Anent the petition Given in to the Lords of his Majesties privie Councill By Sir Gilbert Kennedy of Girvanmaynes Sheuing That the petitioner Being charged at the instance of Sir Thomas Kennedy of Kirkhill and Robert Blackuood merchant in Edinburgh upon their Lordships Lauburroues And not being able to find Caution he was Incarcerat within the tolbooth of Edinburgh in Jullie Last wher he yet remains prisoner And seing he is not able to find Cautione albeit he be most willing to Enact himself in their Lordships books That neither the petitioner nor any in his name shall trouble or molest the said Sir Thomas Kennedie or Robert Blackuood or aither of them their persons Lands heretages houses tennents Cotters servants or others that belong to them And that under the penaltie (In caise of his breach) voluntarly to undergoe Imprisonment during his Life And what farder punishment their Lordships shall please to Inflict upon him And which is all that he is Capable to doe in this his present Condition And therfore humblie Craving to the effect underwryten as the said petition Bears The saids Lords of his Majesties privie Councill having Considered this petition given in to them by the said Sir Gilbert Kennedy of Girvanmaynes with the said provost Kennedy and Baillie Blackuood their Consent to the said Sir Gilbert Kennedy his Liberation in the terms of the said petitione Subscribed by their hands wryten upon the end of the petitione They In respect of the forsaid Consent Doe heirby Give order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth to Sett the said petitioner at Libertie furth therof In respect he hath Inacted himself in the Books of his Majesties privie Councill That neither he nor any in his name shall trouble or molest the said Sir Thomas Kennedy and Robert Blackuood or either of them their persons Lands heretadges houses tennents Cottars servants or others that belongs to them And that under the penaltie (in caise of his breach) voluntarly to undergo Imprisonment during his Life and what farder punishment The saids Lords shall please to Inflict upon him the said petitioner.
