke of Argyll] her majesty’s high commissioner, and lords of her majesty’s privy council do hereby recommend to Sir James Stewart, her majesty’s advocate, to reduce into writing the confession of [George] Haynes, one of [Thomas] Green’s crew, in relation to money or gold offered to him to be an evidence in the trial against Green and his crew, and to report the same to the council.

Proclamation for adjourning the parliament

Anne by the Grace of God Queen of Great Brittaine, France and Irland defender of the faith To our Lyon King at armes and his Brethren Heraulds, Meacers of our privie Councill, purservants, messengers at armes, our Shirreffs in that pairt Conjunctllie and Severallie Speciallie constitut Greeting Forasmuch as wee find that the parliament of this our antient kingdome cannot conveniently meet wpon the twentie fourth day of May instant to which it stands adjurned, So that a further adjurnement for a Short tyme is necessary for our affairs; wee are therfor resolved to continue the said adjurnement to the fourteenth day of June nixt to to2 come without further delay for the good ends for which wee have called it; Therfor and that the members of our said Parliament be not putt to the trouble and charges of meeting wpon the said twentie fourth day of May instant, Wee with advyse of the Lords of our privie Councill have adjurned, and heirby Adjurne our said Current parliament from the said twentie fourth day of May instant To the said fourteinth day of June nixt to come; Requyreing heirby all the members therof to attend the said day at Edinburgh peremptorly in the usuall way and wnder the accustomed certifications by law appoynted, Our Will is Heirfore and wee charge yow Strictly and Command that in continent thir our Letters seen ye pass to the mercat cross of Edinburgh, and to the mercat crosses of the haill remanent head burghs of the severall Shyrs and Stewartries within this our antient kingdome, And ther in our name and authority by open proclamation Make publict Intimation that our said parliament is adjurned to the said fourteenth day of June nixt to come, And ordains these presents to be printed and published; Given wnder our Signet att Holyrudehouse the fyfteinth day of May, And of our reigne the fourth year 1705. Proclamation for adjourning the parliament

Anne by the grace of God queen of Great Britain, France, and Ireland, defender of the faith, to our lyon king at arms and his brethren heralds, macers of our privy council, pursuivants, messengers at arms, our sheriffs in that part conjunctly and severally, specially constituted greeting. Forasmuch as we find that the parliament of this our ancient kingdom cannot conveniently meet upon 24 May instant to which it stands adjourned, so that a further adjournment for a short time is necessary for our affairs, we are therefor resolved to continue the said adjournment to 14 June next to come without further delay for the good ends for which we have called it. Therefor and that the members of our said parliament be not put to the trouble and charges of meeting upon the said 24 May instant, we with advice of the lords of our privy council have adjourned, and hereby adjourn our said current parliament from the said 24 May instant to the said 14 June next to come. Requiring hereby all the members thereof to attend the said day at Edinburgh peremptorily in the usual way and under the accustomed certifications by law appointed. Our will is therefore and we charge you strictly and command that immediately these our letters [are] seen you pass to the mercat cross of Edinburgh, and to the mercat crosses of the whole remanent head burghs of the several shires and stewartries within this our antient kingdom, and there in our name and authority by open proclamation make public intimation that our said parliament is adjourned to the said 14 June next to come. And ordain these present to be printed and published. Given under our signet at Holyroodhouse 15 May, and of our reign the fourth year 1705. Letter from the Queens Majestie to the Councill for adjurneing the parliament to the fourteint of June nixt being Read was ordered to be recorded, and a proclamation in the termes therof being prepared, the Samen was read, Signed and appoynted to be printed, published and recorded, off which Letter the tenor follows

Right trustie and Right intirely beloved Cousine and Councellor, Right trustie and well beloved Cosuine and Councellor, Right trustie, and right well beloved Cousines and Councellors, Right trustie and well beloved Cousins and Councellors, Right trustie and well beloved Councellors, and trustie and well beloved Councellors, wee Greet yow well Wheras we find that our parliament of that our antient kingdome cannot conveniently meet wpon the twenty fourth day of May instant to which it was adjurned, And that a further adjurnement for a short tyme is necessary for our affairs, Wee therfor heirby authorize and requyre yow, To issue furth a proclamation in our name, Adjurneing our parliament from the said twentie fourth of May instant to the fourteinth day of June nixt, And ordering all the members peremptorly to attend that day at Edinburgh in the usuall way and wpon the accustomed certifications. And yow are to intimat to all our good Subjects that wee are firmely resolved our parliament Shall meet on the said fourteinth day of June without further delay, for the good ends for which wee have called it, and so we bid yow heartily farwell; Given at our Court at Kensingtoun the tenth day of May 1705. Letter from the queen’s majesty to the council for adjourning the parliament to 14 June next being read was ordered to be recorded, and a proclamation in the terms thereof being prepared, the same was read, signed, and appointed to be printed, published, and recorded, of which letter the tenor follows:
Sic Supra Scribitur Anne Regina
Right trusty and right entirely beloved cousin and councillor, right trusty and well beloved cousin and councillor, right trusty and right well beloved cousins and councillors, right trusty and well beloved cousins and councillors, right trusty and well beloved councillors, and trusty and well beloved councillors, we greet you well. Whereas we find that our parliament of that our ancient kingdom cannot conveniently meet upon 24 May instant to which it was adjourned, and that a further adjournment for a short time is necessary for our affairs, we therefor hereby authorise and require you to issue forth a proclamation in our name, adjourning our parliament from the said 24 May instant to 14 June next, and ordering all the members peremptorily to attend that day at Edinburgh in the usual way and upon the accustomed certifications. And you are to intimate to all our good subjects that we are firmly resolved our parliament shall meet on the said 14 June without further delay, for the good ends for which we have called it, and so we bid you heartily farewell. Given at our court at Kensington 10 May 1705 and of our reign the fourth year. By her majesty’s command Sic Subscribitur David Nairne.
