Committie and Interloquitor Anent Chiftains of Clanns
The Lybell at the instance of Sir James Steuart his Majesties Advocat Against George Duke of Gordon and other Chiftains of highland Clanns Cited to have Compeared this day being the third teusday of June was this day Called in presence of the Lords of his Majesties privie Councill And His Majesties Advocat Compearing personallie and George Duke of Gordoun […] Viscount of Strathallan […] Murray of Stroan […] Drummond of Logie David Grhame of Fintrie David Grhame of Duntroon and […] Spaedin of Asshintullie Compearing personallie And […] Marques of Montrose Alexander Earle of Moray James Lord Drummond John, Earle of Marr […] Lord Ogilvie […] Stirling of Keir Thomas Steuart of Gairntullie Thomas Rattray his baillie and Factor and […] Stirling of Carden being Laufullie Cited ofttymes Called and not Compearing The Lybell being at Length heard read and Considered by the saids Lords of privie Councill They heirby nominat and appoint the Earls of Argyll and Annandale the Lord Ruthven and Lord Justice Clerk to be a Committie For hearing of the noblemen and Gentlemen Cited and appearing in this process what they have to propose why they should not find Cautione as they are requyred to doe And to Consider whither they ought to find Caution or not and to Consider who shall be offered Cautioners for them whither they are sufficient and may be receaved And Declares any three of the above Committie to be a Quorum And Recommends to his Majesties advocat to meet uith and be assistant to the said Committie And Recommends to the said Committie to meet the morrow at Nyne in the morning And report their opinione to the Councill at their first meeting And Grants Certificatione against the saids persons abovenamed and not Compearing except as is after excepted in respect of their absence and not Compearance And the saids Lords ordaines messengers to pass to the mercat Crosses of […] and other places needfull And ther in his Majesties name and authoritie Duely Lawfullie and orderly denunce the forsaids persons his Majesties rebells and putt them to his Majesties home And Escheat and Inbring all there moveables Goods and Gear to his Majesties use for their Contempt and disobedience And superceeds any Certificatione against the Marques of Montrose and the Laird of Keir notuithstanding of their not Compearing In respect they are Minors and there Curators not Cited And also superceeds execution against the Lord Drummond In respect he is prisoner in the Castle of Edinburgh
