Act The divinitie Colledge of St Andrews

Anent the petitione given in to The Lords of his majesties privie Cownsell be The maisters of the wniversitie at St Andrews appointed for administrating the affairs of the Divinitie Colledge ther Shewing That wheras his majestie and estates of parliament in the Last Sessione therof granted to the two philosophie Colledges of the said wniversitie and to all the other wniversities in the kingdome a gift of the vaccand Stipends of Swch churches as are wnder ther patronage And ther being non then to appeare for the said divinitie Colledge in petitioneing the parliament for the lyke gift to the great Loss and detriment ther of which defect ther Lordships can now Supplie And therfore humbly craveing ther Lordships to grant the said colledge of divinitie the vaccant Stipends of Conveth Craig and Tyningham wherof they are partons and that for the cropt and yeir of God Jaj vic nyntie Seven yeirs And that for repaireing the fabrick and wther wses of the said colledge As the said petitione bears Which petitione being this day red and considered be the saids Lords of privie Counsell They doe heirby allow the vaccand Stipends of the paroch kirks of Conveth Craig and Tyningham wherof the divinitie colledge of St Andrews is patron for this present cropt and yeir of God Jaj vic nyntie Seven (2The twentie merks payable by act of parliament to the minister preaching at these kirks being first payed out therof to be imployed for repaireing the fabrick and other wses of the said colledge And nominats and appoints Thomas Rankeillor Late baillie to The Countess of Weemes to be factor for uplifting and ingathering of the saids vaccand Stipends And ordains him to be readiely answered obeyed and payed of the saids yeirs vaccand Stipend of the saids kirks by the heretors fewers wodsetters Liferenters titullars tacksemen of teinds tennents possessors and others lyable in payment of the same And ordains Letters of horneing on fiftein dayes and others neidfull under the Signet of Cownsell to be direct heiron at the saids factors instance against the heretors and others foirsaids lyable in payment of the said yeirs vaccand Stipend (The said twentie merks being first payed out therof to the ministers preaching at the said Kirks) upon productione of a decreit of Localitie and if ther be non ordaines the heretors and others foirsaids lyable in payment of the saids Stipends to make payment of ther respective proportiones of the Same according as they shall be decerned by the Judge ordinarie In respect the said factor hes Beffor extracting heirof given bond and found Sufficient Cautione acted in the books of privie Counsell that he shall apply the saids vaccand Stipends of the saids kirks for the ends and wses foirsaids

Liberation Leivtenant Chisholme

Anent the petition given in to the Lords of his Majesties privie Councell By Leivtennant Chisholme Sheuing That the petitioner Hath represented by former petitiones how he was formarly Imprisoned now for the space of ten months For not finding Caution to appear before the Court Martiall att the horse guairds at Whytehall And having then offered such Caution as he uas able to find the same was rejected and he still Lays in this noisome prisone wherin his health hath been much Impaired and the petitioner his wyfe and family reduced to the greatest extremity altho he uas aluayes and still is uilling to doe all in his pouer to satisfie those that pretend any Claime against him and uill undoubtedly be able to Clear himself of any thing that Can be Charged upon him And seing that the petitioners Imprisonment Can noe uayes Contribute to the obtaining of what is pretended against him And that he is ready to Give all the security In his pouer for that effect And because the petitioner Cannot find bale He is uilling to Inact himself under the highest Certifications that can be demanded To Ansuer all that is Charged against him And therfore Humblie Craving their Lordships to Consider the petitionres case and upon his Inacting himself In a place of Caution which In truth he Cannot find to order him to be sett at Libertie without Fees Having nothing to pay the Good man of the tolbooth or his servants as the said petition bears The Saids Lords of his Majesties privie Councell Having Considered this petition given in to them by The said Leivtennant Chisholme and ansuers therto By The Lady Graden They doe heirby Give order and warrand to The Magistrats of Edinburgh and Keeper of their tolbooth To Sett the petitioner at Libertie furth therof In respect the petitioner before extracting heirof Hath Inacted himself in the books of his Majesties privie Councell That he shall hold Compt and make payment to the said Lady Graden of what shall be found due by him to her of the money belonging and payable to the Deceast Leivtennant Colonell […] Home her son And hath Given bond and found […] Chisholme of Fairhope his father as Cautioner therin That he shall not depairt furth of this kingdome without Libertie of The King or his privie Councell untill he Clear and Compt uith the said Lady under the penaltie of ane Hundreth pounds Sterling By and att our performance of the premisses.

Anent the petition given into the Lords of his Majesties privie Councell By Alexander Blair alias Carnegie of Kinfaines Sheuing That their Lordships were Justly pleased to Committ the petitioner to the Castle of Edinburgh upon the […] day of November Last For his misbehaviour in their Lordships presence wher he hath Continoued ever since And seing it uas only the effect of his want of experience and of the Knouledge of the respect due to their Lordships which he hopes uill be pardoned In respect of his age and Confusion at that tyme And being now to Choise his Curators on teusday nixt so that it is in some sort necessar That the petitioner Should have Libertie And therfore Humblie Craving to the effect underwryten as the said petition bears The saids Lords of his Majesties privie Councell Having Considered this petition given in to them by the said Alexander Blair alias Carnegie They doe heirby Recommend to the Earle of Leven Constable and Governour of the Castle of Edinburgh And In his absence Gives order and uarrand to the nixt Commanding officer ther To sett the petitioner at Libertie furth therof For which this shall be to all Concerned a sufficient warrand.

Anent the petition given in to the Lords of his Majesties privie Councell By Robert Viscount of Oxfoord Sheuing That the petitioner some years agoe being Called before their Lordships He uas putt under Confynment at his oune house and tuo Mylls about the same And seing now ther is peace Concluded wherby the Cause of putting the petitioner under the said Confynment is happily taken auay And that the petitioners affairs and bussines are much prejudged by his said restraint and he the only persone of all these then putt under Confynment who is Continoued And therfore Humblie Craving to the effect underwryten as the said petition bears The saids Lords of his Majesties privie Councell Having Considered this petition given in to them by Robert Viscount of Oxfoord They doe heirby take off the Confynment formerly putt upon the said viscount And Declares him quytt therof and free therfrae And Gives order and warrand to The Clerks of privie Councell to delyver up to the viscount the bond granted by him and his Cautioners for Keeping his Confynment and his peacable behaviour and appearance when called for For which this shall be to all Concerned a sufficient warrand.
