Order Anent the toune of St Androwes

The affair of the toune of St Androwes was this day tabled in the Councill, And the tounes old Chartor by King Malcome being called And the tounes books being revised and severall acts therin anent the election of their magistrats read, And both parties being called to the barr to be heard whither the toune Councills Choising their oun magistrats for these four years bygone without giveing in leitts to any person in place of the Archbishop be Suficient to continue them in electing after that Same maner till it be declared before the Judge ordinary that they have no right so to doe, And the Solicitor and his assistance haveing Declyned to debate that point, In Respect they have not seen the books produced for the toune The Lords of his majesties Privy Councill allowes the Solicitor to get up the books from the Clerks upon his recept on the books of the Inventar to be produced on Tuesday before twelve in the forenoon, And appoints both parties to be ready to debait upon the pynt forsaid that afternoon.

Act Doctor Weymes

Anent a Petition given in to the Lords of their majesties privy Councill be Doctor James Weymes late principall of St Leonards Collodge of St Androwes Shewing That wher the petitioner by act of the date the thrid day of march Jaj vjc nyntie one years therwith produced Did allow to the petitioner the steipend he hade formerly been in use of for the cropts and years of god Jaj vjc Eightie nyne years and Jaj vjc nyntie And Sicklike appointed Alexander Hamiltone of Kinkell Collector for uplifting the rents of the Archbishoprick of St Andrewes to pay to the petitioner what he had uplifted of the said two years Stipend belonging to the petitioner and also ordaine the heritors fewars, wodsetters fermorers tacksmen of teynds tenants possession and others Lyable in payment of the said stipend and parsonadge of Kinkell to make payment therof to the petitioner for the cropt and years forsaid In so farr as the Same was not at that tyme uplifted by the said Collector, And now that the said Alexander Hamiltone of Kinkell at least Some pretending to have right from him doe yet Continue to charge in his name the persones Lyable for payment of the forsaids two years Stipend on purpose as it seemed to get the money in his oun hand wherby the petitioner will be put to unnecessar charges expences and trouble for repetition of the forsaid stipend And Therfore Humbly Craveing the saids Lords to Discharge the said Alexander Hamiltone from uplifting any more of the forsaid stipends And from charging calling or conveening these Lyable in payment of the Same And to ordaine all charges given at his instance for that effect to be taken back that the petitioner himself or his factor might have the uplifting of the saids two years stipend. as the petition bears The Lords of their majesties privy Councill haveing Considered this petitione given in to them be the above Doctor Weymes Togither with ane act of Councill mentioned therin and produced therwith They heirby Discharge Discharge2 the above Alexander Hamilton to uplift any more of the above two years stipends And Declaires the charges given or other dilligences done be him for these stipends to be voyd and null And Ordaines him to refound and pay in to the petitioner or his factor such part of the saids Stipends as he has allready uplifted And Discharges him to trouble the petitioner or his factor in the peacable uplifting of the saids two years stipend And Ordaines the persones Lyable To payment to the petitioner or his factor of the same conforme to the above act of Councill.

Act Mr Archibald Borthwick for stipend

Anent the petitione Given in to the Lords of there Majestyes privie Councill be Mr Archibald Borthwick preacher of the gospell Shewing That whereas the petitioner at the appoyntment of the presbitry of Dalkeith did preach in the pariochine of Fala and other other places within the presbitry for the spring. and summer Jaj vjc nyntie one years And did preach constantly the wholl Last winter at the desyre of the Eldership and parochiners of the said paroch of Fala in the said pariochine And since that tyme hath preached in severall other vacancies within the said presbitry particularly in the pariochine of Newtoun And thereupon the said presbitry hath granted ane recomendatione to the saids Lords In favours of the petitioner for granting him ane right to ane years stipend of aither of the saids pariochines of Newtoun or Fala As the saids Lords should think fitt As the said presbitryes testificat and recomendatione produced with the said petitione hes testifyed and sieing the patrone of the of the2 Kirk of Newtoun is popish and thereby the vacant stipend at there Majesties gift and disposition And that the magistrats of Edinburgh as haveing the right of presentatione of the said kirk of Fala have consented to the premises as the consent subjoyned to the said testificat bears And therefore Craveing That the saids Lords would be pleased In consideratione of the premises To allow the petitioner the stipend of aither of the saids pariochines of Fala or Newtoun for this present cropt and year Jaj vjc nyntie tuo As there Lordships should think fitt And to ordaine the heretors and others Lyable in payment thereof To make payment of the same to the petitioner upon his recept As the said petitione bears The Saids Lords of there Majesties privie Councill haveing considered this petitione Given in to them be the above Mr Archibald Borthwick with the testificat recomendation and Consent mentioned therein and produced therewith They hereby allow the petitioner the stipend of the above Kirk of Fala and rent of the gleib thereof for the haill cropt and year of God Jaj vjc nyntie tuo years and ordaines him to be readily ansuered obeyed and payed thereof be the heretors Lyfrenters wodsetters and others Lyable in payment of the samen and ordaines Letters of horning under the signet of Councill at his Instance againest them for that effect He produceing a decreet of Locality And in Case there be none ordaines these Lyable To make payment to the petitioner of there respective proportiones of the said stipend and gleib for the said year according as they shall be decerned be the Judge ordinary In respect the petitioner hes sworne and signed the oath of alleadgeance and signed the assureance to there majestyes King William and Queen Mary prescrybed by the act of parliament And that in presence of one of the Lords of privie Councill.

