Act The Principall and Regents of St Leonards Collodge in St Androwes

Anent a Petition given in to the Lords of their majesties privy Councill be the principall and Regents of St Leonards Collodge in St Androwes shewing That the Comissioner of the late visitatione for the University of St Androwes, Haveing Sequestred the haill writtes pertaineing to the said university and put them in the hands of the magistrats of St Androwes In Respect of the totall vaccation of the masters of the said university, Wherby, the petitioners are deprived of the benefite and use of the wrytes pertaining to their Colladge of St Leonards And so are not in a suficient Capacitie to manadge the affairs and rents pertaineing to the said Collodge, Unless they ware allowed libertie and use of the wryts pertaineing to the same, To the great detriment of the said Society, The magistrats of St Androwes being willing to deliver up the saids writtes upon and suficient warrand and exoneration to them And In Respect that the Comission of the visitation of the said university have fixed no Dyet for their Sitting, and their meetting againe being uncertaine And Therfore Humbly Craveing the saids Lords would grant warrand to the magistrats of St Androwes To deliver up the haill writtes pertaineing to the said Collodge of St Leonards To the principall of the said Collodge of St Leonards To the principall of the said Collodge And Lykewayes to Grant warrand to Mr Alexander Pitcairne Provest of the old Collodge of St Androwes who hath the Custody of the keyes of the Chists or boxes quherin the saids writtes are, To deliver up the saids keyes to the principall of the said Collodge of St Leonards, To the effect the masters of the said Collodge might have the custodie of their oun writtes for prosecuteing the affairs of the said Collodge As the petition bears. The Lords of their Majesties privy Councill haveing Considered this petition given in to them be the principall and Regents of St Leonards Collodge, They heirby Ordaine the Magistrates of St Androwes in whose hands the above writtes wer Sequestrat To deliver up these writtes with the Sealls which were put theron the tyme of the Sequestration unbroken or opened with the Chists and boxes quherin these writtes are to Mr William Tillidaff principall of the said Collodge and in caice the severalls be brocken or opned Ordaines the magistrates to deliver up the writtes to the principall upon oath and inventar In presence of Mr John Lindsay of Wolmerstoune Comissionar of St Andrewes, And Ordaines the above Mr Alexander Pitcairne To deliver the keyes of the Chists or boxes wherin the writtes are, to the above principall of St Leonards Collodge And Ordaines letters of horning to be direct heiron against the magistrats havers of the saids writtes whose names are to be particularly Condescended upon in the horning of exhibition and deliverie therof as said is And Lykewayes against Mr Alexander Pitcairne for deliverie of the keyes upon a charge of fiftein dayes.

Act Lord Lundoirs and Heretors of Newburgh for stipend

Anent the petitione given in to the Lords of there Majesties privie Councill be John Lord Lundoirs patrone of the paroch Shewing That the paroch kirk of Newburgh hes been vacant eversince the terme of Mertimes Jaj vjc Eightie Nyne as yet supplyed by none nor any persone whatsomever pretending interest to the stipend thereof And the trueth is no minister hes ever offered to accept of the Charge and Cure of the said paroch In respect of the Meanness of the stipend and that the church is altogether ruinous and no manse for the ministers to Live in The Church dykes are Lykewayes fallen so that the place of buryall is altogether made as the open place of pasture And there is no schoolhouse But what the paroch hes thir severall years past been at the charge of payeing maill for And sieing the said stipend for the tyme bypast Cannot be better Imployed then for building of a manse repairing of the said church and dyckes thereof and building of a schooll house All which are most necessarie and pious works And that all Concerned in the paroch are most readie to concurr therewith As shall (if nead be is) be Instructed by a Consent of all the heretors and Inhabitants of the said paroch in wreitt to the Clerks of Councill befor extracting And therefore Craveing that the saids Lords would be pleased In consideration of the premises to allow the said bygone stipends of the said paroch to be uplifted by the petitioners for the pious and necessary uses forsaids And for that end to name there oune collector For whom they are Content to find Cautione beyond exceptione that the said stipend shall be Imployed and stowed to the uses forsaid As the said petitione bears The Saids Lords of there Majesties privie Councill Haveing Considered this petitione given in to them be the Lord Lundoirs patrone of the paroch kirk of Newburgh They hereby allow to the petitioner the haill bygone stipends of the said kirk since the terme of mertimess Jaj vjc Eightie nyne And that for building of a Manse repairing of that kirk and dyckes thereof and biulding of a schooll house in the said paroch of Newburgh And nominates and appoints Mr David Orem in Newburgh to be factor for uplifting of the said bygone stipends And ordaines the said factor to be readily ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning under the signet of Councill at the said factors Instance againest them for that effect He produceing a decreet of Locality And in case there be none ordaines these Lyable to make payment to him of there respective proportiones of the saids stipends according as they shall be decerned be the Judge ordinarie2 In respect the petitioner hes given in to the Clerks of Councill ane Consent of the heretors and Inhabitants of the said paroch in wreitt As Lykewayes In respect the said factor hes found sufficient Cautione acted in the books of privie Councill That he shall Imploy the haill forsaids bygone vacand stipends upon the ends and uses forsaids.

