Act

Act anent the Earle of Buchans continowing at Liberty

His majesties High Commissioner and Lords of privy Councill Doe hereby exoner and discharge Lwetenant John Erskine Leutt Governour of the Castle of Stirling for what may be laid to his charge in permitting the late Earle of Buchane to goe furth of the said Castle to John Keirie of Gogar his house albeit the Earle hes not returned to the Castle but gone to Edinburgh and allow’s the said late Earle to remaine at liberty in Edinburgh in respect of his great weakness and dangerous Conditione The Earle first giving bond and finding sufficient Cautione acted in the books of privy Councill That He shall reenter himself prisoner within the said Castle of Stirling so soon as he shall be able to travell thether and in the meantyme that He shall live peaceablie under and with all submissione to the present Goverment of his majestie King William and that He shall not act consult nor contryve anything in prejudice thereof nor converse or correspond with any Rebells under the penalty of fyve Hundred pounds sterling in case he shall transgress in any part of the premisses.

Act Edmonstoune of Ednem

Anent the petitione given in to2 his majesties High Commissioner and Remanent Lords of his majesties privy Councill by Andrew Edmonstoune of Ednem Shewing That where after a long imprisonment in the Castle of Blackness The said petitioner was alloud to retire to his owne House upon his finding Caution to be confyned within two myles of his dwelling which Confynement he hath most exactly observed ever since his being liberat from the said Castle, to his great detriment and Loss both in his privat affairs in the Countrey where he lives and at Edinburgh where busines of his concern of very great importance hath been delayed and partly intirely lost by reasone of his absence and which the said petitioner can never expect to retrive3 but by the said Lords ther favor And therfore Craveing the said Lords to take of the said petitioners Confynement and allow Him to goe about his affairs and business at Edinburgh or elsewhere upon his finding sufficient Cautione to appeare before the said Lords when called as the said petitione bears His majesties high Commissioner and the Lords of privy Councill haveing Considered the foresaid petitione given in to them by the said Andrew Edmonstoune They hereby take of the said petitioners Confynement and declare Him to be at full liberty to goe about his affairs as any other of his majesties free Leidges In respect He hes Given bond and found sufficient Cautione acted in the books of privy Councill That He shall live peaceablie under and with all submissione to the present Government of his Majestie King William and that he shall not act consult nor contryve any thing in prejudice and that He shall appear before the said Lords of privy Councill when called for under the penalty of fyve thousand marks scots money in case He shall transgress in any part of the premisses and upon granting the said bond ordained the former bond to be given up

Letter frae the King in favors of Duke of Gordone

The following letter being read was ordered to be recorded and ane act to be extracted thereon follows the Letter sic suprascribitur William Rex Right trusty and right well beloved Cousin and Councillor Right trusty and entirely beloved Cousin and Councillor Right trusty and well beloved Cousins and Councillors and trusty and welbeloved Councillors We greet you well whereas by our Letter of the tuenty sexth of February Last We granted to the Duke of Gordone the Libertie of the Toune of Edinburgh and of four myles round till the first day of June next He finding security to live peaceablie within the bounds of his said Confynement and To reenter his persone prisoner in our Castle of Edinburgh on the said first day of June we think fitt to Continow him the same Libertie of the Toune of Edinburgh and of four myles round for sex moneths to come he finding security for his behaviour in the tearmes abovementioned and to reenter himself prisoner at the end of the said sex moneths and so we bid you heartily farewell given at our Court at Kensingtoune the tuenty seventh day of Apryll Jaj vjc nynty and fyve years and of our Reigne the seventh year By his Majesties Command sic subscribitur J Johnstoun

His majesties high Commissioner and the Lords of privy Councill Doe Hereby Ordaine […] Sandiland, Baillie of Calder to be ceitted by macers or messingers to appear before his grace and their Lordships upon the nynth day of July next to come To answere at the instance of Sir James Stueart his Majesties Advocat for his great Contempt and high misdemanner in dispyseing the ordors and refuseing to provyde and dispose in quarters some of the officers or Dragoons of the Lord Carmichells Regiment in their march through that bounds even when they had provyded forrage for themselves and only asked houseroome.
