The Lords of his majesties privie Counsell haveing considered a representatione made to them be Dwncan Ronald writer to the Signet and John Wilkie merchand in Edinburgh and Agnes and Magdaline Scotts her Spouses Beareing that their Lordships by the act of the date the twentie of March Jaj vic nyntie four upon the decease of Isobell Wardlaw doughter and air to wnqle Mr Charles Wardlaw of Logie Have given order and warrand to the baillie deput of the regalitie of Dumferleing to take inspectione and make inventar of the wrytes and evidents of Logie and to seall the same and to transport them to the clerks of privie Counsell which wrytes are now sealled and Secured in the hands of the said baillie deput And that the saids Agnes and Madgaline Scotts are served and retourned as airs portioners in speciall to the said Isobell Wardlaw as ther retoure Showen to the Lords of privie Counsell hes testified And therfore humbly craveing to the effect underwritten The saids Lords of his majesties privie Cownsell Doe heirby take off any seqwestratione Laid upon the saids wrytes and evidents and decernes and ordaines […] Baillie deput of the said regalitie of Dumferleing to Deliver the same with the charter chist wherin they ly and the key thereof to the saids Duncan Ronald and John Wilkie And ordaines Letters of Horning on fiftein dayes and others needfull under the signet of Counsell to be direct heiron in forme as effeirs

Act The Magistrats of Aberbrothock

Anent the petitione given in to The Lords of his majesties privie Counsell be The proveist Magistrats and town Councell of Aberbrotheck Shewing That wher the church of Aberbrothock is Lately Declaired vaccant by the presbetrie of Dwndie and severall ministers appointed from tyme to tyme to preach at the said church who by the Late act of parliament are to have twentie merks for each Lords day And the petitioners being most willing that they Should be payed accordingly untill they shall gett and setled minister according to Law which accordinglie they are doeing befor the said presbetrie But considering that the Stipend is for a great pairt in viccaradge teinds and in the teinds of severall heretors in and about the town which would occasione a great date of trouble for the ministers to procure dwe payment therof And to the presbetrie to appoint factors for the samen Besydes the hazard of the inhabitants of being doubly distressed and the hazard of Loseing the viccarage teinds are both locall and temporarie and cannot allow of ane factor to waite upon them And therfore Humbly craveing to the effect eftermentioned As the said petitione bears Which petitione being this day red and Considered be the saids Lords of privie Counsell They heirby awthorize the petitioners or Such as they Shall appoint to uplift the ministers Stipends of the said church of Aberbrothock viccarage and personadge teinds therof and that for this haill cropt and yeir of God Jaj vic nyntie Six The petitioners or such as they shall appoint they first giveing bond and finding Sufficient cautione acted in the books of privie Counsell That they shall make payment to the ministers who shall be appointed by the said presbetrie of Dundie to preach at the said kirk of the Soume of Twentie merks for each Lords Day in the termes of the above act of parliament And that they shall make Just compt reckning and payment to the Lords Commissioners of his majesties Thesaurie or ther orders of the Superplus of the said yeirs Stipend so far as the Samen shall not be exhausted be payment of the foirsaids twentie merks Scotts And ordains the saids petitioners or Such as they Shall appoint to be readiely ansuered obeyed and payed of the said yeirs vaccant Stipend be the heretors fewers wodsetters Life renters titulars tacksemen of teines tennents possessors and others lyable in payment therof And ordaines Letters of Horning under the Signet of Counsell to be direct at the petitioners instance or such as they shall appoint to uplift the ministers stipend of the said kirk of Aberbrothock against the heretors and others foirsaids lyable in payment of the said yeirs vaccant stipend upon productione of a decreit of Localitie And in caice ther be none ordaines the heretors and others forsaids to make payment of the respective proportiones of the said yeirs vaccant Stipends according as they shall be decerned and determined by the Judge ordinary

Sir William Scott younger of Harden being Cited as Cautioner for James Dalziell son to the deceast Sir Robert Dalziell of Glennae to have produced the said James before the Councell under the penaltie of one Hundreth pounds Sterling Contained in a bond subscryved by the said James as principall and Sir William as Cautioner dated the fifteenth day of December Jaj vjc nyntie five years And being this day ofttymes Called to have Compeared and to have produced the said principall He failzied therintill And therfore the saids Lords of his majesties privy Councill Have forefaulted and heirby forfaults the said penalty of one Hundreth pounds sterling In so farr as Concerns the said Cautioner only And Decerns and ordaines the said Cautioner to make payment and satisfaction to George Baillie of Jarvesuood Receaver of his Majesties Croun rents of the said soume of ane Hundreth pounds sterling of penaltie in his Majesties name and for his Majesties use And ordaines Letters of Horning on six dayes and others to be direct heiron under the Signet of Councill against the said Cautioner superceeding extracting heirof untill the tuenty second day of Aprile instant Betuixt and which the said principall appearing before Sir James Steuart his Majesties advocat and Enacting himself in the books of privy Councell in such tearms and under such a penaltie as his Lordships Finds he hes allowance for from his Majestie That he shall depairt furth of his Majesties Dominions and that within such a tyme as the Lord Advocat shall appoint And also Giving bond and finding sufficient Cautione acted in the books of his majesties privy Councell That he shall Live peacably under and uith all submission to the present government of his Majestie King William and that he shall not Act Consult nor Contrive anything in prejudice therof nor shall not Converss or Correspond uith any rebells And that he shall appear before the saids Lords of his majesties privy Councell whensoever he shall be Called or requyred therto In caise he shall be Called for before he Depairt the dominions And that under the penaltie of ane Hundreth pounds sterling In caise He shall transgress in any pairt of the premisses And upon Granting new bond appointes the former to be Given up
