Banishment Elizabeth Waterstone

Anent the petitione given in to the Lords of his Majesties privie Councill by Elizabeth Waterstoune Late servitrix to William Fairfoul Tenent in […] now Prisoner in the Tolboth of Edinburgh Shewing That the said petitioner hes remained a long tyme in prisone in great miserie for her alleadged being guilty of incest in Haveing Carnall Dealing with the said William Fairfoul and Andrew Fairfoul his Sone in the year Jaj vjc nynty and three years and is indicted for the said Cryme And since she know’s more of her owne guilt in the said matter then can be proven against Her and is Content rather to undertake banishment then to put the said Lords to more trouble in her Tryall And therefore Humblie Craveing in maner and to the effect aftermentioned as the said petitione bears The Lords of his majesties privy Councill Haveing considered the foresaid petitione given in to them by the said Elizabeth Waterstoune indicted for incest They doe Hereby Banish the said petitioner unto his majesties plantationes in America And ordaines Her to be delyvered to Master William Erskine Governour of Blackness in ordor to her transportatione and Giv’s ordor and warrand to the magistrats of Edinburgh and Keeper of ther Tolboot to sett the said petitioner at Liberty furth therof And delyver her to the said Master William Erskine to the effect foresaid The said petitioner first before extracting hereof Inacting herself in the books of Privy Councill That she shall depairt furth of his majesties Dominions and shall repaire to his majesties plantationes in America with the persone whome the said Master Erskine shall appoynt And that she shall never returne within his majesties Dominions without the King or Councills express warrant for that effect and that under the paine of death sic subscribitur Tweddale Cancell ipd Southerland Carmichaell Polwarth Robert Sinclair J Burnet John Maxuell T Livingstoune
