Act Mr Robert Stewart

Anent a Petition given in to the Lords of their majesties privy Councill be Mr Robert Stewart advocat shewing That quheras the petitioner engadged as Cautioner for Captain John Liveingstone that he should continue under his confinement within his house in the Cannongate dureing the saids Lords pleasure under a penaltie And seing the saids Lords have lately liberate the said Captain Livingston from all Imprisonment upon his finding Cautione to live peacably and appear when called wherby the petitioners former bond is fullfilled and Therfore Humbly suplicating to the effect aftermentioned The Lords of their majesties privy Councill haveing Considered this petitione given in to them be the above Mr Robert Stewart advocat They heirby give order and warrand to the Clerks of Councill to give up to the petitioner his bond of Cautionrie abovementioned.

Anent a Petition given in to the Lords of ther majesties privy Councill be Sir Thomas Stewart late of Balcaskie and Mr Roderick Mckenzie of Prestonhall shewing That the petitioners being bound as Surities for John Master of Tarbett and Alexander Frazer of Kinaeries that they should not goe above two mylles distance from the toune of Edinburgh And now seing the saids Lords have alloued the saids persones to goe to their respective homes In respect that the master of Tarbat did obtaine his majesties Remission and that Kinaries did give new baill for his liveing peacably at home and Therfore Humbly suplicating to the effect after mentioned The Lords of their Majesties privy Councill haveing Considered this petition given in to them be the above Sir Thomas Stewart and Mr Roderick Mackenzie They heirby give order and warrand to the Clerks of Councill To deliver up to the petitioners their bond of Cautionrie abovementioned.

Act for Balcaskie and Mckenzie

Concerning a petition given in to the lords of their majesties’ privy council by Sir Thomas Stewart, late of Balcaskie, and Mr Roderick Mckenzie of Prestonhall, showing that the petitioners being bound as sureties for John, master of Tarbet and Alexander Fraser of Kinneries that they should not go above two miles distance from the town of Edinburgh, and now seeing the said lords have allowed the said persons to go to their respective homes in respect that the master of Tarbat did obtain his majesty’s remission and that Kinneries did give new bail for his living peaceably at home, and therefore humbly supplicating to the effect after mentioned. The lords of their majesties’ privy council having considered this petition given in to them by the above Sir Thomas Stewart and Mr Roderick Mackenzie they hereby give order and warrant to the clerks of council to deliver up to the petitioners their bond of caution above mentioned.

The Lords of their Majesties privie Councell Doe heirby authorize and Requyre the Magistrats of Edinburgh Cannongate Leith and haill suburbs of the samen To seize upon and Committ to prisone all sturdie Beggers idle vagabounds and vagrant persones who cannot give a rationall account of the places of their Constant residence and way and manner of their Living and how they are mantained and to transmitt their names to the Clarks of Councell from tyme to tyme as they shall apprehend the forsaids persones To be by the saids Clarks presented to the saids Lords of privie Councell That their Lordships may Give ordor for delivering such of the saids persones as they shall think fitt to such officers who are presently Levying souldiers for their Majesties service in Flanders as they shall appoynte To be by the saids officers transported to Flanders for their Majesties service

Warrant to the magistrates of Edinburgh to seize sturdy beggars to be soldiers

The lords of their majesties’ privy council do hereby authorise and require the magistrates of Edinburgh, Canongate, Leith and whole suburbs of the same, to seize upon and commit to prison all sturdy beggars, idle vagabonds and vagrant persons who cannot give a rational account of the places of their constant residence, and way and manner of their living and how they are maintained, and to transmit their names to the clerks of council from time to time as they shall apprehend the foresaid persons, to be by the said clerks presented to the said lords of privy council that their lordships may give order for delivering such of the said persons as they shall think fit to such officers who are presently levying soldiers for their majesties’ service in Flanders as they shall appoint, to be by the said officers transported to Flanders for their majesties’ service.

