Warrant

Warrand to receave Ballachin and his brothers bond and Cautioners therin

The Clerks of privie Counsell haveing presented the two bonds following Viz one granted be Patrick Stewart of Ballachin as principall and Charles Stewart yownger of Ballachin and Collonell James Meinzies of Culders as Cautioners And the other granted be Alexander Stewart brother to the said Laird of Ballachin as principall and James Herring of Calley and Thomas Stewart of Stenton as Cawtioners The saids Clerks represented that these two bonds were granted in obedience to ane act of Cowncill Dated the twentie two of Jwlly Last bypast And that the Saids clerks being ignorant of the saids Cawtioners They offered the bonds to The Counsill to be considered be them And The Counsell haveing considered the saids bonds and the Cautioners named therin They hereby allow and awthorize ther saids clerks to receave these bonds and upon receaveing therof to give out the extract of the Cowncills act of the date forsaid

Act Lord Ross and parochiners of Paisley

Anent the petitione given in to The Lords of his majesties privy Cownsell be William Lord Ross for himself and in name of most of the heretors and parochiners of the parochin of Paisley Shewing That wheras the river of Cart being a great hinderance to the petitioners both in repaireing to kirk and mercat And ther being two Small Streames that rwns in therunto that either efter a flood at all tymes of the yeir and for the most pairt Dureing the whole winter are impassable So that the petitioners are therby debarred from access to the paroch kirk at these tymes And also from the mercats and from the Coallhewghs and other places wher they have necessar occasiones to repaire to without indangering ther Lives And Seing they are resolved to attempt to bwild a bridge over the said river of Cart they Doe humbly expect ther Lordships Countenance and incouragement to soe good and piows a work And therfore humbly craveing to the effect eftermentioned As the said petitione bears which petitione being this day read and considered be the saids Lords of privie Counsell They doe heirby allow a volwntar contributione to be collected throwgh the whole parishes within this kingdome upon such dayes as the petitioner shall think fitt for bwilding a bridge over the river of Cart at the place mentioned in the petitione and recomends to the ministers of the severall paroches within this kingdome to cause ther elders pass throw the severall houses and dwilling places of the inhabitants within ther respective paroches and to receave and uptake the said collectione and nominats and appoints Robert Forrester Servitor to The Lord Ross to be factor for uplifting of the collectiones to be made in the said severall paroches And appoints the ministers or kirksessiones of everie parosh to cause delyver to the said factor the collectiones made in ther respective paroches And recomends to the said ministers of the severall paroshes to cause make intimatione hereof at ther paroch churches upon the Sabath day befor the saids collectiones shall be made In respect the said factor hes given bond and found sufficient Cautione acted in the books of privie Counsell that he shall imploy the saids collectiones upon bwilding the said bridge

Act additionall Commissioners for the midle strait of the highland Justiciary

The Lords of his Majesties privie Councell upon Information and application made to them by John Earle of Mar one of the Commissioners of Justiciary of the midle district appointed by his Majestie for setling and securing the peace of the highlands Conform to a Recommendation made by the saids Commissioners to the said Earle under the hand of George Cockburn Clerk of Court to represent to the saids Lords of privie Councell How necessary it is for their assistance In pursuance of their Commission That the persons follouing whom The Commissioners doe Recommend be added to the number Have added and heirby adds the persons follouing viz Mr Frances Montgomery of Giffine Governour of Dumbartoune Castle Captain John Areskine Claud Hamilon of Barnes Nicoll and Robert Bunteins elder and younger of Airdoch John Buchanan of Garbaith John Stevenson of Knockhill and John Glass of Sauchie to be members of the Commission of the said midle district appointed for setling and securing the peace of the highlands With Full pouer to the saids Commissioners heirby added to Sitt Vote Act and doe with the Commissioners already named in the said Commissione alse fullie and freely in all respects as if their names had been from the beginning in the said Commissione And as any other Commissioners Have done or may doe in the Lyke caice.

Order

Order to the Lord Carmichaell Commander in Cheiff for disbanding the Earle of Tullibardine the Lord Lindsay and Forbess their regiments

The Lords of his Majesties privie Councell Doe heirby Recommend to John Lord Carmichaell Commander in cheiff of his Majesties forces within this Kingdom for the tyme To Give orders to the officers of the regiment under Command of Colonell Mcgill to march that regiment to Edinburgh And upon thursday nixt to see The Lord Lindsays regiment Disbanded at this place and their armes secured in the Castle of Edinburgh And Recomends to the said Lord Carmichaell to Give orders also to the officers of that Detachment of the Lord Lindsays regiment Lying att Drumfreis to march that detachment to Edinburgh to be disbanded ther as the rest of the said regiment And Recommends to the said Lord Carmichaell to give orders to the officers of the Earle of Tullibardins regiment to march the said regiment from Falkirk to Linlithgow and to disband them ther upon thursday the tuenty fifth Instant and to send ane officer there the said day to receave and secure their armes in the toune Counsell house of Linlithgow And appointes the Magistrats of Linlithgow to take care to Keep the armes till they be transported to the Castle of Edinburgh And Recommends to the said Lord Carmichaell to send a party of his Majesties foot forces to Linlithgow for guairding and Convoying the saids armes from thence to the Castle of Edinburgh And to send a Company of his Majesties foot to the toune of Queensferry to keep Guaird ther And to secure the armes of all Straglers or of such as may run auay with their armes And Recommends to the said Lord Carmichaell to send orders to the Lord Forbes that he disband such of the troops of his regiment of Dragoons as are presently Lying at Invernes and that att the toune of Invernes And that the Lord Forbes doe secure all the armes belonging to the saids Dragoons in the Castle of Invernes And Recommends to the said Lord Carmichaell to give orders to the officer who Commands that troop of the Lord Forbes his regiment of dragoons now lying at Falkirk That he disband the said troop att Falkirk upon thursday the tuenty fifth Instant And that he take care the armes be secured in the hands of the magistrats of Falkirk untill they be called for by the Government And Recommends to the said Lord Carmichaell before Disbanding to adjust any differences which may be betuixt the officers and souldiers of that troop anent their horses And The saids Lords Gives pouer warrand to the shireff principall of Invernes and his deputes and the provost of Invernes summarly to examine and Indeavour to setle any differences which may occurr betuixt the officers and souldiers anent the horses of the dragoons before disbanding of them at Invernes And that the said Lord Carmichaell Give orders to the officers of the regiment Lying at Stirling that they take care to seize upon and secure the armes of any disbanded souldiers who shall Indeavour to Carry them off that way and to delyver the same in to one of his Majesties magazines.

