Act In favors of the Lady St Leonards for ane aliement

Anent a Petitione given in to the Lords of their St Leonards Shewing That quher her husband being Imployed as ane officer in his majesties Service he was necessitate to leave this kingdome and did intrust the managing of this affairs to Thorndykes and did grant him ane disposition to the rents of his lands dureing his lifetyme and did burdein the same with five hundred merks of yearly annuitie as ane aliement privision for my intertainment and quhich wes but very small and inconsiderable when it is Considered That I brought allong with me to his familly ane Considerable Soume of money besides ane lyfrent annutie of 1200 lbs yearly quhich he has uplifted and possessed since the time of our mariadge quhich wes about Eight years agoe and over and above he has ane seperat estate extending to ane thousand merks yearly rent and Thorniedykes having neglected to pay to me the forsaid soume the petitioner was therby redacted to great necessitie and was necessitate to give in ane petition to the saids Lords Craving that they might be pleased to apoint her ane aliement suitable to her husbands conditione But this was refused upon answers given in be Thorndykes quherin he alledged that her husband was owing debts extending to the 24000 merks Bot that he still protected he was willing of the saids Lords interposed ther authoritie to pay to her the 500 Merks Conforme to her husband Disposition But now he declynes even to doe this The petitioner does therfore humbly represent the saids Lords That it has been Constantly the Custome to modifie aliements to wifes when ther husbands treats them with the least severitie and heir by her husbands withdrawing and not Cohabiting with her and disponeing her estate to Thornydykes she is at the point of Starving and he having been now thrie years abroad she was Content to depone that she has not hade from him or his factor above thrie hundred merks scots dureing all the forsaid time neither is his estate possest by Creditors and it is so far from being true that his Debts doe extend to 24000 merks that he owes not above Eight at most and has ane seprat estate quhich is suficient for paying twyce alse much and that besyde her Joynture And seing I ame this Circumstantiat she could have no remieed but by the saids Lords Justice and Clemencie And Therfore humbly Supplicating to the effect aftermentioned The Lords of ther majesties privy Councill having Considered this petition given in them be the above Lady St Leonards which Mr Alexander Brown of Thorniedykes being allowed to see and answer gave in no answer therto with the factory Granted by the Ladies husband to the said Mr Alexander They ordaine the said Mr Androw Brown of Thorny-dykes To make payment to the petitioner of the soume of five hundred merks for the aliement of the petitioners and her familly yearly for all years since her husband went abroad and in time Comeing untill he returne dureing the continuance of the said factory the termes of payment being allwayes first come and bygone, And Ordaines the said Mr Alexander to enter her to the possession of the house yeards and parks of St Leonards with the baynes and Cariadges of the said estate and ane horss grass conforme to her husbands disposition or factorie and the saids Lords Declaires that this aliementary provision shall no wayes be Lyable to the Ladies husbands Creditors And ordaines letters of horning on 15 dayes and others needfull to be derect heiron under the Signet of Councill.

The Lords of their majesties privy Councill haveing Considered a petitione given in to them be George Viscount of Tarbat concerning the Lands seperat from Ross and annexed to the shire of Cromartie with the report of a Committie of their oun number to whom the Consideration of this matter was Remitted They ordaine the rentall produced with the said petitione which is signed by the Commissioners of Supply Clerk and Collector of Ross shyre bearing that the same is the valued rentall and rule of Publict burdeins for the lands belonging to the said Viscount or his wodd setters or which were or are liferented by his mother or mother in law to be insert and recorded in the books of privy Councill Followes the tenor of the forsaid rentall, The penult October Jaj vjc nyntie thrie List of George Viscount of Tarbat Lord Mccleod and Castlehaven etc. It is oun valuatione, The Lady Castlehaven his mother and Lady Maynes Lyferent Lands and the said Lord Tarbat his wodsetters valuations as in his George Mckenzie Collector And the saids Lords of privy Councill Ordaines the valuatione so attested. to be recorded in the valuatione books of the shyre of Cromartie as to the Lands not allready recorded therin and to be expunged out of the valuation books of Rose shyre, And Declaires that the saids Lands shall bear and carie with them the same quota of the Levies cess and other publict burthens, and that they shall pay the same for the futur in and with the shyre of Cromartie and adjoyned to the totall therof and deduced from Ross Shyre in all time comeing, This being exactly conforme to the acts past in the last session of this current parliament as also conforme to the other act of parliament past theranent the nynteinth day of Jully Jaj vjc nyntie years and Conforme to the act of parliament Jaj vjc Eightie five years all quhich were read and Considered be the Committie.

The Lords of their majesties privy Councill haveing by their act of the date the twentie seventh day of December Jaj vjc nyntie two years given Warrand to their Clerks to deliver up to Captain Robert Young in Collonoll Grahames regiment and bond taken before the Committie of Councill anent Souldiers granted be Robert Cosbie seaman and his Cautioner dated the nyntein of the said moneth They heirby ordaine all executione by horning Caption Or otherwayes to pass upon the said bond at the instance of the said Captaine Young for payment of the penaltie therincontained.

