The Lords of his Majesties privie Councill Doe heirby nominat and appoint Eduard Marjoribanks of Halyeards to be a Commissioner of Supplie and Justice of peace uithin the shire of Edinburgh with Full pouer to the said Eduard to meet uith the rest of the Justices of peace in the said shire And Act and doe alse fullie and freely in the saids offices of a Commissioner of Supplie and Justice of peace as any other Commissioner of Supply or Justice of peace uithin this Kingdome hes done hertofore or may doe at any tyme Coming In respect he hath qualified himself by taking the oath of alleadgance and signing the assurance appointed to his Majestie by the acts of parliament.

Decreet

Interlocutor upon the report Anent Militia

The Committie being mett In pursuance of the reference of Councill made to them upon the Eleventh of March last For Considering how the Militia may be exercised and trained now in the approaching Summer Seasone They thought fitt to revise the proposalls of Councill made to his Majestie anent the Militia on the Fifteenth of Aprile Jaj vic nyntie six and approven by his Majesties Letter of the fourt of May therafter And for the making of the said militia more effectuall They humblie offer ther follouing Remarks upon the saids proposalls Viz upon the first article that the Lochaber axes ordered for every regiment be presently provyded Extending in haill to Fifteen hundred in Number Conform to the remitt by the Councill to the Thesaury theranent On the second article that the dayes of the Rendivouzes be changed thus The single Companies to muster and stay togither tuo dayes the first week of June in stead of the Last week of May and Four dayes the fourth week of June in stead of the third week therof. The regiments mustering as before And that this order Continow till recalled On the fourth article that the list of the Colonells Leivtennant Colonells and majors already named be revised and Considered On the fifth article that the Commissioners of Supplie send in Lists of all persons fitt and qualified and of the best Interest to be Captains And that the Names of all the Captains Leivtennants and Ensignes aither named or to be named by the Commissioners of Militia be reported to the Councill for their approbatione against the first teusday of May nixt And that a Captain have allouance of six shillings sterling each muster day when present to be payed out of the supplie as the allouance given to Majors and Leivtennants On the Sixth article That Captains be alloued Intrusted uith the Keeping of the armes of the respective Companies They Giving ther recepts and being ansuerable for them Item that ther be a Gunsmith uithin the bounds appointed to every regiment to be named by the Major who is to receave the Captains recept for the armes And that the said Gunsmiths have tuenty four pounds Scotts per annum to be payed out of the Supplie as above On the seventh article that the dayes of Commissioners of Shires their Meeting be Changed as the dayes of Rendivouzes are above changed On the Eight article That it be Left out And that all the officers already named aither by the Councill or Commissioners be revised Item that the Militia be Continoued Conform to the Last printed proclamation dated the tenth day of december Jaj vic nyntie six uith such changes as here remarked And that it be also extended to the other shires as the Councill shall think fitt Item that particular Lords of privie Councill be appointed to revew these regiments which are not Commanded by privie Councelors Item that the surplus of armes now in the magazines after the furnishing of the standing forces be Given out at the sight of such as the Lords of privie Counsell shall appoint to be Majors of every regiment who are to Give their recepts to the Lords of the Thesaury for the same And that the saids majors give them out againe to their respective Captains upon their recept and obleidgement to be Comptable as said is And that the Charges for transporting of the saids armes be payed out of the Supplie as above as the said report Bears The saids Lords of his Majesties privie Councill Having Considered the said report of the Committie Anent the Militia They doe heirby Recommend to Sir James Steuart his Majesties Advocat to prepare the draught of a Letter from their Lordshipps to the King Craving his Majesties approbatione of the points in the report which are to Come out of the supplie viz payment of a Gunsmith for every regiment payment of the Captains and of the expensses of Carrying and transporting armes And Recommends to the said Lord Advocat or Gives order and warrand to his Majesties sollicitor to prepare a draught of a Letter to the Commissioners of Supply in the severall shires Requiring them to send in to the Councill the names of all persons fitt to be Captains Leivtennents and Ensigns in the Militia betuixt and the first teusday of may nixt in the termes of the report And appointes the Clerks of privy Councill to prepare a proclamation for Calling out the Militia to minister in the termes of the said report And to present the Letters and proclamation to the Councill att their nixt meeting.

