Warrand to the Lord Mark Kerr to beat Drums for levieing a redgment of foot

The Lords of her Majesties privie Councell Doe heirby Grant Licence and warrand to Lord Mark Kerr Brother to the Marques of Lothian, or others haveing warrand from him to beat Drums within the Severall burghs of this Kingdome, wher they Shall have occasion to resort for levieing a redgment of foot To be Commanded by the said Lord Mark to Serve her Majestie in Flanders upon the English establishment, And allows the said Lord Mark, or these haveing his warrand to have the use of the prisons in any burgh within this kingdome for detaineing and keeping the persons so to be levied and taken on, wntill they Shall be transported to Holland, And ordains all Magistrats and others to give ther concurrance to the said Lord Mark, or these haveing his warrand to Secure the persons So to be levied, and willingly taken on, wpon ther own proper charges and expensses; And prohibits and discharges all disorders or abuses to be committed in levieing and secureing as above, but alewayes to keep themselves within the bounds the Law prescrybes.

The lords of her majesty’s privy council doe hereby grant licence and warrant to Lord Mark Kerr, brother to [William Kerr] the marquis of Lothian, or others having warrant from him, to beat drums within the several burghs of this kingdom, where they shall have occasion to resort for levying a regiment of foot to be commanded by the said Lord Mark to serve her majesty in Flanders upon the English establishment. And allow the said Lord Mark, or these having his warrant, to have the use of the prisons in any burgh within this kingdom for detaining and keeping the persons so to be levied and taken on, until they shall be transported to Holland. And ordain all magistrates and others to give their concurrence to the said Lord Mark, or those having his warrant, to secure the persons so to be levied, and willingly taken on, upon their own proper charges and expenses. And prohibit and discharge all disorders or abuses to be committed in levying and securing as above, but always to keep themselves within the bounds the law prescribes.

Repryve In favours of Elizabeth Hunter

Anent the petition given in and presented to the Lords of her Majesties privie Councell by Elizabeth Hunter a poor condemned prisoner in the Tollbooth of Edinburgh, Humbly Shewing that She being but nyne years of age She was taken home by one John Brown her Uncle to his house, wher being naturally weak and Simple, She was keept till She was Sevinteen years of age, and then gott with child by my Uncle himselfe, but concealled her being with child till She brought furth the Same ten weeks befor the tyme, And that without calling for help, For which Crymes being brought befor the Lords of Justiciary, She freely confessed them, only the two midwyves that wer examined as wittnesses in the tryall did both declaire that the child wanted about ten weeks of its full tyme, wherwpon it was thought I was not in the terms of the act of parliament, Since it could not be said I had conceaved her being with Child the wholl tyme lykeas the Child was Still borne, yet by the verdict of the assyze She was brought in guilty both of murder and Incest; But the Lords considering the Circumstances of her case; and her nottor Simplicity and weakness, appoynted the execution of the Sentence to be on the last wednsday of Apryll, on purpose that in the mean tyme, She might apply to the saids Lords of Privie Councell for a repryve and Commutation; and therfor Craveing it might please their lordships the poor Supplicant and to repryve and Commute her Sentence and punishment as ther lordships Should See cause, as the said petition bears, The Lords of her Majesties Privie Councell haveing considered the petition given in to them by Elizabeth Hunter prisoner in the Tollbooth of Edinburgh found guilty of and condemned to dy for the crymes of murder and Incest, Craveing a repryve and Commutation of her Said Sentence and punishment, The saids Lords doe heirby Repryve the said Elizabeth Hunter from the Sentence of death appoynted to be execute upon her the Last wednsday of Apryll instant from the said day To the third Twesday of June nixt to come, And discharges the said sentence of death to be putt in execution against her till the said day; And appoynts and ordains the said sentence of death pronounced against the said Elizabeth Hunter by the Lords of Justiciary, To be putt to punctuall execution against her the said third twesday of June nixt to come, And gives order and warrand to the Magistrats of Edinburgh, to cause the said Sentence of death be putt to punctuall execution against the Said Elizabeth Hunter at the Same place and in the Same maner mentioned and contained in the said Sentence. Reprieve in favour of Elizabeth Hunter

Concerning the petition given in and presented to the lords of her majesty’s privy council by Elizabeth Hunter, a poor condemned prisoner in the tolbooth of Edinburgh, humbly showing that she being but nine years of age, she was taken home by one John Brown her uncle to his house, where being naturally weak and simple, she was kept till She was seventeenth years of age, and then got with child by my uncle himself, but concealed her being with child till she brought furth the same ten weeks before the time, and that without calling for help. For which crimes being brought before the lords of justiciary, she freely confessed them, only the two midwives that were examined as witnesses in the trial did both declare that the child wanted about ten weeks of its full time, whereupon it was thought I was not in the terms of the act of parliament, since it could not be said I had conceived her being with child the whole time, likewise the child was stillborn, yet by the verdict of the assize she was brought in guilty both of murder and incest. But the lords considering the circumstances of her case, and her notorious simplicity and weakness, appointed the execution of the sentence to be on the last Wednesday of April, on purpose that in the meantime, she might apply to the said lords of privy council for a reprieve and commutation. And therefore craving it might please their lordships [to take pity on] the poor supplicant and to reprieve and commute her sentence and punishment as their lordships should see cause, as the said petition bears. The lords of her majesty’s privy council having considered the petition given in to them by Elizabeth Hunter, prisoner in the tolbooth of Edinburgh, found guilty of and condemned to die for the crimes of murder and incest, craving a reprieve and commutation of her said sentence and punishment, the said lords doe hereby reprieve the said Elizabeth Hunter from the sentence of death appointed to be executed upon her the last Wednesday of April instant from the said day to the third Tuesday of June next to come, and discharge the said sentence of death to be put in execution against her till the said day. And appoints and ordain the said sentence of death pronounced against the said Elizabeth Hunter by the lords of justiciary, to be put to punctual execution against her the said third Tuesday of June next to come. And give order and warrant to the magistrates of Edinburgh to cause the said sentence of death be put to punctual execution against the said Elizabeth Hunter at the same place and in the same manner mentioned and contained in the said sentence. Act and Commutation of William Bizzets Sentence

