Decreet
Certificatione against The Lord Drummond
Anent the Lybell or Letters of Complaint raised and pursued before the Lords of his Majesties privie Councell at the instance of Sir James Steuart his Majesties Advocat for his highnes Intrest in the matter underwryten Mentioning That wher James Lord Drummond by his bond and obligation subscribed by him as principall and Thomas Hay of Balhousie as Cautioner soveitie and full debitor for him by their bond and obligatione subscribed by them of the date the fifth day of March Jaj vjc nyntie five years Band and obleidged them Conjunctlly and severallie that the said James Lord Drumond should Live peacably under and uith all submission to the present government of his Majestie King William And that he should not Act Consult or Contrive anything in prejudice therof nor shall not Converss or Correspond uith any rebells And that he should appear before the Lords of his Majesties privie Councell when called for under the penaltie of one thousand pounds sterling In caise he should transgress in any pairt of the premisses as the said bond of the date forsaid Containing a clause of releiff in favoures of the Cautioner Insert and registrat in the books of privie Councell and ane Decreit of the Lords therof Interponed therto upon the threttie day of March Last produced hes testified Lykeas the said James Lord Drummond being seized in order to his being presented before the saids Lords He brok the Custody and made his escape In order to prosecute his ill designs and practices against the Government And seing that by the forsaid misdemanners the said James Lord Drummond hath not only rendered himself suspected but also forfaulted any favour that was formerly Indulged to him for the ill practises that he uas then Ingadged in Therfor the penaltie Contained in the forsaid bond ought and should be forefaulted as to the said Lord Drummond And He ought and should be decerned by the saids Lords their decreit to make payment to George Baillie of Jarviswood Receaver of his Majesties Croun rents of the said penaltie of ane Thousand pounds sterling Contained in the forsaid bond And also He ought and should be furder punished In his persone and Goods to the terror of others from Committing or doing the Lyke wicked practises in tyme coming And anent the charge given to the said Lord Drummond to have Compeared personallie before the saids Lords of his Majesties privie Councell at ane Certain day bypast To have ansuered to the abovewryten Complaint And to have heard and seen such order and Course taken theruith as the saids Lords should think fitt under the paine of rebellion and putting them to the horne with Certificationry as the said principall Lybell or Letters of Complaint uith the executions therof in themselves more fullie proports Which Lybell Being this day Called in presence of the saids Lords of his Majesties privie Councell And his Majesties Advocat Compearing personallie For his Majesties Intrest as pursuar And James Lord Drummond Defender being Laufullie Cited at the Castle of Drumond and the mercat Cross of Perth ofttymes called and not Compearing The Lords of his Majesties privie Councell Doe heirby Grant Certificatione against the said Lord Drumond In respect of his absence and not Compearance And Have forfaulted and heirby forfaults the penaltie of one thousand pounds sterling contained in the bond Lybelled granted by the said Lord Drummond and his Cautioner In so farr as Concerns the said Lord Drummond only And Decerns and ordaines the said Lord Drummond to make payment and satisfaction to George Baillie of Jarveswood Generall Receaver of his Majesties Croun rents of the forsaid penaltie for his Majesties use And ordaines Letters of Denunciation to be direct heirupon at the pursuars instance Commanding messengers at arms to pass to the mercat Cross of […] and other places needfull And ther in his Majesties name and authority Deuly Lawfullie and orderly Denunce the said Lord Drumond his Majesties rebell Escheat and inbring all his movabells goods and Gear for his majesties use for his Contempt and disobedience And ordaines the saids Letters of Denunciation uith the executiones therof to be registrat Conform to the act of parliament