Certification His Majesties Advocat against The Laird of Strictmartine and others

William By the Grace of God King of Great Brittaine France and Ireland defender of the faith To […] Macers of our privie Councill messengers at armes our shireffs in that part Conjunctly and Severally specially Constitut Greeting Forasmuchas Anent the Lybell or Letters of Complaint purchased and raised before the Lords of our privie Councill att the Instance of Sir James Stuart our Advocat for our Interest in the matter underwryten As also at the instance of Mr William Mitchell minister of Dundie moderator of the presbytrie therof In name of the presbytrie Making Mentione That wher by the Laues of this and all other well Governed realms Especialle by the act James the sixth parliament Eleventh chapter tuenty seventh against troublers of the Kirk all raising of tumults rablings and ryotts By unwarrantable Convocations and violence especialle In oppositione to Laufull orders aither of the Civill or ecclesiastick government and upon the Lords day and in or about kirks or kirk yeards to the desturbance of the people assembled for publick worship are Crimes of a high nature and severly punishable Nevertheless It is of veritie that Mr Patrick Midletoun Intruder upon the kirk and paroch of Fermy Having been formerly minister at Lesly From which he uas outted and depryved by sentence of his Majesties privy Councill For not praying for his Majestie King William Hath of late not only Intruded and presumed to preach and exercise the function of the Ministrie at the said Kirk and paroch of Strictmartines But hath with the Assistance of one […] Wintoun of Strictmartine and severall other disaffected persons afternamed Hath upon one or other of the dayes of the months of the years Jaj vic nyntie six and of this present year Jaj vic nyntie seven taken possession by disorder and violence of the said kirk of Strictmartine and by armed Men such as […] Gullam his gairdner Peter Tham James Tham and James Smith and others of his tennents guarded the said kirk by force In opposition to the Minister sent by the presbytrie to preach ther as at a vacant Kirk And particularly upon the Lords day the fourteenth day of March last when Mr Alexander Lauder minister at Mordingtoun sent by the Generall Assembly to supplie the vacancies of Angus and Mearns uent by order of the said presbytrie of Dundie to preach at the said kirk of Strictmartines now of a Long tyme vacant by the death of the former Incumbent wher the said Mr Patrick Midletoun mett him at the Kirk door and asked him for his warrand to whom Mr Alexander Ansuered that he had a subscryved Commission from the presbyterie which he was ready to show to any of the paroch But thought Mr Midletoune who was only ane Intruder not Concerned in the paroch wherupon the said Mr Midletoun Cryed to all the people to follow him to the Laird of Strictmartins house to hear sermone And forbid them to hear the said presbyterian minister who uas ane unknouen shepherd And the said Mr Alexander Having preached in the fornoon without any disturbance about the midst of his afternoon sermone ther Came a Great rable of people from Strictmartins house wher Mr Midletoun had presumed to preach as said is And who noe doubt had been animat and Instigat by him and assaulted the Kirk Throuing in great stones att the window and beatting at the church doors and Ringing the bell And when they Could not enter the door some of them came in at the window and opened the door to the rest of the rable who Came in with great fury Cursing and suearing and stricking uith great staffes all that were in their way And offering the same violence to the Minister if not Guarded by a few about him And particularly John Greive wright in Baldivance Struck uith a Squyre rule one James Smith Servant to William Watt in that paroch and gave him a dangerous uound in the head As also he beat one James Williamson brazier uith severall bloues on the hand wherby he is Lyke to be Mutilat of one of his fingers And the said James Gullam gairdner uith the said John Greive did Lykewise beat the saids persons speciallie the said James Williamsone and one Thomas Fleeming merchant in Dundie Threatning many terrrible threatts and curses Item Laurence Andersone in the said paroch was ring Leader to the said rable and did throw stones at the minister through the windoues and Struck with a battonn Alexander Wyllie Servant to the said William Watt and severall others Item John Andersone servant to Margaret Tham In Balreggan was the first came in violently at the window of the Kirk the tyme of Sermone and opened the door to the rest and threw Great stones at the people Item Walter Couper at the Bridgend of Strictmartines Came in also at the window and Struck Severall persons uith a battoun As also James Hill in Balmadoun and James Thomson ther and James Greive in Baldivance Andrew Law in the Kirktoun of Strictmartin James and George Thames sons to Patrick Tham ther James Andersone ther David Salmond and George Law in Baldreggan all and each of them did Invade the Kirk as said is By throuing of stones in att the window Cursing the poeple and beatting them with battouns or doing one or other of the saids deeds which uithout any order By all which It is Evident that the haill forsaids persons viz the said […] Wintoun of Strictmartine […] Gullam Peter and James Thames James Smith John Grieve James Smith Laurence Andersone John Anderson Walter Couper James Hill James Thomsone James Greive Andrew Law James and George Thames James Anderson David Salmond and George Law all rablers are guiltie airt and pairt of the premisses which being verified against them They ought to be punished by the paines of Law as the saids Lords of our privie Councill should see Cause To the example and terror of others to Committ Anent the Lybell or Letters of Complaint purchased and raised before the Lords of his Majesties privie Councill att the instance of Sir James Steuart his Majesties Advocat for his highnes Intrest in the matter underwryten as