Committie Anent the toune of Edinburgh Anent persons seased as souldiers

Anent a petitione given In to the Lords of their Majesties privie Councill Be the Magistrats and toune Councell of Edinburgh Sheuing That wheras severall officers who are Levying Recruits have summarly seized and Imprisoned some Apprentices and also servants who have not consented to take on uith them nor taken their Earnest […] aither as servants or souldiers And in respect that such Irregular practices have been the occasione of severall disordors and tumults The petitioners Have found themselves obleidged to represent this Illegall practice to their Lordships That a suitable Remedie may be provyded And therfore Humblie Craving their Lordships to discharge all officers and others to seize or imprisone any Apprentices or servants who have not uillingly Consented or taken on within this City and suburbs therof And Grant warrand for liberatione of all these that are illegallie Imprisoned as the said petitions Bears The Saids Lords of their Majesties privy Councell Having Considered this petitione given In to them be the Magistrats and toune Counsell of Edinburgh They heirby Recommend to the Master of Burleigh and the Laird of Grant To Repaire to the tolbooth of Edinburgh Cannongate and Leith and alse to the Castle of Edinburgh And to Call for such persones as are Committed to the saids prisones upon pretence of Having taken on with any of the officers presently Levying souldiers To be transported to Flanders for their Majesties service And particularly for John Fergusone Androw Kinnings and Androw Gullans prisoners In the tolbooth of the Cannongate upon the forsaid account And Lykeways to Call for the officers By whose warrand they are Committed And to examine and take tryall if these persones have willingly taken on with the saids officers or receaved their money or if they be forced and Compelled to prisone Against their will uithout having taken on or receaved their money And to report to the Councell the names of such persones as they find they are Compelled and the cases of such as they are not clear in And discharges the Keepers of the forsaids prisones to delyver the persones Imprisoned upon the pretence forsaid to the officers or others by whom they are Committed or to suffer them to goe furth of the forsaids prisones untill the samen be visited by the forsaid Committie and report made to the Lords of privie Councell

Committee concerning the town of Edinburgh over persons seized as soldiers

Concerning a petition given in to the lords of their majesties’ privy council by the magistrates and town council of Edinburgh showing that whereas several officers who are levying recruits have summarily seized and imprisoned some apprentices and also servants who have not consented to take on with them nor taken their earnest […] either as servants or soldiers, and in respect that such irregular practices have been the occasion of several disorders and tumults, the petitioners have found themselves obliged to represent this illegal practice to their lordships that a suitable remedy may be provided, and therefore humbly craving their lordships to discharge all officers and others to seize or imprison any apprentices or servants who have not willingly consented or taken on within this city and suburbs thereof, and grant warrant for liberation of all those that are illegally imprisoned as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the magistrates and town council of Edinburgh, they hereby recommend to [Robert Balfour] master of Burleigh and [Ludovic Grant] laird of Grant to repair to the tolbooth of Edinburgh, Canongate and Leith and also to the castle of Edinburgh, and to call for such persons as are committed to the said prisons upon pretense of having taken on with any of the officers presently levying soldiers, to be transported to Flanders for their majesties’ service, and particularly for John Ferguson, Andrew Kinnings and Andrew Gullans, prisoners in the tolbooth of the Canongate upon the foresaid account, and likewise to call for the officers by whose warrant they are committed, and to examine and take trial if these persons have willingly taken on with the said officers or received their money or if they be forced and compelled to prison against their will without having taken on or received their money, and to report to the council the names of such persons as they find they are compelled and the cases of such as they are not clear in, and discharges the keepers of the foresaid prisons to deliver the persons imprisoned upon the pretense foresaid to the officers or others by whom they are committed or to suffer them to go forth of the foresaid prisons until the same be visited by the foresaid committee and report made to the lords of privy council.