Act Mr Archibald Borthwick for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr Archibald Borthwick. preacher of the gospel, showing that whereas the petitioner at the appointment of the presbytery of Dalkeith did preach in the parish of Fala and other other places within the presbytery for the spring and summer 1691, and did preach constantly the whole last winter at the desire of the eldership and parishioners of the said parish of Fala in the said parish. And since that time has preached in several other vacancies within the said presbytery, particularly in the parish of Newton. And thereupon the said presbytery has granted a recommendation to the said lords in favours of the petitioner for granting him a right to a year’s stipend of either of the said parishes of Newton or Fala, as the said lords should think fit, as the said presbytery’s testificat and recommendation produced with the said petition has testified, and seeing the patron of the kirk of Newton is Popish, and thereby the vacant stipend at their majesties’ gift and disposition, and that the magistrates of Edinburgh as having the right of presentation of the said kirk of Fala have consented to the premises, as the consent subjoined to the said testificat bears, and therefore craving that the said lords would be pleased in consideration of the premises to allow the petitioner the stipend of either of the said parishes of Fala or Newton for this present crop and year 1692 as their lordships should think fit, and to ordain the heritors and others liable in payment thereof to make payment of the same to the petitioner upon his receipt, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Mr Archibald Borthwick, with the testificat, recommendation, and consent mentioned therein and produced therewith, they hereby allow the petitioner the stipend of the above kirk of Fala and rent of the glebe thereof for the whole crop and year of God 1692, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, liferenters, wadsetters, and others liable in payment of the same. And ordain letters of horning under the signet of council at his instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to the petitioner of their respective proportions of the said stipend and glebe for the said year according as they shall be discerned by the judge ordinary, in respect the petitioner has sworn and signed the oath of allegiance and signed the assurance to their majesties King William and Queen Mary prescribed by the act of parliament, and that in presence of one of the lords of privy council.

Comittee and Liberation William Robertson and Alexander Davidson

Petition William Robertsone and Alexander Davidson seamen prisoners for alleadged being in the Bass read and remitted to Mr Francis Montgomery to examine them And authorizes him to give order for setting them at Liberty if he Think fitt. And the said Mr Francis Montgomery Conforme to the above reference did Liberate the saids tuo prisoners upon the eighteint day of november Instant.

The lords of there Majesties privie Councill In obedience to and prosecutione of his majesties Comands contained in a Letter under his Royall hand direct to them from His majesties Camp at Grammen near Deynse dated the fourteenth day of september Last Doe hereby grant warrand to and authorize the officers of there Majesties Scotts regiments in Flanders who are sent over from thence for makeing recruitts To Levie men for makeing as many more recruitts as besydes the tuenty four men of all the ordinarie Companyes of foot in this Kingdome will recruitt and Compleat there regiments And for that effect to take on such persones as are willing to engadge in the said service And to beatt drums within the burgh of Edinburgh and all places of this Kingdome for that end. And Lykewayes grants warrand to the saids officers to seize as many deserters from there respective regiments as they can find in this Kingdome not presently in there majestyes service And ordaines all the Magistrats of burghes and other magistrats and ministers of the Law within this Kingdome to give Concurrance to the saids officers for makeing up there recruitts And for secureing such persones as shall willingly engadge in the same And Lykewayes for apprehending of the saids deserters And to allow the officers the benefite of there prisones both for such as shall Engadge in makeing up the recruitts and also for the deserters The officers alwayes mantaining such persones as shall be by them Comitted to the saids prisones

The lords of their majesties’ privy council, in obedience to and prosecution of his majesty’s commands contained in a letter under his royal hand directed to them from his majesty’s camp at Grammene near Deinze dated 14 September last, do hereby grant warrant to and authorise the officers of their majesties’ Scots regiments in Flanders, who are sent over from thence for making recruits, to levy men for making as many more recruits as besides the twenty-four men of all the ordinary companies of foot in this kingdom will recruit and complete their regiments. And for that effect to take on such persons as are willing to engage in the said service, and to beat drums within the burgh of Edinburgh and all places of this kingdom for that end. And likewise grant warrant to the said officers to seize as many deserters from their respective regiments as they can find in this kingdom not presently in their majesties’ service. And ordain all the magistrates of burghs and other magistrates and ministers of the law within this kingdom to give concurrence to the said officers for making up their recruitts, and for securing such persons as shall willingly engage in the same, and likewise for apprehending of the said deserters, and to allow the officers the benefit of their prisons both for such as shall engage in making up the recruitts, and also for the deserters, the officers always maintaining such persons as shall be by them committed to the said prisons

