Uarrand for Confyning Mr Thomas Gordoune to the toune of Killmarnock

The uhich day Mr Thomas Gordoune Late Regent In the Colledge of Glasgow who is under bale before the Lords of privie Counsell That He shall Live peacably under their Majesties Government and appear before the Councell when called for Being Charged upon his bond to appear as said is and Having appeared accordingly And Having refuised to suear and signe the oath of alleadgance and signe the assurance to their Majesties appoynted by Act of parliament Their Majesties High Commissioner and Lords of privie Councell Doe Heirby Confyne the said Mr Thomas Gordoun to the toune of Killmarnock to remaine therin And not goe furth therof uithout their speciall warrand for that effect And appoynts the Macers of privie Councell to detaine him prisoner untill he Give bond and find sufficient Cautione acted in the books of privie Counsell That He shall repaire to his said Confynment and observe and keep the same betuixt and this day Eight dayes And that he shall Live peacably in the Commone forme and appear when called for under the penaltie of tuo thousand merks scotts

Report of the Committie Anent the security of the peace of the natione

The Follouing Report of the Committie underwryten wherof the tenor folloues Edinburgh 26 May 1693 Sederunt Earle of Drumlangrig Earle Argyle Earle Annandale Lord Viscount of Tarbat Viscount Stair Lord Raith Thesaurer depute The Lords Carmichaell Beilhaven Polluarth Lord secretary Lord Advocat Lord Justice Clark Mr Frances Muntgomery and Sir John Maxuell Earle of Drumlangrig Elected preses
It is the opinione of the Committie That it be signifyed by the Counsell to the Commissioners of supply In the shyres follouing viz The shyres of Wigtoune and steuartry of Kirkcudbright the shyre of Lanerk Air Renfrew and Dumbrittaine That they Intimat to the Fencible men uithin the saids shyres aither at the paroch kirks or otherwayes as they shall think meet That the Lords of their Majesties privie Counsell Having had experience in former occasiones of their readiness to appear for defence of Church and state as presently by Law established And having also Good Ground to apprehend that the attempts of enemies from abroad may be to Invade and make a descent on the uest coast Doe therfore allow them to rendivouze themselvs in Companies In one paroch or more as shall be sufficient to putt furth the saids Companies uith the best armes they have And under such Captaines and other Inferior officers that they shall make choyse of And to appoynte dayes and places for their mustering uithin the saids paroches And ther to exercise and traine themselves under their saids officers To the effect they may be in better posture and readines to defend Against any danger that may happen Requyring them only to Give ane accompt to the saids Commissioners respective of the Captains Leivtennants and ensigns that they shall make choyse of And declaring that the forsaids Rendivouzs and musters are only Intended for the end forsaid uithout Ingadging the persones that shall appear therat any farder then they shall willingly offer themselves as said is And the saids Commissioners are to be requyred to send in the names that shall be Given In to them of the saids officers to the Lords of their Majesties privy Councell uith their best conveniency And that the saids Commissioners take accompt from them what armes and amunitione they have and make report therof to the Councell To the effect they may be supplyed in what is uanting And appoyntes Letters to be wryten to the Commissioners of supply for that effect The which Report Being this day redd In presence of the Lords of their Majesties privie Councell And they Having Considered the same They approve therof And appoyntes Letters to be wryten to the Commissioners of supply in the saids shyres In the termes of the same And Recommends to the Lord Chancellor to signe the said Letters In name of the Councell

Anent the petitione given in to the Lords of their Majesties privie Counsell Be James Irvine macer Sheuing That the petitioner Having fallen into the misfortune in Letting yesterday Androw Baird escape out of the Committie room It is Humblie represented to his Grace and their Lordships That he Having at the present juncture three Gentlemen in custody And not knouing that any of them were In any worse Circumstance then ane other Ther Came Into the Committie room such ane Croud of poeple their Lordships sitting in Councell and George Weir the other macer Carrying Gairletoune to prisone that the said Andrew Baird made his escape For It is nottourly knouen that the petitioner hes been very valitudinary all this uinter being sick near unto death His Grace and the saids Lords knoues He did nevar fall into the lyke misfortune of before And therfore Humblie Craving his Grace and their Lordships to take the premisses to their consideratione and to sett the petitioner at Liberty as the said petitione bears Their Majesties High Commissioner and Lords of privie Counsell having Considered this petitione Given In to them Be the above James Irvine They heirby Give ordor and uarrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the petitioner at Liberty furth therof And Have depryved and heirby depryves the said James off his office untill He produce and cause secure the persone of the said Androw Baird whom He suffered to escape by his negligence

Their Majesties High Commissioner and Lords of privie Councell Doe Heirby Recommend to the Lord Strathnaver and Sir James Muncreiff to meet uith Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdome to Concerte uith him what armes will be necessary for their regiments And Recommends to the Lords Commissioners of their Majesties Thesaury to Give out for the use of these regiments such Arms as shall be Condescended upon by them upon the obleidgement of the said Lord Strathnever and Sir James Muncreiff to restore the same when requyred