The Lords of their Majesties privy Councell Doe herby Recommend to the Earls of Craufurd and Leven Lord viscount Stair Lord Raith Thesaurer depute Lord Ruthven Sir Colline Campbell of Aberuchill one of the senators of the Colledge of Justice Sir Robert Sinclar of Stevensone Sir John Maxuell of Pollock and Sir Thomas Livingstoune Commander in cheiff of their Majesties forces within this Kingdome To Consider how ane sufficient ship of force and Guns well conditioned may be Instantly provyded for defence of the Countrie and the securitie of vessells passing up and doune the firth Against the Rebells now in the Bass who have provyded themselves with a Large boat and what shipp will be most convenient for this Interprize and what number of men and Cannon and what amunitione or other provisione she will stand in need of and how the samen may be most Conveniently and Speedily furnished And Recommends to the said Committie to prepare a draught of a Letter to be wryten from the Councell to the severall shirreffs of this kingdome or their deputes authorizing and Requyring them to seize upon and Committ to prisone all sturdie beggars idle vagabonds or vagrant persones who Cannot Give a rationall account of the places of their Constant residence and way and manner of their Living and how they are mantained and delyver them to the officers presently Levying souldiers by warrand of Councell To be transported to Flanders for their Majesties service And declares any three of the forenamed persones to be a Quorum And Recommends to them to make their report to the Lords of privy Councell at their nixt dyet of meeting

Letter from the Marques of Athole anent a Company of men

A letter from the Marques of Athole to Sir Thomas Livingstoune acquanting him that his Lordship hes in readines ane hundred men for their Majesties service upon the Master of Stairs Letter (but that none other of his neighboures tho requyred to provyde the lyke number have any at all ready) Being presented by Sir Thomas Livingstoune and red at the Board The Councell declyned to medle in that matter as having neither receaved any advertisement nor instructione from the Kings Majestie anent these Companies.

Letter from [John Murray] marquis of Atholl concerning a company of men

A letter from [John Murray] marquis of Atholl to Sir Thomas Livingstone acquainting him that his lordship has in readiness a hundred men for their majesties’ service upon [John Dalrymple] master of Stair’s letter (but that none other of his neighbours though required to provide the like number have any at all ready) being presented by Sir Thomas Livingstone and read at the board, the council declined to meddle in that matter as having neither received any advertisement nor instruction from the king’s majesty concerning these companies.

Liberation Grogan Oneill and John Bourgatt

Anent a petitione Given In to the Lords of their Majesties privie Councell Be Grogan Oneill and John Bourgat prisoners In Edinburgh tolbooth Sheuing That wher the petitioners By a former petitione given In to their Lordships did therby Represent their Coming over from Ireland with the Earle of Seaforth And how they voluntarly Left the Highlands And of their procuring Collonell Hills pass and Recommendatione The saids Lords by their Last delyberance upon the forsaid petitione appoynted them to Ingadge with Leivtennant Dicksone who by the said delyverance was ordained to make payment [to] the master of the prisone of their Jayle Fees But he finding That the same amounts to more money By farr then he Can have tuo men for And therupon refuises to accept of the petitioners in these termes quherby they shall still remaine in prisone Botwithstanding they are uilling to obey their Lordships Interloquitor But Cannot gett it obeyed for want of money to pay the jayle fees Having been alimented by their Lordships at fyve shilline per diem since their Incarceratione And therfore Humblie Craving their Lordships to take the premisses to their Consideratione Especially seing Leivtennant Dicksone refuises to pay the jayle fee being to Great And the petitioners have not wherwith to Recommend the master of the prisone to the Lords of the Thesaury for payment of his jayle fees The petitioners being Immediatly to depart the kingdome as the said petitione Bears The saids Lords of their Majesties privie Councell Having Considered this petitione Given in to them Be the above Grogan Oneill and John Bourgatt They Give ordor and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth To sett the petitioners at Liberty furth therof In respect they have Given their oathes In presence of a privie Councellor That they shall departe furth of their Majesties dominiones Betuixt and the first day of March nixt to Come and sooner if opportunity shall offer And that they shall not Returne therto uithout his Majesties or their Lordships warrand And that they shall not bear armes against their Majesties King William and Queen Mary or their Allyes And in the meantyme that they shall Live peacablie and uith all submissione to the present Government under their Majesties And that they shal not Act Consult or Contryve any thing in prejudice therof nor Converss or Corespond uith any Rebells And that they shall appear before the saids Lords when called for And ordaines the Master of the tolbooth to sett the petitioners at Libertie free of house dues And Recommends him to the Lords of Thesaurie To Cause payment be made to him therof

