Warrand Continouing the delyvery of the Levy for Lanerkshire

The Lords of his Majesties privie Councell Being acquanted by the Lord Carmichaell that the halfe of the shire of Lanerk their proportion of the present Levy of one Thousand men is already delyvered And that it will requyre some dayes before the other halfe can be made ready The saids Lords Continoues the delyvering of the men not delyvered by that shire as their proportione of the forsaid Levy untill the sixteenth day of Apryle Instant And appoints the said men to be delyvered to the officers appointed or who shall be appointed to receave them upon the said day

Warrand for Delyvering Mcnaughtan and Mcgrigor to Captain Campbell

The Lord Advocat having acquanted the Councell that Finlay Mcnaughton and John Mcgrigor prisoners in the tolbooth of Glasgow were by a former order of Councell appointed to be delyvered to some officers as souldiers And that these officers have never called for them so that the toune is at expences in mantaining them And that they are Content to goe abroad as souldiers uith Captain Coline Campbell in the Lord Lorns regiment The Lords of his Majesties privie Councell Doe heirby Give order and warrand to the magistrats of Glasgow and Keeper of their tolbooth to sett the saids Finlay Mcnaughton and John Mcgrigor to Libertie furth of their tolbooth And appointes them upon payment of their necessar expences to delyver them to the said Collin Campbell to be Carryed abroad by him as souldiers in the forsaid regiment And alloues his Majesties Advocat to signifie this to the magistrats of Glasgow in a Lyne And ordaines the officer who receavs the saids tuo persons to pay the expences of their house dues and others Contracted and resting by them since their Imprisonment

Warrand To The Lord Murray to grant Commission Anent Jean Colzier

The Lords of his Majesties privie Councell Being Informed by Sir James Steuart his Majesties advocat that Jean Colzier Late Servant Easterynd hath brought furth a Chyld and that the body of the Chyld Cannot be found They heirby Recommend to the Lord Murray principall secretary of state and principall shirreff of the shire of Perth To nominat and appoint tuo or three fitt persons of good understanding and Judgement And to Grant Commission to them to be shirreffs deputs ad hunc effectum specialem to take tryall anent the said Jean Colzier her being guiltie of the Crymes forsaids And to Give sentence against her ad pernam ordinariam vell extraordinariam noe wayes including the punishment of death in their said sentence and to see their said sentence putt to execution

Act for open prisone to Alexander Taite

Anent the petitione given in to the Lords of his Majesties privie Councell By Alexander Taite Skipper in Leith Sheuing That wher the petitioner was Imprisoned uithin the Tolbooth of Edinburgh upon the first day of March Last And hes been detained ever since closs prisoner which hes much Impaired his health and hath tended much to the prejudice of his oune privat affairs And seing he never gave any disturbance to the present government But did alwayes and is still resolved to Live peacably under the same And therfore Humblie Craving their Lordships wowld be graceously pleased to take the petitioners caise and Circumstances to their serious Consideratione and to ordaine him to be sett at Libertie upon his finding Cautione as formerly to Compear when called and in the meantyme to Live peacably under the present government as the said petition bears The saids Lords of his Majesties privie Councell Having Considered the above petitione They doe heirby give order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth To allow the petitioner the benefite of open prisone The saids magistrats and Keeper being alwayes ansuerable for his safe Custody

