Act Changing Alexander Govans Sentence from Death To Banishment
The Lords of his Majesties privy Councill By their act of the date the […] day of […] having given order and warrant, To the Bailzie of the Regality of Glasgow, To cause put the Sentence of death against Alexander Govan Smith in Glasgow who in the year Jaj vic Eightie Eight was convict of Thift by ane assize and by ane Act of the then Councill, The Said Bailie was ordered to mitigat the punishment of death To Banishment, And The Councill Considering That the said Alexander hes been accordingly Banished and now Returned to this Kingdom, And That they appointed the forsaid Sentence To be put to Execution, To the Effect The said Alexander might Confess any Crimes he hes Committed since his Banishment, And Seing the Said Bailie hes Informed The Councill or Sir James Stewart His Majesties Advocat, who Represented the same to them That the said Alexander denyes any Crymes since his Banishment and That the Said Baillie can gett no Information against him, The Saids Lords of privy Councill Doe heirby Commute and Change The Sentence of death pronunced against the said Alexander to Banishment And discharges the said Sentence of death to be putt To Execution against him att any time hereafter, And have Banished and heirby Banishes the said Alexander Govan Furth of this Kingdom of Scotland, And Appointes him To depairt furth thereof, Betwixt and The Tenth day of March next to Come, And discharges him to Return therto att any tyme thereafter without His Majesties or the Councils order for that Effect, under the pain of death, And gives order and warrant To […] within those Tolbooth he now lyes, To sett him att Liberty Furth thereof he always Enacting himself in the said Baillie his Regality Books That he shall depairt Furth of this Kingdom, Betwixt and the day forsaid And never Return within the same without his Majesty or the Councills warrant for that Effect under the pain of death, For which this Shall be to all Concerned a Sufficient warrand.
