The Lords of her Majesties privie Councell Doe heirby Recommend to the Earle of Levine, Governour and Constable of the Castell of Edinburgh, and to the deputy Governour ther, And in ther absence Gives order and warrand to the nixt Commanding officer to cause fyre the great Guns of the said Castell upon the Sixth day of February nixt to come, being the birth day of her Majestie Queen Anne, att the ordinary tyme, and conforme to the accustomed maner heirtofore observed in the lyke cases.

Warrand to the Magistrats of Edinburgh for observeing the Queens birth day

The Lords of her Majesties privie Councell Considering that Wednsday nixt being the Sixth day of February nixt to come Is the Birth day of her Majestie Queen Anne, And that it is customary the Samen be observed with all demonstration of publict Joy, Doe heirby Appoynt and ordaine the Magistrats of Edinburgh to cause Ring the Musick Bells from Ten of the Cloak in the morning till four of the Cloak in the afternoon, att which tyme the great Bells are to begine, And appoynts the publict Solemnitie att the Cross of Edinburgh to be and begine att twelve acloak the said day, And appoynts the Magistrats of Edinburgh to cause intimation be made after the usuall maner to all the neighbours and Inhabitants within the said burgh that they putt furth illuminationes the said day att the ordinary tyme, and in maner heirto fore observed, And to conclude the evening with illuminations, Ringing of Bells and other demonstrations of publict Joy, Conforme to ordinary custome in the lyke cases; And appoynts and ordains the Magistrats of Edinburgh to take Speciall care that ther be no throwing of Squibs, breaking of Glass, windows or other abuses committed the said day, either the tyme of the Solemnitie or after the Samen, But that they enjoyne to the respective deacons of Crafts within ther burgh the punctuall observance heirof, as they will be answerable on ther highest perrill.

Warrant to the magistrates of Edinburgh for observing the queen’s birthday

The lords of her majesty’s privy council considering that Wednesday next, being 6 February next to come, is the birthday of her majesty Queen Anne, and that it is customary the same be observed with all demonstration of public joy, do hereby appoint and ordain the magistrates of Edinburgh to cause ring the music bells from 10 o’clock in the morning till 4 o’clock in the afternoon, at which time the great bells are to begin, and appoint the public solemnity at the cross of Edinburgh to be and begin at 12 o’clock the said day. And appoint the magistrates of Edinburgh to cause intimation be made after the usual manner to all the neighbours and inhabitants within the said burgh that they put furth illuminations the said day at the ordinary time, and in manner heretofore observed, And to conclude the evening with illuminations, ringing of bells, and other demonstrations of public joy, conform to ordinary custom in the like cases. And appoint and ordain the magistrates of Edinburgh to take special care that there be no throwing of squibs, breaking of glass, windows, or other abuses committed the said day, either [at] the time of the solemnity or after the same, but that they enjoin to the respective deacons of crafts within their burgh the punctual observance hereof, as they will be answerable on their highest peril.

Formula Taken and Signed by Patrick Butter of Gormack

The Lords of her Majesties privie Councell haveing considered the within Formula taken by Patrick Butter of Gormack purgeing himselfe of popery In presence of the Earle of Glasgow and Mr Francis Montgomrie two of ther lordships number, and the samen with the attestation on the end therof being read in ther presence, The Saids Lords doe heirby appoynt the Samen to be recorded. wherof the tenor follows.
I Patrick Butter of Gormack doe Sincearly from my heart profess and declaire befor God, who Searcheth the heart, that I doe deny, disowne and abhore these tenets and doctrines of the papall Romish Church viz The Supremacie of the pope and Bishop of Rome over all pastures of the Catholick Church, His power and authoritie over Kings and Princes and States, and the Infallability he pretends to, either without or with a generall Councell, his power of dispensing and pardoning, The doctrine of Transsubstantiation and the Corporall presence with the Communion without the Cup in the Sacrament of the Lords Supper, The adoration and Sacrifice professed and practised by the popish Church in the Mass, The Inovcation of Angells and Saints, The worship of Imagines Crosses and Relicts, The doctrine of Supererogation, Indulgences and purgatorie And the service and worshipe in ane wnknowen tongue; all which tenets and doctrines of the said Church I believe to be contrary to and inconsistant with the wrytten word of God, And I doe from my heart deny, disowne and disclame the saids doctrines and Tenets of the Church of Rome as in the presence of God without any equivocation or mentall reservation, But according to the knowen and plain meaning of the words as to me offerred and proposed, So help me God Sic Subscribitur Patrick Butter.
Att Edinburgh the Twentie Sixth of January Jaj vijc and Six years, The Which day Patrick Butter of Gormack haveing Compeared2 In presence of the Earle of Glasgow Lord Theasaurer Deput, and Mr Francis Montgomrie two of the Lords of her Majesties Privie Councell, did take and Signe the formula as above, appoynted by act of parliament purgeing himselfe of popery as is attested by Sic Subscribitur Glasgow Fr Montgomrie.

