Anent the petitione Given In to the Lords of their Majesties privie Councell Be Hector Bannatyne of Kaimes Sheuing That wher ther being a most Groundles Complaint raised at the Instance of Thomas Craufurd of Carseburne Against the petitioner for ane alleadged ryott pretending that the petitioner Hounded out severall persones to deforce the messenger that Carseburne had Imployed the petitioners goods which is in itself false and most Caluminous and as to the Complaint as Groundles so that it was most malicious in Carseburne who is a Neighbour to take assignations to any debt due be the petitioner off purpose to distress him And seing the petitioner hes attended all this while upon the Calling of the said process But their Lordships being taken up about other affairs The same was delayed all this tyme Althogh the petitioner applyed to their Lordships for discussing therof as the dark can attest And seing the protectione Is expyred formerly Granted be their Lordships to the petitioner and that He Cannot safely attend their Lordships or the dyetts of the said process By reasone of the severall personall dilligence Against him for Civill debts uithout their Lordships be pleased to Renue his protectione And therfore Humbly Craving their Lordships uould be pleased to Consider the petitioners case and Circumstances and Renue his protectione for such tyme as their Lordships shall think Fitt The said Lords of their Majesties privie Councell Having Considered this petitione given In to them be the said Hector Bannatyne of Kaimes They Heirby Grant personall protectione to the petitioner untill the seventh day of november nixt to Come That He may attend the discussing of the said process And discharges all Judges Magistrats messengers at arms or officers uithin burgh or Landuard To putt any Letters of Captione Acts of warding or other personall dilligence to executione against the petitioner untill the forsaid day Excepting alwayes their Majesties rents and publict dues sic subscribitur Tueeddale canel: Drumlangrig Southerland Linlithgow Tarbat Beilhaven Polwarth James Steuart T Livingstoune

proclamatione Against transporting Cornes to France

The Following proclamatione Being redd uas voted approven and signed and ordored to be recorded wherof the tenor folloues
William and Mary By the Grace of God King and Queen of Great Brittaine France and Ireland defenders of the faith To Macers of our privie or messengers at armes our shirreffs in that part Conjunctlly and severally specially Constitut Greeting Forasmuchas we are now in warr uith the french King and his subjects And by the Eight Act of the fourth sessione of this our Currant parliament It is statute That none of the subjects of this kingdome presume to Correspond or have Concerne uith any persones residing uithin the kingdome of France or any of the dominiones subject to the French King under the paine of treasone And ue Considering that the transportation of Graine and Corne of any sort to the French Kings dominiones will be of singular and great advantage to our Enemies in their present extream want and scarcity Therfore we uith advyce of the Lords of our privie Councell prohibite and discharge all and every one of our poeple and subjects of this our Antient kingdome and all other persones whatsomever to export or cause be exported directly or Indirectly any Corne or victuall from this our antient kingdome to the kingdome of France or dominiones belonging to the French King under the paines contained in the said Act And for rendering this our2 prohibitione the more effectuall we further Requyre and Command all magistrats of burghs shirreffs of shirreffdomes steuarts of steuartries Lords and Baillies of Regalities and other officiars whatsoever and their deputes to take exact Care uithin their respective Jurisdictiones And Give all dilligence for preventing the export of any Cornes or victuall whither by our oune subjects or Forraigners to the said kingdome of France or any other the dominiones belonging to the French King And that noe shipps Loadned in whole or in part uith victuall be suffered be them to saile furth of any harbour port or other places uithin their respective Bounds untill first the master of the said ship Enact himself before any of the saids Magistrats or officiars respective under a Liquid soume and penaltie equivalent to the value of the ship to be sailed by him and Loadining therof not to be unload or Cause unload the victuall aboard of his said shipp or any part therof directly or Indirectly uithin any place or port of the kingdome of France or dominiones of the French King But that He shall unload the same at some port or place belonging to such as are in Freindship uith us or our Allies And also that he suear and give his oath to be by him subscribed That he shall observe and keep the termes of the said Enacting which Enacting and oath are to be taken befor the saids magistrats and officiars respective forsaid and recorded by their Clarks 3 Gratis uithout any allouance therof And ue uith advyce forsaid In case of the faillzie or refuisall of the said master Requyre and Command the magistrats and officiars respective uithin their particular Jurisdictiones to secure and arreast all vessells Loadned uith victuall by taking from the saids shipps ther sails and Rads And to detaine them ther untill our privie Councell be Acquanted theruith and Have signified their pleasure theranent And further we uith advyce forsaid Requyre and Command all masters of vessells Loadned uith victuall who after Enacting them selves and Giving their oath In manner forsaid shall saile to any forraigne ports or report and bring back sufficient Certificats and ducuments under the hand and seall of the Magistrats of the place or port toune wher the said victuall is Livered And also of the Conservator of the Scots priviledges or English Consull if any be upon the place Bearing the said skipper or master of the ship to have unloaded his whole Cargoe of victuall at the said port which Certificats are to be delyvered in to the saids respective Magistrats wher the said skipper or master Inacted himself and gave his oath before he sailed furth of this kingdome And that uithin fifteen dayes after their returne back to this kingdome from their severall voyages uith Certificatione to each of the saids skippers or masters of the saids shipps In case of failzie of having their ships Certificat to us And be furder lyable in the value of the Loadning exported by them which we heirby Requyre our Sollicitor to doe dilligence for and Cause be payed to the Collector of our Croune rents Our will is Hierfore And ue Charge yow strictly and Command That Incontinent thir our Letters seen ye pass to the mercat cross of Edinburgh and remanent mercat Crosses of the head burghs of the severall shyres and steuartries and also to all seaport tounes uithin this kingdome and ther in our name and authority be open proclamatione make publicatione of the premisses that none may pretend ignorance And ordains these presents to be printed Given under our signet at Edinburgh the tuelvth day of october and of our reigne the fifth year 1693 sic subscribitur ut sederunt