also att the instance of Mr William Mitchell Minister at Dundie Moderator of the presbytrie of Dundie In name of the said presbytrie and of John Blair agent for the Kirk Mentioning That wher by the Laues and acts of parliament not only is presbyterian Church Government Settled and established as the only Government of Chrysts Church in this Kingdome But also all Ministers not deuly qualified by taking the oath of alleadgance and subscryving the same with the Assurance presuming to preach or exercise any part of the Ministeriall function are discharged and punishable by deprivatione banishment or otherwayes as their Caise should Deserve and the Lords of his Majesties privy Councill shall think fitt Lykeas by the sixteenth act of the Conventione of the estates of Jaj vic Eighte nyne years The whole Leidges are discharged to oune or acknouledge the Late King James and all Ministers of the Gospell uithin this Kingdome are ordained to pray publickly for his Majestie King William as King of this realme under the paine of deprivation And by the tuenty second Act parliament Jaj vic nyntie five It is statut That whoever therafter Should Intrude themselves into any church or possess manse or benefice or exercise any part of the Ministeriall function without ane orderly Call from the heretors and Eldership and Legall admission from the presbytry of the bounds shall be Incapable of Enjoying any church stipend or benefice for the space of seven years after their being removed And the execution of the said Act is remitted to the Judges ordinary to remove and declare all the forsaids Intruders ut supra And furder It is recommended to the Lords of his Majesties privie Councill to remove all such who had formerly Intruded since the orders aither of the Civill or ecclesiastick Government and upon the Lords day And In and about Kirks or Kirke yeard dykes to the disturbance of the people assembled for publick worship are Crymes of severall others disaffected persones afternamed Hath upon one or other of the dayes of the mouths of the years Jaj vic nyntie six and of this present year Jaj vic nyntie seven taken possession by disorder and violence of the said kirke of Strictmartine And by armed men such as […] Gullam his gairdner Peter Tham James Tham and James Smith and others of his tennents guarded the said Kirke by force In opposition to the Ministers sent by the presbytrie to preach ther as at a vacant Kirke And particularly upon the Lords day the Fourteenth of March last when Mr Alexandar Lauder Minister at Mordingtoune sent by the Generall Assemblie to supplie the vacancies of Angus and Mearns went by order of the said presbytrie of Dundie to preach at the said kirke of Strictmartins now of a Long tyme vacant by the death of the former Incumbent wher the said Mr Patrick Midletoun mett him at the kirke door and asked him for his warrand to whom Mr Alexander Ansuered that he had a subscribed Commission from the presbytrie which he was ready to show to any of the paroch but thought Mr Midletoun who uas only ane Intruder not Concerned in the paroch wherupon the said Mr Midletoun Cryed to all the people to follow him to the Laird of Strictmartins house to hear Sermon And forbid them to hear the said presbyterian Minister who was ane unknouen Shepherd And the said Mr Alexander Having preached in the fornoon uithout any disturbance about the midst of his adternoon sermone Ther Came a Great rable of people from Strictmartins house wher Mr Midletoun had presumed to preach as said is And who no doubt had been animat and Instigat by him And assaulted the kirke throuing in Great stones at the windoues and beatting att the Church doors and Ringing the bell And when they Could not Enter the door some of them Came in at a window and opened the door to the rest of the rable who Came in uith Great furie Cursing and Stricking uith Great staffes all that were in their way And offering the same violence to the Minister if not guairded by a few about him And particularly John Greive wright in Paldivane struck uith a squyre rule one James Smith servant to William Watt in that Strauchan Mr Alexander Wilson Mr John Grub and Mr John Davie untill the […] day of […] And Grants Certification against the saids Thomas Wintoun of Strictmartin and the haill other persons rablers at Strictmartine mentioned in the Lybell except the said John Andersone In respect of their absence and not Compearance And ordaines Letters of denunciation to be direct to Macers or messengers at armes ordaining them to pass to the mercat Cross of […] and other places needfull And ther in his Majesties name and authority duely laufully and orderly denunce the said Thomas Wintoun of Strictmartin and haill other persons rablers mentioned in the Lybell his Majesties rebells And putt them to his highnes horne And ordaine all their Movable goods and Gear to be escheat and Inbrought for his Majesties use for their Contempt and disobedience And the saids Lords alloues the said John Anderson Compearing as said is to returne home In respect he hath Inacted himself in the books of his Majesties privie Councill That he shall Live peacably and orderly In all tyme coming under the Government both of Kirke and state of this Kingdome And that he shall Give no disturbance or disquiet to the same nor have The Lords of his Majesties privie Councill Doe heirby Recommend to the Earle of Leven Governour and Constable of the Castle of Edinburgh and in his absence Gives order and warrand to the nixt Commanding officer ther to receave into the said Castle tuo hundred of the recruits brought togither besydes Eightie already therin by Collonell George Hamiltone For recruiting of his Majesties forces in Flanders and detaine them therin untill they be gott shipped for Flanders And Recommends to the Viscount of Teviot Commander in cheiff of his Majesties forces uithin this Kingdome to send such a detachment of the standing forces for the better securitie of that garrisone as the said Earle of Leven or nixt Commanding officer in his absence shall Call for.