Whereof the tenor follows:

Passport to Julian Godet and other 7 French prisoners

Anent the petition given in and presented to the Lords of her Majesties privie Counsell by Julian Godet, and Pieter Beahomme for themselves and other Six French prisoners Shewing that wheras the saids Lords wer pleased Sometyme agoe to allow our Captain Mr Michell Godet Master of the French pryze taken by Captain Campbell to goe into France, for releiving of severall Scots men then prisoners at Dinant, and Seeing the Said Captain Godet hes according to promise and word of honour to the saids Lords, releived the saids Scotsmen, As appears by a Certificate heirwith produced, Therfore craveing it might please the saids Lords to order the petitioners releasment who wer left as hostages, with some small allowance for ther geting home to ther own Countrey As the said petition bears, The Lords of her Majesties most honourablle2 privie Councell of the Kingdome of Scotland haveing considered the within petition given in to them by Julian Godet, and Pieter Bonhomme for themselves and other Six French prisoners keept in Scotland as hostages for the persons aftermentioned, And the samen with a certificat wnder the Signe and Subscription of John Baptista Lemperewr One of the French Kings Councellors, Commissioner of the Marine affairs and Governour in the Jurisdiction of St Mallo Bearing that John Adams, Patrick Moodie, John Kerr, John Mckenzie, James Sherar, William Ritchie, Robert Cowan, Archbald Millar, William Rodgers and Matthew Scott all Scotsmen, wer sent back out of the prisons of Dinant and released, Being all read in ther presence, And the saids Lords of her Majesties Privie Councell haveing considered the Same, They heirby appoynt and Ordaine the Magistrats of Cannongat and Leith to Sett the petitioners at libertie furth of ther Tollbooths without payment of any house dewes, And doe heirby permitt and allow the petitioners to returne to the kingdome of France without trouble or molestation, And discharges all persons whatsomever to trouble or molest them in ther voyage thither, And the saids Lords have Recommended and heirby Recommends the petitioners to all Judges, Magistrats and Ministers of the law within this kingdom Governours of Castells and forts, and Garisons, Captains, Commanders and Masters of Ships, Barks and Boats wher the petitioners may have occasion to be, To give them and3 each4 of them all due assistance In ther said transport to the kingdome of France, And to use them civilly and discreetly, And not to hinder or obstruct them in ther voyage thither, And appoynts and ordains the Cashet of Privie Councell of Scotland to be appended, and ther Clerks to give out extracts heirof accordingly.

Passport to Julian Godet and other seven French prisoners

Concerning the petition given in and presented to the lords of her majesty’s privy council by Julian Godet and Pieter Beahomme for themselves and other six French prisoners, showing that whereas the said lords were pleased some time ago to allow our Captain Mr Michell Godet, master of the French prise taken by Captain [Matthew] Campbell to go into France for relieving of several Scotsmen then prisoners at Dinan, and seeing the said Captain Godet has according to promise and word of honour to the said lords relieved the said Scotsmen, as appears by a certificate herewith produced, therefore craving it might please the said lords to order the petitioners release who were left as hostages, with some small allowance for their getting home to their own country, as the said petition bears. The lords of her majesty’s most honourable privy council of the kingdom of Scotland having considered the within petition given in to them by Julian Godet and Pieter Bonhomme for themselves and other six French prisoners kept in Scotland as hostages for the persons after mentioned, and the same with a certificate under the sign and subscription of John Baptista Lemperewr, one of the French king’s councillors, commissioner of the marine affairs and governor in the jurisdiction of Saint-Malo, bearing that John Adams, Patrick Moodie, John Kerr, John Mackenzie, James Sherar, William Ritchie, Robert Cowan, Archibald Millar, William Rodgers, and Matthew Scott, all Scotsmen, were sent back out of the prisons of Dinan and released, being all read in their presence, and the said lords of her majesty’s privy council having considered the same, they hereby appoint and ordain the magistrates of Canongate and Leith to set the petitioners at liberty forth of their tolbooths without payment of any house dues, and do hereby permit and allow the petitioners to return to the kingdom of France without trouble or molestation, and discharge all persons whatsoever to trouble or molest them in their voyage thither. And the said lords have recommended and hereby recommend the petitioners to all judges, magistrates, and ministers of the law within this kingdom, governors of castles and forts, and garrisons, captains, commanders and masters of ships, barques and boats where the petitioners may have occasion to be, to give them and each of them all due assistance in their said transport to the kingdom of France, and to use them civilly and discreetly, and not to hinder or obstruct them in their voyage thither, And appoint and ordain the seal of [the] privy council of Scotland to be appended, and their clerks to give out extracts hereof accordingly.

The Lords of her Majesties privie Councell Doe heirby nominat and appoynt Sir David Cuningham of Millcraig Advocat to be ane Commissioner of Supplie within the Shyre of Linlithgow In the place of Patrick Murray of Livingstoun deceast, with power to him to meet with the rest of the Commissioners of Supplie of the Said Shyre, and exerce the said office as fully and freely in all respects, as any other Commissioner of Supplie may doe, And appoynts the said Sir David Cuningham befor he exerce the said office to qualifie himselfe to her Majestie by Swearing the oath of alleadgance, and Subscribing the Same with the assureance Conforme to the act of parliament.

The lords of her majesty’s privy council do hereby nominate and appoint Sir David Cunningham of Milcraig, advocate, to be a commissioner of supply within the shire of Linlithgow in the place of Patrick Murray of Livingston, deceased, with power to him to meet with the rest of the commissioners of supply of the said shire, and exercise the said office as fully and freely in all respects, as any other commissioner of supply may do. And appoint the said Sir David Cunningham before he exercise the said office to qualify himself to her majesty by swearing the oath of allegiance, and subscribing the same with the assurance, conform to the act of parliament.