Liberation of Grogan O’Neill and John Bourgat

Concerning a petition given in to the lords of their majesties’ privy council by Grogan O’Neill and John Bourgat, prisoners in Edinburgh tolbooth, showing that where the petitioners by a former petition given in to their lordships did thereby represent their coming over from Ireland with [Kenneth Mackenzie] earl of Seaforth and how they voluntarily left the Highlands, and of their procuring Colonel Hill’s pass and recommendation. The said lords by their last deliverance upon the foresaid petition appointed them to engage with Lieutenant Dickson who by the said deliverance was ordained to make payment to the master of the prison of their jail fees, but he finding that the same amounts to more money by far than he can have two men for, and thereupon refuses to accept of the petitioners in these terms whereby they shall still remain in prison, but withstanding they are willing to obey their lordships interlocutor but cannot get it obeyed for want of money to pay the jail fees having been alimented by their lordships at five shillings per day since their incarceration, and therefore humbly craving their lordships to take the premises to their consideration, especially seeing Lieutenant Dickson refuses to pay the jail fee being too great, and the petitioners have not wherewith to recommend the master of the prison to the lords of the treasury for payment of his jail fees, the petitioners being immediately to depart the kingdom as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Grogan O’Neill and John Bourgat they give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth, to set the petitioners at liberty forth thereof, in respect they have given their oaths in presence of a privy councillor that they shall depart forth of their majesties’ dominions between now and 1 March next to come and sooner if opportunity shall offer, and that they shall not return thereto without his majesty’s or their lordships’ warrant, and that they shall not bear arms against their majesties King William and Queen Mary or their allies, and in the meantime that they shall live peaceably and with all submission to the present government under their majesties, and that they shall not act, consult or contrive anything in prejudice thereof nor converse or correspond with any rebels, and that they shall appear before the said lords when called for, and ordain the master of the tolbooth to set the petitioners at liberty free of house dues, and recommend him to the lords of treasury to cause payment be made to him thereof.

Recommendatione to The Thesaury to provyde a ship and money for the present expedition against the Rebells

The Lords of their Majesties privie Councell Doe heirby Recommend to the Lords Commissioners of their Majesties Thesaury to Cause provyde ane sufficient shipp and well Conditioned fitt for transporting such things as shall be found necessar for ther Majesties service In the present expeditione Against the Highlanders and other Rebells And in case of refuisall of the skipper or ouners of the said shipp To Fraught or if the skipper or his Company [refuse] to saill the said ship Recommends to and authorizes the saids Lords Commissioners to Cause force the same Being for their Majesties speciall service The saids Lords Commissioners being alwayes Lyable and becoming bound For payment of the Fraught of the said shipp at a reasonable rate And Lykewayes Recommends to the saids Commissioners to provyde and have in readines such soumes of money as will be needfull for defraying the Incident charges of their Majesties Forces in this expeditione To be delyvered to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces within this Kingdome or any whom he shall appoynte and that from tyme to tyme as occasione shall requyre and as the samen shall be called for As also Cause payment be made to Captain Fletzer Captaine of the Artillarie Company of such soumes of money as their Lordships shall find necessary For putting of the said Captaine and his Company of artillarie men In a present Condition to march with their Majesties forces in the above expeditione And that all thir things be done with dilligence and dispatch as the present state of their Majesties forces does requyre

Recommendation to the treasury to provide a ship and money for the present expedition against the rebels

