Recomendatione to the said Duke to quarter the Troop of Guards

His Grace the Duke of Queensberry Haveing acquainted the Councill That the Commissary formerly appoynted to provyde his majesties Troops Hath made noe provisione this summer for them and that as yet there is noe other persone contracted with for executing the said office of Commissary or appoynted to provyde for the Horses of the Armie and that the troop of guards now after their late fatique doe necessarly requyre to be well quartered dureing the rest of this summer Therfore the Lords of His majesties privy Councill Doe Hereby recomend to the said Duke of Queensberrie to quarter his majesties troop of Guards as most conveniently may be done untill a Commissary be appoynted With power to his Grace to remove them from tyme to tyme as he shall find necessary or convenient and Recommends to his Grace to give the necessary ordors to the officers to make payment to the Counterey of the quarters of the said troop of guards wherever they shall happen to be quartered dureing the space foresaid

Liberatione Sir Æneas Mcphersone

Anent the petitione given in to the Lords of his majesties privy Councill by Sir Æneas McPhersone Prisoner in Edinburgh Tolbooth Shewing that where the petitioner having been seased […] Prisoner in February Jaj vjc nynty and four years by ordor of Sir John Trinhard upon suspitione of secret practises against the Government was in June following sent to Scotland aboard of one of his majesties ships of warr and Haveing arryved at Leith the tenth of August therafter was immediatly 2 ordered to this unheathy noysome jaille where the said petitioner hath been a Constant prisoner alwayes since and by his Long confynement contracted so many distempers and desease That ane incurable decay threatens if he is not shortlie set at liberty And therfore Humbly Craveing the said Lords to Commiserat the said petitioners Conditione and either to set him free or to allow Him for his health to be in some private lodgeing under guard with Libertie of the feilds the petitioner being content to inact himself under payne of death not offer his escape as the said petitione bears.
The Lords of his Majesties privy Councill Haveing considered the foresaid petitione given in to them by the said Sir Æneas Mcphersone They Hereby give ordor and warrand to the magistrats of Edinburgh and keeper of ther Tolbooth to set the said petitioner furth thereof In respect he hes inacted himself in the books of privy Councill That he shall Live peaceablie under and with all submissione to the present Government of his majestie King William and that He shall not Consult nor contryve any thing in prejudice thereof nor converse or Correspond with any Rebells and that He shall appear before the said Lords of privy Councill when called for under the penalty of ane Hundred pound Sterline and upon the said petitioners liberatione recalls the alliment allowed to him whyle he was a prisoner.

The Lords of his majesties privy Councill Considering That Sir Ewen Cameron of Lochiell and Coll McDonald of Keppoch were called Here from their owne Homes anent the publick concerns of the Government and that its just and reasonable they be allowed to returne to their Homes without prejudice Therefore they Hereby grant personall protectione to the said two persones and discharges any messengers at armes or officers within burgh or Landward to put to executione any Letters of Captione, acts of wardeing or others against the persones of the said Lairds of Lochiell and Keppoch for whatsomever Cause or occasione untill the fyfteen day of August next to come excepting alwayes his Majesties rents and publick dues.

Anent the petitione given in to the Lords of Privie Councill by Charles Earle of Home Shewing That where the said petitioner haveing been confyned to his house and two myles about it by the said Lords their ordor now of a long tyme and which he so exactly observed That upon noe account he would goe that lenth in the2 shyre where he liv’s even in prosecutione of his most urgent affaires where he was not evidentlie within his Confynement whereby much of his business both at Aytoune and Eymouth is gone into absolute Confusione and cannot shun to be irrecoverable especiallie by the death of John Weild at Eymouth to whom his business there was intrusted unless the said Lords would allow Him farder freedome and therfore Humbly Craveing in maner and to the effect aftermentioned as the said petitione bears
The Lords of his majesties privy Councill haveing considered the foresaid petitione given in to them by the said Charles Earle of Home They Hereby Grant Libertie to the said Earle To goe about his affairs at any place within the shyre of Berwick upon this syde of the water of Tweed In respect the said Earle hes given bond and found sufficient Cautione acted in the books of privy Councill That He shall remain confyn’d within that part of the shyre of Berwick quhich is upon this syde of the water of Tweed and not goe without the same under the penalty of two thousand pounds sterline and upon granting a new bond ordains the former bond to be given up And in the meantyme to live peaceablie under and with all submissione to the present Government of his majestie King William and that He shall not act consult nor Converse or Correspond with any Rebells And shall appear before the said Lords qhuen called for under the said penalty in Case He shall transgress in any pairt of the premisses

Act Hendry Payne

Anent the petitione given in to the Lords of his Majesties privy Councill by Hendry Payne Shewing that where the said petitioner Hes about fyve years past languished in Continuall imprisonment within this Kingdome and for the most part under Closs confynment whereby his health and Constitutione is not only miserablie decayed but for want of Correspondence with his freinds agents and debitors in England and Ireland where some remains of his ruined fortune still rest he is reduced to the outmost want and without any Hopes but that the said Lords out of the bowels of Christian Charity would put some speedie alteratione to his miserable conditione He being a poor stranger that hes not one relatione or acquaintance in the Kingdome he can reasonablie expect releiff from wherfore the said petitioner humbly Craved That the said Lords in their aboundant mercie the would remove him from that dismal place and the unwholesome state he is in if not by full enlargement or any sort of exile yet that the said Lords would allow him open prisone in some other place as for a short tyme he formerly enjoyed it That He may then endeaver to find furder Cautione of his weill demeaning then his owne personall promise though the petitioner hoped his behaviour hetherto hes not appeared such as to render his word of noe value and therfore he doth presume to give2 the said Lords all the faith of a Christiane That He will noe wayes whatever correspond about or incourage things prejudiciall to the peace of the natione dureing such favorable imprisonement as he hoped the said Lords will allow him doubting not but the King will in some short tyme unbeleive the black Clack Character the said petitioners enemeys have given him and permitt him to share in that Compassione he hes showed to numbers of more active and considerable opposers then he can anywayes be supposed to be as the said petitione bears
The Lords of his majesties privy Councill haveing considered the foresaid petitione given in to them by the said Hendrie Payne They Hereby grant the said petitioner the benefit of open Prisone And appoynts him to be transported from the Castle of Dumbartaine where he now lyes to the Castle of Stirling there to remaine prisoner with the benefitt to walk through the Castle The Governour deputy Governour and other officers and Souldiers being alwayes answerable for his saffe Custodie And Recomends to his Grace the Duke of Queensberrie to cause convoy the said petitioner to the Castle of Stirling under a sufficient guard And ordains the Governour or other officers in Stirling Castle to receive him from them and keep him prisoner in maner foresaid untill furder ordor of Councill.