Act for Lord Lindores and the heritors of Newburgh for stipend

Concerning the petition given in to the lords of their majesties’ privy council by John [Leslie] Lord Lindores, patron of the parish shewing that the parish kirk of Newburgh has been vacant ever since the term of Mertinmas 1689 as yet supplied by none, nor any person whatever pretending interest to the stipend thereof, and the truth is no minister has ever offered to accept the charge and cure of the said parish in respect of the meanness of the stipend and that the church is altogether ruinous and no manse for the minister to live in, the church dykes are likewise fallen so that the place of burial is altogether made as the open place of pasture, and there is no schoolhouse but what the parish has these several years past been at the charge of paying rent for, and seeing the said stipend for the time past cannot be better employed than for building of a manse, repairing of the said church and dykes thereof and building of a school house, all of which are most necessary and pious works, and that all concerned in the parish are most ready to concur therewith as shall (if need be) be instructed by a consent of all the heritors and inhabitants of the said parish in writing to the clerks of council before extracting, and therefore craving that the said lords would be pleased in consideration of the premises to allow the said bygone stipend of the said parish to be uplifted by the petitioners for the pious and necessary uses foresaid, and for that end to name there own collector for whom they are content to find caution beyond exception that the said stipend shall be employed and stowed to the uses foresaid, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the Lord Lindores, patron of the parish kirk of Newburgh, they hereby allow to the petitioner the whole bygone stipend of the said kirk since the term of Martinmas 1689 and that for building of a manse, repairing of that kirk and dykes thereof and building of a school house in the said parish of Newburgh, and they nominate and appoint Mr David Oram in Newburgh to be factor for uplifting of the said bygone stipend and ordains the said factor to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters and others liable in payment of the same, and ordains letters of horning under the signet of council at the said factor’s instance against them for that effect, he producing a decreet of locality, and in case there is none, ordains those liable to make payment to him of their respective proportions of the said stipends accordingly as they shall be discerned by the judge ordinary in respect that the petitioner has given in to the clerks of council a consent of the heritors and inhabitants of the said parish in writing, as likewise in respect that the said factor has found sufficient caution acted in the books of privy council that he shall employ the whole foresaid bygone vacant stipend upon the ends and uses foresaids.

The Lords of there Majesties privie Councill doe hereby recomend to Sir Thomas Livingstoun Comander in cheiff of there majesties forces within this Kingdome to Cause transport the persone of Robert Hamiltone […] prisoner presently in the tolbooth of Edinburgh for alleadged being present at the publishing of a disloyall paper or declaratione Lately published at the mercat croce of Sanquhar from the said tolbooth of Edinburgh to the tolbooth of Haddingtoun under a sufficient guaird And appoints the Magistrats of Edinburgh and Keeper of the tolbooth thereoff to delyver the said Robert Hamiltone to the said guaird And ordaines the magistrats of Haddingtoun and keeper of there tolbooth to receave him from the said guaird and to keep and detaine him prisoner in the said tolbooth untill further order.

The lords of their majesties’ privy council hereby recommend to Sir Thomas Livingston, commander in chief of their majesties’ forces within this kingdom to cause transport the person of Robert Hamilton […] prisoner presently in the tolbooth of Edinburgh for allegedly being present at the publishing of a disloyal paper or declaration lately published at the mercat cross of Sanquhar from the said tolbooth of Edinburgh to the tolbooth of Haddington under a sufficient guard, and they appoint the magistrates of Edinburgh and keeper of the tolbooth thereof to deliver the said Robert Hamilton to the said guard, and they ordain the magistrates of Haddington and keeper of their tolbooth to receive him from the said guard and to keep and detain him prisoner in the said tolbooth until further order.

The Following Letter Signed be the Lord Chancellour In name of the Councill wes ordered to be recorded, whereof the tenor followes – Sir. Letter from the council to the moderator of the presbytery of Dalkeith

The following letter signed by the lord chancellor in name of the council was ordered to be recorded, whereof the tenor follows: Sir, There being a petition presented to the council in name of the heritors of Cranston parish representing that you are about to plant the kirk of Cranston without due regard to the interest of and call from the said heritors. These are therefore appointing you to see and answer the said petition against 11 October next, and recommending to you in the mean time to forbear any further progress in planting that church.
