Act The Magistrats of Aberbrothock

Anent the petitione given in to The Lords of his majesties privie Counsell be The proveist Magistrats and town Councell of Aberbrotheck Shewing That wher the church of Aberbrothock is Lately Declaired vaccant by the presbetrie of Dwndie and severall ministers appointed from tyme to tyme to preach at the said church who by the Late act of parliament are to have twentie merks for each Lords day And the petitioners being most willing that they Should be payed accordingly untill they shall gett and setled minister according to Law which accordinglie they are doeing befor the said presbetrie But considering that the Stipend is for a great pairt in viccaradge teinds and in the teinds of severall heretors in and about the town which would occasione a great date of trouble for the ministers to procure dwe payment therof And to the presbetrie to appoint factors for the samen Besydes the hazard of the inhabitants of being doubly distressed and the hazard of Loseing the viccarage teinds are both locall and temporarie and cannot allow of ane factor to waite upon them And therfore Humbly craveing to the effect eftermentioned As the said petitione bears Which petitione being this day red and Considered be the saids Lords of privie Counsell They heirby awthorize the petitioners or Such as they Shall appoint to uplift the ministers Stipends of the said church of Aberbrothock viccarage and personadge teinds therof and that for this haill cropt and yeir of God Jaj vic nyntie Six The petitioners or such as they shall appoint they first giveing bond and finding Sufficient cautione acted in the books of privie Counsell That they shall make payment to the ministers who shall be appointed by the said presbetrie of Dundie to preach at the said kirk of the Soume of Twentie merks for each Lords Day in the termes of the above act of parliament And that they shall make Just compt reckning and payment to the Lords Commissioners of his majesties Thesaurie or ther orders of the Superplus of the said yeirs Stipend so far as the Samen shall not be exhausted be payment of the foirsaids twentie merks Scotts And ordains the saids petitioners or Such as they Shall appoint to be readiely ansuered obeyed and payed of the said yeirs vaccant Stipend be the heretors fewers wodsetters Life renters titulars tacksemen of teines tennents possessors and others lyable in payment therof And ordaines Letters of Horning under the Signet of Counsell to be direct at the petitioners instance or such as they shall appoint to uplift the ministers stipend of the said kirk of Aberbrothock against the heretors and others foirsaids lyable in payment of the said yeirs vaccant stipend upon productione of a decreit of Localitie And in caice ther be none ordaines the heretors and others forsaids to make payment of the respective proportiones of the said yeirs vaccant Stipends according as they shall be decerned and determined by the Judge ordinary