Order to the Lord Carmichaell Commander in Cheiff for disbanding the Earle of Tullibardine the Lord Lindsay and Forbess their regiments

Right trustie and right well beloved Cousin and Councellor Right trustie and Entirely beloved Cousin and Councelor Right trustie and well beloved Cousins and Councellors Right trustie and uell beloved Councellors And trustie and well Beloved Councelors We Greet yow well Wheras We are Informed that […] Frazer of Boufort and Captaine Simeon Frazer his son have In a tumultuary manner Convocat severall persons of the name of Frazer And have with their assistance illegally made prisoners The Lord Saltoun The Lord Mungo Murray and my Lady Lovitt And did Keep them under guards of their accomplices for a Considerable tyme And doe yet in that manner detaine my Lady Lovitt And have otherwise barbarously and Inhumanely used them which is a high Contempt of our authority And we being resolved to Give protection to all our Good Subjects and that these who shall in so open and heynous a manner Act against our Laus shall be brought to due punishment We have therfore Thought fitt to signifie to yow That it is our royall will and pleasure That yow use all Dilligence possible To Cause apprehend the said […] Frazer and his son with such others of their accomplices as yow shall think fitt And yow are to order our Advocat and Sollicitor to prosecute them untill they be punished according to Lau And expecting your Care in this It being so Important for our service and so necessary for the peace and quiet of our Subjects We bid yow heartily Fareuell Given att our Court at Kensingtoune the nynteenth day of november 1697 and of our reigne the nynth year By his Majesties Command sic subscribitur James Ogilvie.

Right trustie and right well beloved Cousin and Councellor Right trustie and Entirely beloved Cousin and Councellor Right trustie and uell beloved Cousines and Councellors Right trustie and well beloved Counsellors And trustie and well beloved Councellars We Greet yow well Wheras ue understand by your Letter that yow have not as yet Given orders for disbanding of the tuo Regiments of foot Commanded by the Earle of Tullibardin and Lord Lindsay And the regiment of dragoons Commanded by The Lord Forbes We have Therfore thought fitt againe to signifie to yow That without further delay yow Cause disband the saids regiments And secure their armes to be Laid up in our magazines: Wee Cannot Comply with what yow desyre in allouing them a Fourteen nights pay from the tyme they are disbanded Because wee have ordered our tuo battallions of Guards Commanded by Major Generall Ramsay and the regiment Commanded by Colonell Row Immediately to be transported to Scotland The which regiments as soon as the others are disbanded are to be upon the establishment of that our Kingdom We have appointed the Lords of our Thesaury to Cause make payment to the forsaids regiments of full subsistance to the tyme of their being Disbanded As Lykeuayes to make payment of their Clearance provyding that Can be done uithout exhausting the Funds for the Current subsistance of our other forces For Doing wherof This shall be your warrand So we bid yow heartily Farewell Given att our Court at Kensingtoune the Nynteenth day of November Jaj vic nyntie seven By his Majesties Command sic subscribitur James Ogilvie.

Right trustie and right well beloved Cousin and Councellor Right trustie and Entirely beloved Cousin and Councellor Right trustie and uell beloved Cousines and Councellors Right trustie and well beloved Counsellors And trustie and well beloved Councellars We Greet yow well Wheras ue understand by your Letter that yow have not as yet Given orders for disbanding of the tuo Regiments of foot Commanded by the Earle of Tullibardin and Lord Lindsay And the regiment of dragoons Commanded by The Lord Forbes We have Therfore thought fitt againe to signifie to yow That without further delay yow Cause disband the saids regiments And secure their armes to be Laid up in our magazines: Wee Cannot Comply with what yow desyre in allouing them a Fourteen nights pay from the tyme they are disbanded Because wee have ordered our tuo battallions of Guards Commanded by Major Generall Ramsay and the regiment Commanded by Colonell Row Immediately to be transported to Scotland The which regiments as soon as the others are disbanded are to be upon the establishment of that our Kingdom We have appointed the Lords of our Thesaury to Cause make payment to the forsaids regiments of full subsistance to the tyme of their being Disbanded As Lykeuayes to make payment of their Clearance provyding that Can be done uithout exhausting the Funds for the Current subsistance of our other forces For Doing wherof This shall be your warrand So we bid yow heartily Farewell Given att our Court at Kensingtoune the Nynteenth day of November Jaj vic nyntie seven By his Majesties Command sic subscribitur James Ogilvie.