The Lords of their majesties privy Councill Ordaines the act of Councill of the date the nynth of march last against Tumults and other Disorders of Students in Colledge quherof2 The tenor Followes Att Edinburgh the nynth march Jaj vjc nyntie thrie years The Lords of their Majesties privy Councill takeing to their Consideratione the Tumults and disorders which frequently fall out amongst and are Committed by the students within the severall Colledges and universities within this kingdome and haveing Considered the report of a Committie of their oun number appointed in this matter the saids Lords for preventing of any tumults or other disorders in any of the said Collodges and universities for the future Foe heirby authorize and Impower the severall principalls regents and masters of the saids Collodges respective In case it shall happen heirafter any of the Students of any of the Collodges abovementioned to Committ or be guilty of any tumults or other enormeous disorders against the quyet and good government of the saids Collodges to Impose and exact finnes from such as they shall find guilty not exceiding the respective rates and proportiones after mentioned viz for a nobleman or his eldest sone ane hundred and fiftie punds Scots, for noblemens younger sones or Barrons themselves, or their eldest sones ane hundrid punds, for the younger sones of Barrons or gentlmen, and for the sones of burgesses Fiftie punds, And for the Sones of Craftsmen or yeomen fiftie merks Scots, And that by and attour the repairation of damnages And the saids Lords Doe heirby Requyre and Command the magistrats of the respective burghes quher the saids Collodges are keept to Interpose their authoritie to the sentance of the saids masters, and to give them their assistance in executeing the same by Imprisonment if need bees, And allowes and appoints the soumes that shall be exacted for finnes in maner and for the Causes abovementioned to be applyed for the use of the severall Bibliothicks of the saids Collodges, And the saids Lords haveing reveiwed ane act of Councill of the date the first day of February Jaj vjc seventie two years Prohibiting one Collodge to receive any schollar from another Collodge. Act Mr Alexander Haggins anent the Countess of Southesk

Anent the petitione Given In to the Lords of their Majesties privie Councell Be Mr Alexander Higgins advocat Sheuing That wher the Countess of Southesque Having resided at Paris a Considerable tyme for her Health and Given a Commissione to the petitioner for manadging her affairs in Scotland relating to her Joyntur And their Lordships Having been pleased to Grant a uarrand to the petitioner to wryte to her And to Remitt her money In ordor to her returne from France Against the first of Agust last in the termes of the Act of parliament which being done by the petitioner and a Coppie of his Letter being Given to the Lord High Chancellor The Countess hath wryten ane Ansuer which was Immediatly Communicat by the petitioner to the Lord Advocat wherby she Evidenceth her uillingnes to Give all deutifull obedience to the Act of parliament And that she would Gladly have begun her Journey upon recept of the said Letter But that her Indispositione and the seasone of the year maketh it almost Impossible for her to performe such a Journey till the month of February nixt And seing the Act of parliament does Leave it to their Lordships to Give Licences to persones to stay in France after the said first of Agust as they shall see cause and that ther can be noe case more favourable Considering her Indispositione and other Circumstances mentioned most Ingenwously in her said Letter And therfore Humbly the saids Lords uill be pleased to take the forsaid case to their Consideratione And to Grant ane uarrand to the petitioner to wryte to the said Countess as the said petitione Bears The Saids Lords of their Majesties privie Councell Having Considered this petitione Given in to them Be the above Mr Alexander Higgins They Heirby Grant warrand and alloues the said Mr Alexander to wryte to the said Countess In ordor to her returne from France and also to transmitt money or bills to her for defraying the charges of her transportatione The Letter or Letters which shall be wrote by the petitioner being alwayes first revised and marked by their Majesties Advocat

Approbatione of the procedure of the Committee and others Anent the Lady Lockhart

The Lord Advocat having reported to the Lords of their Majesties privie Councell That conforme to their Lordships warrand of the date the tuenty second day of december instant Mr William Calderuood Advocat shirreff depute of Edinburgh Mr Patrick Creichtoune servitor to the Clarks of Councell and Mr Robert Patersone servitor to the Lord Advocat Having Gone to the house of Dredden and broken up the sealls searched for peapers and brought in such as they found and some pockett books which his Lordship and the Lord Justice clark Conforme to the saids Lords of privie Councells ordor of the same date forsaid did goe through these papers and the other papers in the Ladies dressing box seased att Edinburgh And finding ther was nothing of Import in any of the saids papers or books they delyvered them all back againe to the Lady except three or four Letters or papers which their Lordship thought fitt to keep till they be furder Inquyred after The saids Lords of their Majesties privie Councell approves of what the Committie and the other persones above named have done in this matter And the said Lord Advocat Having represented that in respect of Captain James Pattoune did refuise to declare who were meaned by the persones to who in the Letters seased upon him were direct or to Give any account anent these Letters The Committie Have Committed him closs prisoner in the tolbooth of Edinburgh The Councell approves of the forsaid Committment