Anent the petition given in and presented to the Lords of privie Councell By William Bizzet prisoner in the Tollbooth of Edinburgh Shewing that he being tryed befor the Commissioners of Justiciary for alleadged poysoneing his wyfe, the cryme of poysoning was not proven only ther was so much proven as it pleased their lordships to Sentence the petitioner to be transported to the plantations, and in the mean tyme did continue him prisoner in the Tollbooth of Edinburgh till ane occasion Should offerr, But therafter he haveing broke prisone and escaped, which he freely confessed to the saids Lords, he was again retaken and brought back to the said Tollbooth of Edinburgh; And Seeing he was willing to goe a recruit to Holland not to returne without leave under the highest certification; and that he humbly conceaved he might be more usefull and serviceable to goe a recruit then to be banished as above, and therfore craveing to the effect underwrytten, The Lords of her Majesties privie Councell haveing considered the petition given in to them by William Bizzet prisoner in the Tollbooth of Edinburgh, and the Samen being read in ther presence; The saids Lords have Commuted and Changed, and heirby Commute and Changes the Sentence of banishment and transportation to the plantations pronounced by the Lords Commissioners of Justiciary Against the Said William Bisset, To transportation to the Neatherlands as a recruit, and have discharged and heirby discharges the Sentence of banishment to the plantations pronounced against the petitioner by the Saids Lords Commissioners of Justiciary to be putt to any farther execution against him on account of the cryme therin mentioned And in place therof have accpoynted and ordained, and heirby appoynts and ordains the said William Bizzet to be transported abroad as a recuit, and discharges him ever to returne to this kingdome without her Majesties or the Councells leave wnder the pain of death, and appoynts the Magistrats of Edinburgh and keepers of ther Tollbooth to delyver the person of the said William Bizzet to Captain […] Mowat In […] redgment to be by him transported abroad as a recruit as said is, wpon his macking himselfe in the books of privie Councell that he Shall never returne to this kingdome without her Majesties or the Councells leave wnder the pain forsaid Sic Subscribitur Sutherland I.P.D. Commission under the great seal in favour of David [Boyle] earl of Glasgow to represent her majesty’s royal person in the ensuing general assembly of the Church of Scotland being presented by Mr Alexander Maitland, clerk, the same was read and ordered to be recorded, and thereafter delivered by [John Gordon] the earl of Sutherland, president for the time, to Sir James Stewart, her majesty’s advocate, in name of the said earl, who received the same on his knee as use is, and whereof the tenor follows:
Anna by the grace of God queen of Great Britain, France, and Ireland, and defender of the faith, to all good men to whom our present letters will have come, greetings. Since from our decree the general assembly of the Church of our ancient kingdom of Scotland is ordained to meet on the fourth day of the month of April next to come, and we however abundantly desirous, moreover judging it to be necessary for the profit of the said Church, that the same general assembly of the Church should be observed on the day duly established, but we are unable to be present at the said Assembly because of matters of great importance calling us elsewhere, and by many testimonies it may be abundantly satisfied to us about the sufficiency and loyalty of our most faithful and loved kinsman and councillor David [Boyle] earl of Glasgow that he may be learned and suitable entirely for exercising and performing rightly the duties of the highest office within specified; know therefore that we have nominated, constituted, and ordained, just as by the tenor of the presents we nominate, constitute and ordain the same David earl of Glasgow our high commissioner, as far as the effect within expressed. Equally, we give and grant to him our fullest power, commission, and warrant of representing our person and our royal authority, of supplying our presence, and of holding our place in the said following general assembly as our commissioner especially constituted in this effect, and of doing all things to the power and duty of commissioner for the general assembly of the Church, so fully and so freely in whatever respect as any other of that highest duty had done, or at any time past was able to do, and we shall be able to do ourselves personally present. All and single to be followed in this our commission which are to be done legitimately by the said David earl of Glasgow, we firmly approve, hold fixed, and will hold to all and single. Moreover, we order strictly and command the pastors and elders of the foresaid assembly and Church and the remaining subjects whatsoever of this our kingdom, of whatever quality and condition, that they should recognise the said David earl of Glasgow as our high commissioner so far as the effect and way abovementioned, revere, and provide themselves listening to his words. And finally, this our commission we declare to continue in strength from the day on which the great seal of this kingdom is appended to the presents, and then for this following session of the said general assembly, and until when it will be revoked and discharged by us.
