Interloquitor Serjeant Kerr

The Lords of his majesties privie Counsell haveing considered ane act made by ther Lordships of the date the twentie one day of Jullie Jaj vic and nyntie six yeirs allowing the baillies of the Cannogate and keeper of ther tollbwith to sett William Ker sometyme Serjeant in Captaine Lockhart his troupe of Dragownes at Libertie with the said Serjeant Kers consent upon the back of the said act to goe abroad wnder the Command of Leivtenent Waler Lockhart in Major generall Coillzers regiment to serve the King with this provisione that he gett his Libertie Conforme to the said act Since he is only detained for want of money to Satisfie the keeper of his house dwes The saids Lords of his majesties privie Cownsell Doe heirby ordaine James Hamiltowne keeper of the tollbwith of the Cannogate to sie and ansuer befor ther Lordships that he may be heard to object why the said serjeant Ker Should not be Sett at Libertie without payment of the Saids house dwes

Anent the petitione given in to the Lords of his majesties privie Counsell Be John Christie writer in Edinburgh Shewing That wher […] Macdonald of Sleat […] Mclewd of Tallascar and […] Mcleane of Tarlosk and ther tenents are Justice adebted and owing to the petitioner severall considerable Debts and Soumes of money for payment wherof the petitioner haveing recovered Decreit and therupon raised Letters of horneing and other dilligences against them And Haveing imployed severall messengers for executeing the Same They altogither refwse the Dwe executione therof not finding tutum accessum wnles they have the protectione of and be assisted by Some of the next adjacent forces wherby the petitioner is in hazard to Lose the Debts for want of Dwe executione of the Law wnles ther Lordships provide remeid And therfore humblie craveing to the effect eftermentioned As the said petitione bears Which petitione being this day red and considered be the Saids Lords of privie Cownsell They heirby recomend to the viscownt of Tiviot Comander in cheiff of his majesties forces within this kingdome to give order to a competent number of his majesties forces to be assisting to the petitioner in the due executione of his legall dilligences against the persones above named in the Isles of Sky and Slait But refwses the Desyre of the petitione as to the above Mclane of Tarlosk or any other persones within the Isle of Mull As to which the saids Lords Leaves the petitioner to apply to the magistrats and Judges ordinary within the said Isle of Mull

Liberation The Duke of Gordon

Anent the petition given in to the Lords of his Majesties privie Councill By George Duke of Gordon Sheuing That wheras the petitioner was Imprisoned uithin the Castle of Edinburgh uith others To whom ther Lordships has been pleased to Grant Libertie And the petitioner having been very sickly of a Long tyme occasioned particularly by his Long Confynments and frequent Imprisonments And that his affairs alse uell as his health requires the petitioners Libertie And therfore humbly Craving to the effect to the underwryten as the said petition Bears The saids Lords of his Majesties privie Councill having Considered this petitione given in to them by the said George Duke of Gordon They heirby Recommend to the Earle of Leven Constable and Governour of the Castle of Edinburgh And In his absence Gives order and warrand to the nixt Commanding officer ther to sett the said petitioner at Libertie furth therof In respect before extracting heirof he hath given bond and found sufficient Cautione acted in the books of his Majesties privie Counsell That he shall not goe further north then this syde of the uater of Tay And the he shall Live peacably under and uith all submission to the present Government of his Majestie King William And that he shall not Act Consult or Contryve anything in prejudice therof nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords of his Majesties privy Councell whensoever he shall be Called for or required to that effect under the penaltie of tuo thousand pounds Sterling In caise he shall transgress in any pairt of the premisses And the saids Lords appointes the petitioners former bond to be given up to him.

The Lords of his Majesties privie Councill Doe heirby Recommend to the Lords Commissioners of his Majesties Thesaury To Cause buy up and prepare sufficient fyrearmes for the three Fourth parts of the halfe foot militia uithin this Kingdome It having been already recommended to the saids Lords to provyde fifteen2 hundred Lochaber axes for the other Fourt part of the said halfe foot militia.

Anent the petition given in to the Lords of his Majesties privie Councill By the provost Toun Counsell and Community of the burgh of Dundie Sheuing That wher the burgh of Dundie having appeared at the beginning of his Majesties most happie revolution Government And upon all occasiones ever since very zealous for his Majesties service wherby they have been and are exposed to the malice of his Majesties Enemies And the armes of the said burgh their Quota of the Militia being in a Great part aither Lost or become useless And the petitioners theirby rendered Incapable to send their said quota sufficiently armed for his Majesties service (if called for) or to defend themselves against his Majesties Enemies Forraign and domestick if they should be attackt as they have been severall tymes threatned by the one And being a seaport toune are exposed to the other And therfore humblie Craving to the effect underwryten as the said petition Bears The Saids Lords of his Majesties privie Councill having Considered this petitione given in to them By the provost Baillies Toune Counsell and Community of the burgh of Dundie They doe heirby allow the petitioners to Import into this Kingdome ane hundreth Stand of sufficient fyrearmes to be Imployed by them for arming their Militia or defending themselves against his Majesties enemies And the saids Lords Recommends to the Lords Commissioners of his Majesties Thesaury To discharge the tacksemen of his Majesties Customes and their Collectors Surveyors or uaiters to exact any publick deuty for the saids armes.

Order Anent breaking weights for weighing meall in Glasgow

A Letter direct from The Magistrats of Glasgow to the provost therof now in Edinburgh (and given back to him again) Giving account of ane disorder Committed In Glasgow by the souldiers and some of the Inhabitatns In breaking the weights made use of for weighing of meall and destroying the Balks and other things made use of for the same And being read The Lords of his Majesties privie Councill Doe heirby Give full pouer warrand and Commission to the Magistrats of Glasgow to Call and Conveen before them the persons guilty of the said ryott Tumult or disorder (except Souldiers) And to take tryall by witnesses or otherwise for coming to the knouledge of the particular persones guilty of the same And to fyne or otherwise punish them according to their demerite except four or fyve of the ring Leaders and most guiltie of the saids persons whom The saids Lords ordaines the saids magistrats to send prisoners to Edinburgh togither with sufficient evidences and probation to be made use of against them And appointes the Magistrats of Edinburgh and Keeper of their tolbooth to receave and detaine the saids four or fyve persons till farder order And the saids Lords Recommends to the viscount of Teviott Comander in cheiff of his Majesties forces uithin this Kingdome to wryte to the Commanding officer of the Forces in Glasgow that he take tryall if any of his Souldiers be guilty of the said disorder or tumult And to see that they be Condignly punished.
