Warrand to the Lord Advocat to wryte to shirreffs anent the defecient Levys

The Lords of their Majesties privy Councell Doe heirby Recommend to Sir James Steuart their Majesties Advocat to wryte to the shirreffs of the severall shires uithin this Kingdome That they Cause make up such of the Levys uithin their bounds as the shire hath been deficient in and which they have not delyvered Conforme to the orders and proclamations of Councell And to Cause transport the saids deficients to the places and delyver them to the persons and upon the dayes all aftermentioned viz These on this syde of the river of Tay at Glasgow upon the tuenty fourth day of Apryle instant and these on the other syde of Tay to the toune of Stirling upon the Eight day of May nixt to the Commanding officers for the tyme being uithin the saids touns respective and that the persons to be delyvered be transported and Intertained untill delyvery att the expensses and upon the Charge of such as have been deficient and to Certifie the shirreffs That these Lyable to send their deficients shall In caise of failzie be punished in dowble the penaltie Contained in the proclamations and Instructiones published theranent

The Lords of their Majesties privie Councell Doe heirby ordaine […] Steuart of Appine to be transported prisoner from Fortwilliam to the tolbooth of Edinburgh And appointes Collonell John Hill Governour of Fortwilliam to Cause transport him under a sufficient guaird And delyver him to the magistrats of Edinburgh and Keeper of their tolbooth whom they ordaine to receave the said Laird of Appine from the said guaird And to Committ and detaine him prisoner in their tolbooth till farder order

Act Colline Mckenzie uncle to the Earle of Seaforth

The Lords of his Majesties privie Councell being Informed by Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdom That Mr Colline Mckenzie uncle to the Earle of Seaforth being of a Great age and very valitudinary may be in dainger of his Life if he shall be restricted to a prisone They heirby declare the said Mr Colline to be free from going to prisone And Confynes him to his house of Herbertshire and tuo Mylls about the same And discharges him to goe uithout the bounds of his Confynment In respect that he hath given bond and found sufficient Cautione acted in the books of privy Councell That he shall keep his said Confynment and not goe uithout the bounds of the same And in the mean tyme that he shall Live peacably under and uith all submission to the present government of his Majestie King William and Queen [Mary] and that he shall not Act Consult nor Contryve any thing in prejudice therof nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords whensoever he shall be Called or requyred therto under the penaltie of tuo thousand merks scotts money In caise he shall transgress In any pairt of the premisses

Leivtenant Collonell Steuart who was Cited by order of the Lords of privie Councell To have ansuered this day for disobeying the order of a Committie of Councell wherby he was requyred to send ashoar from John Watsone in Callforgie who was shipped as a souldier for Flanders And Ansuering that he uould respect noe order but ane express from Sir Thomas Livingstoune Commander in cheiff of their Majesties forces within this kingdome Having Compeared personallie and the Instrument taken against him being read He declared That if he had In any manner transgressed the Councells Commands It uas meer ignorance uithout designe And therfore he was absolutly Innocent of all Contempt The Lords of their Majesties privie Councell Having Considered the matter and particularly the above Instrument Bearing the particular words above exprest They ordered the Leivt Collonell to be Carryed prisoner from the barr to the tolbooth of Edinburgh And In the mean tyme ordaines the Leivtenant Collonell to Cause transport the persone of the said John Watsone from any ship wherin he is to the tolbooth of Edinburgh and the magistrats of Edinburgh and Keeper of their tolbooth to detaine him till farder order from the Councell or the Committie appointed anent pressed men And Recommends to the Committie to Give order for Liberating the said Leivtenant Collonell after the said John Watsone shall be brought in to the said tolbooth