Right trusty and right well beloved cousins and councillors, right trusty and entirely beloved etc (as in the preceding Letter), wee greet you well. Whereas wee have ordered twenty four men to be drawn out of the strong companies and eighteen of all the ordinary companies of the foot in that our ancient kingdom to recruit the Scots troops in Flanders without trouble to the country, yet there will be more necessity to fill up all our Scots regiments here, therefore it is our pleasure that you give your warrant authorising those officers who are sent over to beat drums for making as many more recruits as will complete their regiments, and we do expect your countenance and assistance to them that the recruits may be well made. And as our free lieges are not to be forced, so such as have once engaged are not to be allowed thereafter to desert. Wee doubt not of your care both to prevent abuses and to have the recruits effectually made. And so wee bid yow heartily farewell. Act anent recruits out of the standing forces

The Lords of there Majesties privie Councill Considering that his majestie by a letter under his Royall hand direct to them from his camp at Grammen near Deynse of the date the eight day of september Last hes recomended to there care the speedie and well prosecuteing the recruitts wanting to there Majesties scotts troops in Flanders And being desyrous they be made without trouble to the Countrey and effectually for the service Therefore and in obedience to, and prosecutione of there Majesties Commands in this effair The Saids Lords of there majesties privie Councill doe hereby ordaine and appoint the number of Tuenty four men to be taken out of each of the Companyes of Colonell Hills regiment And the Lyke number out of each of the Independent Companies And ordaines the number of Eighteen men to be taken out of each of the Companyes of Colonell Leslys and Colonell Buchans regiments And appoints all the recruitts to be delyvered at Leith to these officers who are sent over for them who are to pay seven dollars for each of the men to the Captains of the Companyes out of which they are taken And ordaines these Captains to compleat there Companyes within tuo moneths efter the delyverie of these men and the saids Lords doe hereby authorize and appoint the persone who Comands the forces of this Kingdome in cheiff In absence of Sir Thomas Livingstoun Comander in cheiff of the same To order the choise of souldiers fitt for the service out of the severall Companyes aither in regiments or Independent companyes within this Kingdome And the saids Lords doe hereby appoint the said Colonell Sir James Leslie In respect of the absence of the said Sir Thomas Livingstoun to Intimate this act to the Colonells Sir James Leslie In respect of the absence of the said Sir Thomas Livingstoun to Intimate this act to the Colonells Captains and other2 officers of the regiments and Independent Companyes within this Kingdome That the same may receive punctuall obedience And appoynts the said Sir James Leslie To Call the officers who are come from Flanders for recruits And know from them how the recruitts3 To be taken out of the regiments and Independent Companyes are to be divyded and proportioned amongst these officers And how soon these recruitts are to be in readiness for shipping.

And the said lords doe hereby appoint the said Colonel Sir James Leslie, in respect of the absence of the said Sir Thomas Livingston, to intimate this act to the colonels, captains, and other officers of the regiments and independent companies within this kingdom, that the same may receive punctual obedience. And appoint the said Sir James Leslie to call the officers who are come from Flanders for recruits and know from them how the recruits to be taken out of the regiments and independent companies are to be divided and proportioned amongst these officers, and how soon these recruits are to be in readiness for shipping.

The Letter underwreitten from the Kings Majestie to the Councill being read wes ordered to be recorded whereof the tenor followes.

Right trusty and right well beloved council and councillor, right trusty and entirely beloved cousins and councillors, right trusty and well beloved cousins and councillors, right trusty and right well beloved councillors, right trusty and well beloved councillors, and trusty and well beloved councillors, we greet you well. Whereas there are many recruits wanting to our Scots troops in Flanders, and we being desirous that they be had without trouble to the country, and that they may be effectual for the service, it is our pleasure that there be chosen out of every company of foot in that our ancient kingdom eighteen sufficient men, and because the companies of Hill’s regiment and the independent companies are stronger then those of Leslie’s and Buchan’s regiments, twenty-four men are to be taken out of each of these companies, and all the recruits are to be delivered at Leith to those officers who are sent over for them, who are to pay seven dollars for each of the men to the captains of the companies out of which they are taken, and they are to complete their companies within two months after delivery of these men. And to prevent any debate [that] may arise about the choosing of the men, Sir Thomas Livingston is to order the choice of soldiers fit for the service. We doubt not of your care to have this matter, which is of importance to our service, speedily and well prosecuted. And so we bid you heartily farewell.
