Procedure
Recommendation To the Lord Advocate To Examine persones Anent Breaking The Tolbooth of Mayboll
The Earle of Cassills having acquainted His Grace, His majesties high Commissioner and Lords of his Majesties privy Councill That there is one named […] Kennedy who being Imprisoned in the Tolbooth of Mayboll and Indyted for the Cryme of murder, His Lordship is Informed That upon Sabbath last Severall persones some on horse back, and some on Foot, Came To the Tolbooth of Mayboll armed and Fyred pistolls against such as were at windows or offered to oppose them, And by Force and violence Entered the Tolbooth, and carried away the Prisoners. His Majesties high Commissioner and Lords of privy Councill, Having heard and Considered what was Spoke by the said Earle of Cassills, They doe heirby Recommend to his Majesties Advocat, To Examine and take the Depositiones of such persones whose names shall be delivered to him by the said Earle of Cassills Baillie of the Bailiary of Carrick or his Lordships Deput in the said office within which Bounds the said Tolbooth, where the said Ryot was Committed lyes, anent the above Ryot, With power to his Majesties Advocat To Imprison, such persones as he shall see Just Cause to Committ.
