Act Infavours off The Earle of Southesk and his Tuttors alloweing them to wreat to Paris

Annent The petition given in and presented to the Lords of Her Majesties privie Councill By Mary Countess of Southesk, Charles Earle of Hume, John Earle of Lauderdale David Earle of Northesk, Henry Lord Sinclair, Sir Archbald Hope off Rankeillor, Mr James Carnegie off Phinhaven and Mr James Martain off Grange as Tuttors to and in behalfe off James now Earle of Southesk Their Pupill Shewing That ther being a proces Depending befoir the Parliament off Paris annent the summe off Ten Thousand Livers Mortifyed by the late Earle of Southesk For the use off the poor Wherin the now Earle of Southesk younger Petitioners pupill is particularly Concerned And the said Soume will unquestionably be lost and perish unless The Petitioners shall be allowed as Tuttors to transmit due Informatione’s and Instructiones To their Pupills Lauiers employed And Seeing The Petitioners By reason off the Late Act Dischairging Commerce with France Cannot saiffly correspond with ther saids Lauiers without speciall allowance from ther Lordships for that effect And Therfore Creaving To the effect aftermentioned as the said petition bears The Lords of Her Majestie’s Privie Councill Haveing considered the above Petition given into them By Mary Countess off Southesk, Charles Earle of Hume John Earle off Lauderdale, David Earle off Northesk, Henry Lord Sinclair, Sir Archbald Hope off Rankeillor Mr James Carnegie of Phinhaven and Master James Martain off Grange As Tuttors to and in behalfe off James now2 Earle off South Esk Their pupill They Doe Heirby permit and Allow The said Petitioners As Tuttor’s Forsaids or any off them to writ To Paris alse oft as shall be needfull upon occasione off ane proces Depending befoir the Parliament off Paris Annent the soume off Ten Thousand Livers Mortified By the Late Earle of Southesk For the use off the poor wherin the now Earle off Southesk The petitioners pupill is particularly concerned To her Factors, Agents, and Raporteur The Letters and Missives soe sent being allwayes befoir sending therof first seen and marked By Sir James Steuart Her Majesties Advocat.

Act Livt Young in My Lord Lorns regiment for beatting Drums etc

Anent the petition given in to the Lords of her Majesties privy Councill be Livetenent Archibald Young in the Lord Lorns Regiement Shewing That the petitioner being Sent over from Holland to Levie recruits for the Service of the Said Regiment It was necessary for his More Convenient gathering of recruits that the petitioner have the saids Lords warrand and Licence to the officers of My Lord Orkneyes regiment to beat up for recruits for the Service of the said regiment And therfore Humbly Craveing the Saids Lords would be pleased to grant the petitioner warrand and licence to beat drums for takeing on of volunteers in the severall burghes of this kingdome wher the petitioner Should happen to resort as the saids Lords hade formerly been in use to grant to others in maner forsaid as the petition bears; The Lords of her Majesties privy Councill Haveing Considered the above petition given in to them by Livetennent Gilbert Young in my Lord Lorns Regiment and the Samen being read; In ther2 presence The Saids Lords of her Majesties privy Councill Doe hereby Grant Licence and warrant to the petitioner to Beatt Drums for Levieing of men and takeing on of volunteers in the Severall burghs of this kingdome wher the petitioner Shall happen to resort; And allowes the petitioner to have the use of the prisones in any burgh within this kingdome for detaineing and keeping the persones so takeing on untill they shall be transported for Holland; And Grants warrand to the petitioner to Seize upon take and apprehend all deserters from the said regiment; And Ordaines all magistrates and others to give their concurrance to the petitioner for Secureing the deserters from the said Regiment and others who Shall willingly ingadge with him; The petitioner allwayes aliementing and mantaineing them upon his oun proper Charges and expences; And prohibites and Discharges any disorders or abuses to be Committed by the petitioner in Levieing or Secureing as above But allwayes keeping himself within the bounds that the Law prescribes.

The Earl of Tillibardin added to the privy Councill

Letter from the Queen to the Councill for receiveing and adding of John Earle of Tullibardine in to the privy Councill Being read was ordered to be recorded And the said John Earle of Tillibardine being present Did qualifie himself to her Majestie by Swearing the oath of alledgance and Subscrybing the Same with the assurance; And the Earle of Finlator preses for the time did tender the Oath de fideli to his Lordship who took his place at the board accordingly.
Followes the forsaid Letter.

Right Trustie and right well beloved Cousin and Councillor Right trustie and intirely beloved Cousins and Councillors Right trustie and well beloved Cousins and Councillors Right trustie and well beloved Councillors and trustie and well beloved Councillors; Wee greet yow well; Wheras in Consideration of the Loyaltie and Singular abilities of our right trustie and well beloved Cousine John Earle of Tillibardine Wee have thought fitt to add him to the privy Councill fo that our kingdome It is Therfore our will and pleasure And wee doe hereby Authorize and requyre yow to admitt and receive him into that our privy Councill in the ordinary form and method in the Like Occasiones Accustomed For doeing wherof This Shall be your Warrant, And So wee bid yow heartily farewell; Given at our Court at St James’s the 17th day of December 1702; And of our reigne the first year. By her Majesties Command Sic Subscribitur Tarbat.