Letter from the Councell To the Queen

A Letter from the Councell to the Queens Majestie In ansuer to her Majesties to them of the Threttieth of september last Anent the hindering Cornes from being transported to France Redd votted approven and signed and ordored to be recorded Folloues the tenor of the Letter
May it please your sacred Majestie In obedience to your royall Command signified by your Majesties Letter of the threttieth of September Wee Have off new sett furth a proclamatione discharging the Carrying of Cornes from this Kingdome to that of France or any of the dominiones belonging to the French King aither directly and openly or Indirectly and by secret Contryvance And Have also strictly Commanded all magistrats and others concerned to take care that the said prohibitione be observed And to take security for that effect of all masters of shipps outuard bound in the surest Mainer Since the Begining of this warr uith France wee have had noe Informatione of Cornes exported from this Kingdome thither But to our Regrate The supply of Cornes that our Enemies have had from us Hath been by their privateers taking our ships all allongst our coasts and almost in our Harboures so that Cornes being a great part of our export Considerable quantaties therof Have fallen in their hands And tho upon a Representatione made by us the last year of this matter we had assurance Given of tuo or three frygotts to be sent from England to Guaird our Firth and north coasts yet on this occasione we must in all Humility Intreat your Majestie That what was then promised and Hath been soe long delayed To the prejudice of your Good subjects and the advantadge of your Enemies may now att Length be performed It May also be worthy of your Majesties Consideratione that Cornes being the great export of this kingdome as we have said And our deuty binding us up during this warr from sending them to some Forraigne pairts To which they were In use before to be2 Exported makes us Heartily wish that the Laues of England prohibiting the Import of Cornes from this kingdome alse much as from any forraigne Kingdome may be Reconsidered and relaxed since It uould not but Contribute to the benefite of England alse uell of Scotland And uould Certainly facilitat the affectiones of the subjects of both kingdomes soe Happily now of a Long tyme united to a more kyndlie and Closs concurrence for their mutuall defence and the better advancing of your Majesties service May it please your Majestie your Majesties most Loyall most Faithfull and most obedient subjects and servant sic subscribitur Tueeddall Cancel: Drumlangrig Southerland Linlithgow Leven Forfar Tarbat Rossh Polluarth James Steuart Adam Cockburne Ludowick Grant

May it please your sacred Majestie In obedience to your royall Command signified by your Majesties Letter of the threttieth of September Wee Have off new sett furth a proclamatione discharging the Carrying of Cornes from this Kingdome to that of France or any of the dominiones belonging to the French King aither directly and openly or Indirectly and by secret Contryvance And Have also strictly Commanded all magistrats and others concerned to take care that the said prohibitione be observed And to take security for that effect of all masters of shipps outuard bound in the surest Mainer Since the Begining of this warr uith France wee have had noe Informatione of Cornes exported from this Kingdome thither But to our Regrate The supply of Cornes that our Enemies have had from us Hath been by their privateers taking our ships all allongst our coasts and almost in our Harboures so that Cornes being a great part of our export Considerable quantaties therof Have fallen in their hands And tho upon a Representatione made by us the last year of this matter we had assurance Given of tuo or three frygotts to be sent from England to Guaird our Firth and north coasts yet on this occasione we must in all Humility Intreat your Majestie That what was then promised and Hath been soe long delayed To the prejudice of your Good subjects and the advantadge of your Enemies may now att Length be performed It May also be worthy of your Majesties Consideratione that Cornes being the great export of this kingdome as we have said And our deuty binding us up during this warr from sending them to some Forraigne pairts To which they were In use before to be2 Exported makes us Heartily wish that the Laues of England prohibiting the Import of Cornes from this kingdome alse much as from any forraigne Kingdome may be Reconsidered and relaxed since It uould not but Contribute to the benefite of England alse uell of Scotland And uould Certainly facilitat the affectiones of the subjects of both kingdomes soe Happily now of a Long tyme united to a more kyndlie and Closs concurrence for their mutuall defence and the better advancing of your Majesties service May it please your Majestie your Majesties most Loyall most Faithfull and most obedient subjects and servant sic subscribitur Tueeddall Cancel: Drumlangrig Southerland Linlithgow Leven Forfar Tarbat Rossh Polluarth James Steuart Adam Cockburne Ludowick Grant
