Act session and presbyteries of Dumferling

Anent the petition given in to the Lords of his Majesties privie Counsell By Robert Mudie of Barnhill and William Smyth in Dumfermling tuo of the Elders of the Kirk session ther and as Commissioners for the said Kirk Session with Concurrence of Mr Samuell Charters moderator of the presbytrie of the bounds Sheuing That wher Mr Simeon Couper pretended Incumbent in the kirk and paroch of Dumfermling stands deposed by the sentence both of the presbytrie of the Bounds and also of the synod of Fyfe For most nottorious Contumacy He having not only refuised to Compear upon the Citations duely Given him But also Contemned all their orders and Continoued to preach notwithstanding of their suspension Intimat in the Contrary And doeth still now after almost tuo years refuise to submitt to the sentence of Deposition past against him But possesses and preaches in the Church and paroch as if still Laufull pastor therof against all authority Both Ecclesiastick and Civill And seing the forsaid sentences of suspension and depositione proceeding upon the ground of his Contumacy most expressly alloued by the Laus and acts of parliament was not only dewlie intimat But that also it is provyded by the Act of parliament Jaj vjc nyntie three That their Lordships Give all due assistance for making the sentences and Censures of the Church and Judicatories therof to be obeyed or otheruise effectuall as accords And that this hath Lykeuayes been their Lordships Constant practise In Lyke Caises And therfore Humblie Craving their Lordships In Consideratione of the premisses and of the forsaid sentence of Depositione produced with the said petitione To Give warrand for Letters to charge the said Mr Simeon Coupar to remove from the forsaid Church manse Gleib and paroch uithin the ordinary space As also to ordaine the Magistrats and others Conforme to their former Acts to Delyver up the keyes of the kirk and others as is usuall in the caise of vaccancie That the forsaid Church may be regularly planted for the Good of the Congregation and peace of the place as the said petitione Bears The saids Lords of his Majesties privie Councell Having Considered this petitione given in to them by the said Kirk session and presbyterie of Dumfermling against the said Mr Simeon Coupar with the said Mr Simeons Ansuers made therto And Having Considered the bill and Ansuers with the wrytes produced uith the petitione The saids Lords Doe Heirby ordaine the said Mr Simeon Coupar to remove from the said Church of Dumfermling And to remove himself wyfe bairns family and servants Furth and frae the manse and Gleib of the said paroch And ordaines Letters of horning on fifteen dayes and others needfull under the signet of privie Counsell to be direct heiron in forme as effeirs
