Proclamation

Proclamatione anent Recruits Leveys Desertors and Passes

The following proclamatione being read voted approven and signed was ordered to be recorded follows the proclamatione William by the Grace of God King of great Brittaine France and Ireland Defender of the faith to etc macers of our privy Councill messengers at armes our shirriffs in that part conjunctlly and severally specially constitut greeting Forasmuch as it is requisite and necessarie That dureing this present warr which so much concerns the defence and security of the Protestant Religione and of our Kingdomes Rules and ordors be sett for recruits Levies and Desertors whereby frequent disorders and oppressions may be prevented and unfitt2 men may not be engadged and none may be troubled upon the head of desertione but such as are truely Desertors Therfore we with advyse of the Lords of our privie Councill conforme to the thretty thrid act of this our Currant parliament intituled, act for the Levies doe Hereby appoynt and ordaine That noe officer3 either at Home or from abroad offer to take on or press any free leidge to be a souldier unless the man be taken on by agreement owned by Him in presence of the Judge of the bounds And if any officer shall Contraveen this ordor and press to compell any man contrair to the rule hereby established it shall be reckoned oppressione and the Transgressor punished by the fyne of a moneths pay and further by imprisonment and breaking and Casheering as the said Lords of privie Councill shall think fitt And further we with advyse foresaid doe strictly prohibite and Discharge all our officers which we have come for Recruits from Flanders to seize upon any persones as Deserters, But such as have Deserted from our scots Regiments in Flanders since they were there and none others And allows the officers of our Forces in this our ancient Kingdome to seize upon none upon the head of desertione but such as have deserted from one or other of the said Regiments, of which they are present officers And discharge any persone to be seized upon on pretence of desertione before our accessione to the Crowne And for preventing any mistake anent passes given to Such as have been souldiers we with advyce foresaid doe Hereby appoynt and ordaine That noe pass be sustained for any souldier from our Forces in Flanders, or out of this Kingdome unless the samine be subscryved at least by the Collonell of the Regiment or by one of the feild officers commander of the regiment for the tyme to which he belonged and declairs that the passes signed in maner foresaid shall free the persones in whose favors they are granted and furder we with advyse foresaid doe Hereby ratifie and revive all former acts and proclamations made anent Recruits, levies, or Deserters except in so far as the samine are hereby innovate or altered our will is Herefore and we charge you strictly and Command That incontinent thir our letters seen ye pass to the marcat cross of Edinburgh and remanent marcat crosses of the Head burghs of the severall shyres and stuearties within this our Kingdome And there in our name and authority by open proclamatione make intimation Hereof That none may pretend ignorance and ordaines our Sollicitor to transmitt printed Coppies hereof to the Shirriffs of the severall shyres4 of this Kingdome To be sent by them To the ministers of the severall paroches within their respective shyres and appoynts the ministers of the paroches To cause intimat these proclamations in their paroch Churches where they are ministers immediatly at the dissolutione of the Congregatione and that either from the pulpit or at the Church doors And ordaines these presents to be printed and published Given under our signet at Edinburgh the thretteenth day of February Jaj vjc nynty and sex years sic subscribitur Tweeddall Cancel Southerland Lauderdale Kintore Carmichaell Polwarth Adam Cockburne W Anstruther Lodovick Grant Archibald Murray Robert Sinclair John Maxuell