The lords of their majesties’ privy council do hereby recommend to the lords commissioners of their majesties’ treasury to cause provide a sufficient ship and well conditioned fit for transporting such things as shall be found necessary for their majesties’ service in the present expedition against the highlanders and other rebels, and in case of refusal of the skipper or owners of the said ship to freight or if the skipper or his company refuse to sail the said ship, recommend to and authorises the said lords commissioners to cause force the same being for their majesties’ special service, the said lords commissioners being always liable and becoming bound for payment of the freight of the said ship at a reasonable rate, and likewise recommend to the said commissioners to provide and have in readiness such sums of money as will be needful for defraying the incident charges of their majesties’ forces in this expedition, to be delivered to Sir Thomas Livingstone, commander in chief of their majesties’ forces within this kingdom, or any whom he shall appoint, and that from time to time as occasion shall require and as the same shall be called for, as also cause payment be made to Captain Fletcher, captain of the artillery company, of such sums of money as their lordships shall find necessary for putting of the said captain and his company of artillery men in a present condition to march with their majesties’ forces in the above expedition, and that all these things be done with diligence and despatch as the present state of their majesties’ forces does require.

Forasmuchas By a printed Act of Councell of the date the tuelvth day of Janwary Instant The shirreffs principalls of the severall shires of this Kingdome their Deputes and Clarks are ordained to transmitt to the Clarks of privie Councell Not only the Lists of the persones who have taken the benefite of their Majesties gracious Indemnity but Lykewayes the oathes already suorne and signed by the takers therof with their originall subscriptiones And that before the persones and in the precise termes mentioned in the said Act betuixt and the tuenty fifth day of January Instant for such as are on this syde of the river of Tay and the tenth day of February nixt for those on the other syde therof And the Lords of their Majesties privy Councell Considering That the present state of their Majesties affaires does requyre That the forsaids Lists and oathes uith the originall subscriptiones be transmitted to the Clarks of Councell before the dayes above sett doune Therfore they heirby Requyre and Command the saids shirreffs principalls and their deputes and Clarks Instantly upon their receaving of a printed Coppie of this Act To transmitt to the saids Clarks of Councell without any delay the saids Lists and oathes with the originall subscriptiones And appoyntes their Majesties Sollicitor or his assistants Immediatly to dispatch expresses to the severall shyres with Coppies of this Act to the shirreff Clarks of the severall shires To be by them Intimat to their shirreffs principalls and shirreff deputes Uith Certificatione to such as shall faillzie In not Giving punctuall obedience to this Act That the same shall be accounted a malversatione in their office and shall Inferr the punishment of Deprivatione and they shall be depryved accordingly And ordaines these presents to be printed

Act requiring lists and original subscriptions of those that have taken the Indemnity to be transmitted to the clerks of the council

Forasmuch as by a printed act of council of the date 12 January instant the sheriff principals of the several shires of this kingdom, their deputes and clerks are ordained to transmit to the clerks of privy council not only the lists of the persons who have taken the benefit of their majesties’ gracious Indemnity, but likewise the oaths already sworn and signed by the takers thereof with their original subscriptions, and that before the persons and in the precise terms mentioned in the said act between and 25 January instant for such as are on this side of the river of Tay, and 10 February next for those on the other side thereof, and the lords of their majesties’ privy council considering that the present state of their majesties’ affairs does require that the foresaid lists and oaths with the original subscriptions be transmitted to the clerks of council before the days above set down, therefore they hereby require and command the said sheriff principals and their deputes and clerks instantly upon their receiving of a printed copy of this act to transmit to the said clerks of council without any delay the said lists and oaths with the original subscriptions. And appoints their majesties’ solicitor or his assistants immediately to despatch expresses to the several shires with copies of this act to the sheriff clerks of the several shires to be by them intimated to their sheriff principals and sheriff deputes with certification to such as shall fail in not giving punctual obedience to this act that the same shall be accounted a malversation in their office and shall infer the punishment of deprivation and they shall be deprived accordingly, and ordain these presents to be printed.