Anent the petitione given in to the Lords of his Majesties privie Councell By Captain Alexander Bruce Sheuing That wheras the petitioner Having been detained in Long and closs Imprisonment for the space of four weeks which is a very hard tryall to one who hath no fortune in the wordle wherupon to Live But even when at Liberty Did subsist by the bounty and kyndnes of his freinds and relations wherof he is now depryved And he appealls to the whole wordle that thir severall years bypast He hath Lived quietly and peacably in the shire of Fife amongst his freinds uithout medling uith or giving any disturbance or offence to the government And Having only Come to Edinburgh about five weeks agoe about a particular affair uith designe Immediatly to returne if the samen had not been obstructed by Imprisonment And Having Likewise Contracted sicknes which may prove mortall by Long Continowance in prisone which if need beis can be attested And therfore Humblie Craving their Lordships uould seriously Consider the petitioners singular Circumstances with pity and Commiseratione And aither to ordaine present Liberatione out of prisone or else to allow the petitioner ane aliment during the Imprisonment since by being keeped up so closs He is depryved of all means of subsistance as the said petition bears The saids Lords of his Majesties privie Councell Having Considered this petitione given in to them by the said Captain Alexander Bruce They doe Heirby Give order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth To allow the petitioner the benefite of open prisone The saids Magistrats and Keeper Being alwayes answerable for his safe Custody

Anent the petition given in to the Lords of his Majesties privie Councell By John Chancellor merchant in Edinburgh Sheuing That wher the petitioner was seized by order of the Lord provost of Edinburgh and Committed prisoner to the tolbooth therof without any cause whatsoever Knouen to the petitioner And as he is Informed uithout any particular ground signified to their Lordships And seing ther can noe particular Crime or misdemanner be alleadged against the petitioner for which he should be distinguished from others his Majesties good subjects He never having been Concerned about the publict or publict matters But Did and does Judge it his duty uith dilligence to follow his privat affairs and bussiness for the necessar support of his family And therfore Humblie Craving their Lordships to ordaine the petitioner to be sett at Libertie to follow his privat bussiness which suffers exceedingly by his being detained in prisone as the said petitione bears The saids Lords of his Majesties privie Councell Having Considered the above petitione They heirby Give order and warrand to the magistrats of Edinburgh and Keeper of their tolbooth to sett the petitioner at Libertie furth therof In respect He hath given bond and found sufficient Caution acted in the books of privie Councell That he shall Live peacably under and uith all submission to the present government of his Majestie King William And that he shall not Act Consult nor Contryve any thing in prejudice therof nor Converse or Correspond uith any rebells And that he shall appear before the saids Lords of privie Councell when called for or requyred to that effect under the penaltie of ane Hundred pounds sterling In caise he shall transgress in any pairt of the premisses

Act appointing Commissioners for the present Levy in Linlithgowshire

Forasmuchas In the proclamation emitted for the outbringing and delyverie of a thousand men for the Levy of this present year Ther are noe persons appointed or authorized for the shirrefdome of Linlithgow to Judge and determine upon all differences and debates that may arrise betuixt the Commissioners of supplie for that shire and burghs uithin the same and the officers which shall be sent to them anent the sufficiency or Insufficiency of the men to be outreiked for this present Levy in the forsaid shire Therfore the Lords of his Majesties privie Councell Doe heirby authorize and Impoure the persons afternamed viz Patrick Murray of Livingstoune […] Dundas of Dudingstoune and […] Steuart of Pardovan with power to the saids persons to doe and performe everything anent the premisses as any of the other persons mentioned in the said proclamatione for the respective shires therin specified may or might have done be vertue therof And appointes the saids persons to see the said shire its proportione of the said Levy Delyvered And the Commissioners to delyver the same Conforme to the forsaid proclamation unto the officers therin named upon the Eight day of Apryle instant And ordaines the particular persons Lyable in the outreik of the said Levy to have the persons they are to outreik ready and delyver the same at Linlithgow the forsaid day att ten in the fornoon

Sir Thomas Livingstoune Commander in cheiff of his Majesties forces uithin this Kingdome Having reported to the Lords of his Majesties privie Councell That he hes spoke uith Collonell Buchan for the Flanders officers and uith the officers of the regiments staying in this Kingdome upon the Differences betuixt these officers anent the expences bestoued upon the recruits who were driven back and are since redelyvered to the scotts regiments And that both parties pretended It was hard for them not to be reimbursed of what expences they have been putt to And the same being spoke to was Lett fall
