Anent the petitione Given in to the Lords of his Majesties privie Councill By John Byres of Coatts Sheuing That In obedience to their Lordships sentence appointing the petitioner to depart out of the kingdome betuixt and the first of Agust next to Come The petitioner purposed with all submission to be in readines to Comply theruith And his affairs being much Intangled uith severall Incumberances He hath not been wanting by his outmost dilligence to take such Course theruith as might allow him to obtemper their Lordships sentence But it being hard if not Impossible for one in his Circumstances to satisfie and Content every persone he hath to deall with upon a suddent And being obleidged to borrow Considerable soumes of money and Enter into severall transactions for putting his affairs into some order before his departure It is uterly Impossible for him to Gett these his Concerns so ordered uithin the tyme prefixed by their Lordships But that he must Leave all in Confusion to his utter ruine if he be necessitat now to depart the Kingdome neither at this tyme is ther any fleet going for Holland to affoord the petitioner passage thither As also severall others in noe better if not worse Circumstances then the petitioner Have found that favour and Compassion uith their Lordships as to recall any sentence of Banishment past against them And to allow them to remaine in the Countrey And therfore humblie Craving their Lordships In Consideration and compassion2 of the premisses and of the petitioners Condition To take off and recall the former sentence past against him for Going out of the Countrey And to allow him to Continow and remaine therin upon his finding Caution to Live peacably and appear when called for in the Commone forme or at Leist to prorogatt the day of his departure untill mertimes next betuixt and which tyme he may have the opportunity to putt his affairs in that Condition as he may depart uithout being totallie ruined by the disorder and Confusion of his bussines as The saids petition bears The saids Lords of his Majesties privie Councill Having Considered this petition given in to them by the said John Byres of Coatts They heirby prorogat the dyet appointed to the petitioner for his departing furth of this Kingdome to the first day of October next to Come He first before extracting hereof Giving bond and finding sufficient Caution acted in the books of privie Councill That he shall depart furth of his Majesties dominions betuixt and the said first day of october next to Come and that he shall not returne uithin the same uithout his Majesties or the Councills Licence for that effect And that in the meantyme while he be transported out of the Kingdome He shall Live peacably under and uith all submission to the present Government of his Majestie King William And that he shall not Act Consult nor Contrive any thing in prejudice therof nor shall not Converss or Correspond uith any rebells And that he shall appear before the saids Lords of his Majesties privie Councell whensoever he shall be Called or required to that effect under the penaltie of three Hundreth pounds sterline in case he shall transgress in any part of the premisses And upon Granting of this bond ordaines his former bonds to be Given up
