The Lords of their majesties privy Councill haveing heard a Petition given in to them be Mr William Lindsay minister at Alva Representing that he hade given all submissione to the present government by praying for their majesties, And that notwithstanding therof he was in obedience to the late act of Parliament forced to desist from his charge and allow Mr Richard Howiesone who was former presbyterian minister at that church to in the year Jaj vjc sixtie one to reenter to the same and now he haveing removed voluntarly at Candlmis last to another Church he got ane unanimous Call to Returne, yet2 the petitioner was cited before the3 Synod4 at Stirling and Did5 Discharge him from preaching at that Church or any other Church And Craveing that the saids Lords would allow him the legall exercise of his ministrie Conforme to his legall admission at that place, And to grant him the half of the years stipend Jaj vjc nyntie one conforme to the patrons gift In respect at his removall he hade lost a full years And to continue him the benefice for this incouragment during his service ther The Saids Lords heirby appoint one of their Clerks to wryt to the Presbytrie of Stirling desyring them to send over some of their number to Edinburgh to attend the Comittie of Councill appointed to conferr with them on the above matter viz Sir John Lauder of Fountonhall one of the senators of the Collodge of Justice and Sir Robert Sinclar of Stivensone, And that at the dyet to be appointed be the said Comittie And appoynts the Clerk to transmitt a Coppie of this petition in the letter to the said Presbytrie.

The Lords of his majesties Privy Councill haveing Considered a Petitione given in to them be Mr William Smart minister at Ecclesmachan Craveing the saids Lords to recall any acts that hade post by misinformatione to the prejudice of his Just right)2 In favors of Mr William Simervall and Jean Brown and to grant warrand to the petitioner to uplift the stipend of the year Jaj vjc Eightie nyne, and nyntie, seing he hade served intirely for the one and his patrones consent for both which was Requyred by law for the other, And in order to the reversing of the acts in their favors to reveiw the narative of Jean Browns first petitione and Mr Simervells answeres and to Compeir them with this Petition and if any dificulty remained to hear the parties in their oun presence, and that in the mean tyme suspensione might be granted at the instance of the heritors and others Lyable in payment The Saids Lords heirby sist all executione upon the above acts in favors of Mr William Hay for the above stipend untill the first Councill day of June nixt inclusive And in the mean tyme allowed Mr Simervell and Mrs Hay to see and ansuer the said Petition.

Remit In favors of James Scot Souldier

Anent a Petition given in to the Lords of their Majesties privy Councill be David Earle of Leven etc Collonoll of a Regiment of Foot Shewing That quher on James Scot souldier belonging to his Regiment haveing procured a Forloaff for some short time to stay in the Countrey for setling his affairs when the Regiement went for Flanders, And Which haveing soon ended, He was waiting the first occasion of Ships goeing ther, Mean tyme Hedderwick of Pittculls upon some pretence of a Privat debt alledged owing be the said James Scot to him has caused aprehend him and secure him within the Tolbooth of Dysert wher he is Lying Starving without the assistance of the least fardine from the said Pittcull for his subsistance Wherby the said James Scot is rendered miserable, And it being altogither inpracticable to stopt souldiers when they are actually in their Majesties Service besydes their goeing to a Compaigne by shuting them up in starving prisones And Therfore Humbly Craveing the saids Lords to give order to sett the said James Scot at Libertie that he might be in readienes to goe allongst with the Ships now in the Road of Leith to attend his dutie And for that effect to grant warrand to the magistrats and Goaller in Dysert and to interpose their Lordships authoritie therto as the petition bears The Lords of their majesties privy Councill haveing Considered this Petition given in to them be the above Earle of Leven in name of the above James Scot They heirby Recomend to the Lords of Councill and Session to grant suspension and charge to put at Libertie to the said James that he may not be detained from their majesties service.

Anent a Petition given in to the Lords of their majesties privy Councill be William Biggar of Wolmett Shewing That the petitioner haveing become Cautioner for Captain James Wauchop his peacable behavior under the present government and for presenting his person when called, And the petitioner haveing Continued now these thrie years Cautioner for the said Captaine Wauchop and presented him severall tymes And nothing being qualified dureing that tyme against him and the petitioner being unwilling to Lye any longer under the said Cautionrie And therfore Humbly Craveing the saids Lords to Discharge the petitioner of his said Cautionrie for the said, Captain Wauchop And Ordaine his bond to be given up as the petitione bears The Lords of their majesties privy Councill haveing Considered this petition given in to them be the above William Biggar of Wolmett with another petitione given in to them be the above Captain Wauchop to the same effect They heirby give order and warrand to the Clerks of Privy Councill To deliver up the above bond of Cautionrie to the petitioner.

Remitt to the thesaurie anent the burgh of Aberdeen Montross etc

Anent a Petition given in to the Lords of their Majesties privy Councill be the Burghs of Aberdeen, Montross Bamff, Dundie, Cullen and Aberbrothwick Shewing That quher in obedience to the saids Lords proclamation and Comands, The petitioners hade brought up and delivered off their respective proportiones and quotta of the seamen or therby, Imposed upon them And have Recovered recepts therupon, And in Respect the petitioners have been at great and Considerable Charges and expences in mantaneing of the said seamen since the time of the outtaking of them some of the space of two moneths some six weeks and others for Lesser tyme, And in transporting of them into this place with guards and in takeing up and makeing lists of seamen in other sea Ports not within their Jurisdictiones (By and attour what is alowed by their majesties proclamatione being Fourtie shilling sterling and sixpence per diem from the day of their march Conforme to the respective accounts therwith produced, And that ther are considerable soumes due to the petitioners allready advanced for their majestie forces, and quherof they hade gotten no payment By all which they are Disabled to serve their majesties in their station as they willingly would And Therfore Humbly Craveing the saids Lords to take the premisses to their Consideratione And grant warrand to the petitioners to have allowance of the soumes of money abovementioned advanced be them as extraordinary expences upon the accompt of the said seamen out of the cess payable be them Wherby they might be inabled and encouradged to their dutie in their majesties service in all tyme comeing as the petitione bears. The Lords of their Majesties privy Councill Haveing heard this petitione given in them be the above burghs They Remit the same and accompts quherto it relates To the Consideratione of the Commissioners of their Majesties thesaurie And Recomends to their Lordships to doe therin as the should find Just.

The Lords of there Maejstyes privie Councill haveing considered the above mentioned report They approve thereof And Recomends to the Lord High Chancellour to transmitt a coppie of the same and of the petitiones given in be Halyburtoun and Fraser to the secretaries of state to be by them or aither of them Communicat to his Majesty at his convenience And Humbly remitts the same to his Majestyes Royall Consideratione for Makeing his pleasure therein knowen to the Councill
