Act in favors of Paulls Work and Boningtouns manufactories

Anent the petition given and presented, to the Lords of his majesties privie Counsell, by the masters of the manufactory of worsted and other stuffs at Paulls Work and Boningtoun, Showeing, that where ther is a very Comendable mortification made by the deceast Mr John Johnstoun, John Trottar, David Mcaull, and others for encurageing a manufactory in Paulls Work att the foot of Leith wynd in Edinburgh, and Boningtoun, and breeding young Boyes therein they have entered into a society, for manufactoring of stuffs and others ther, and Contributs Considerable stocks for that end. Likeas the toun Councill of Edinburgh have for the petitioners encuragement putt them in possession of the forsaid mortification, and seing that this ther undertakeing is not only most profitable for the makeing of worsed stuffs, and Improveing the product of the nation, But Likewayes, of Great advantage for the Education of Boyes Conform to the design of the said mortifications, So that they desrve the priveledge of a manufactor, als much as any manufactor in the kingdom, Likeas by the twelth act of the parliament one thousand Six hunder and eighty one the saids Lords are fully Impowered to grant the same, and Therefore Craveing to the effect after mentioned; as the said petition bears. The Lords of his majesties privie Counsell haveing Considered this petition, given in to them be the masters of the manufactory of worsed and other stuffs att Pauls Work and Boningtoun, they doe hereby declare the above manufactory to be a laufull manufactory and to have all the liberties priveleges and Immunities Granted by the acts of parliament to such manufactories, and declairs that the said manufactory shall endure for the Space of nynteen years from the day and date hereof

Protectione In favors of Coll McDonell of Keppoch

Anent the petitione Given in to the Lord high Chancelour and remanent Lords of his Majesties privy Councill by Coll Mcdonald In Keppoch Sheweing That where It pleased the Lords of his Majesties privy Councill by there Act of the Nynth of August last to Grant the petitioner a personally protectione to the first of January thereafter which wes thereafter prorogate in favours of the petitioner and his brother Angus with a Liberty for them to Attend their Lordships at Edinburgh To the sixth of Jully instant that the petitioner might treat with the persones named in there Lordships former act anent The Laird of McIntoishes affairs in presence of Brigadeer Maitland Governour of Fortwilliam, In prosecutione wherof the petitioner hes treated Accordingly And the Laird of Mcintoish and the petitioner are fully settled by A Subscribed Agreement reported to their Lordships by the said Brigadeer Maitland And Seing it will be necessar both to the effect that the petitioner May Attend their Lordships pleasure in relatione to the said report And Lykewayes for draueing the wrytes and papers betuixt the Laird of McIntoish and the Petioner2 for Implement of the said agreement which are not yet fully extended in wryteing That their Lordships protectione may be yet prorogate for sometyme with Liberty for the petitioner to Attend their Lordships at Edinburgh to the effect forsaid As alsoe that their Lordships protectione be prorogat to the said Angus McDonald the petitioners brother as formerly being a persone necessary for perfecteing the saids wrytes And Therefore Craveing It might please their Lordships to renew to the petitioner and his said brother their personall protectione with pouer to them to Repair till Edinburgh and other places needfull within the Kingdome for the effect forsaid The Lords of his Majesties privy Councill haveing Considered the petitione given in to them be Coll McDonald in Keppoch They doe heireby grant personall protectione to the said Coll McDonald and to the said Angus McDonald his Brother untill the first day of January Jaj viic and tuo years next to Come inclussive As to any thing May be Layed to ther charge upon Accompt of their actings against the Government Allenarly To the effect the said Coll McDonald May Continow and treat with the persones Named in the former Acts of Councill of the date the tuelvth day of March and Nynth of August Jaj viic years anent the Laird of McIntoish and his private affairs In presence of Brigadeir Maitland Governour of Fort William And Discharges all Macers Messengers at Armes and other officers of the Law within this Kingdom to Trouble or Mollest the said Coll or Angus McDonalds upon Accompt of Any thing May be Laid to their charge for their bypast actings Against The Governement before the said first day of January be Elapsed and Dureing the space of the said protectione Have allowed and heireby allowes the saids Coll And Angus McDonalds to Repair to the City of Edinburgh or other places needfull within this Kingdome to the effect abovementioned sic subscribitur Marchmont chancelor Seafeild Mar Loudown Northesk Montgomerie James Stewart C Campbell A Drummond.

Act The affrican Company

Anent the petition given in to the Lords of his Majesties privy Councill be the Councill Generall of the Company of Scotland tradeing to Affrica and the Indies Shewing That they understanding that his Majestie is now at the head of a treaty wherin (as the petitioners humbly conceive) The Ministers of the Most Considerable tradeing Nationes in Europ Would in all probability be very Solicitous in minding the severall intrests of the respective Kingdomes and States Which they represent The petitioners thought it their dutie by ane humble adress to represent to his Majestie the great Losses and damnadges which their Company hade Sustained by the violent and repeited invasions of the Spaniard, to the end; That if any new treaties were made at this extraordinary conuncture2 of the affairs of Europe Care might be taken to vindicat their Companies right to Caledonia in the Isthmus of Darien as holding of the Crown of this kingdome and to make provision for procureing repairation of their Companies Losses and damnadges abovementioned as wes more particularly expressed in the said adress therwith given in; Which Adress the petitioner humbly pray’d might be by their Lordships care fully and Speedily transmitted to his Majestie with such recommendationes In favors of their Company’s intrest as the saids Lords in their profound wisdome Should Seem meett as the petition bears The Lords of his majesties privy Councill haveing Considered the above petition Given in to them by the above Councill Generall of the Company of Scotland tradeing to Affrica and the Indies with the adress to his Majestie from the said Councill generall; And it haveing gone to the vote, Whither the said adress should be transmitted to his Majestie or not; It was caried in the Negative Nimine Contradicente.

Anent the petition given in to the Lords of his Majesties privy Councill be Sir William Denholme of Westsheill Master of his Majesties Mint Shewing That wher in the Coyning of the gold ordered by the Saids Lords at the Instance of the Affrican Company their occurres this difficultie That the Gold presented for Bullion was not Just Standart But needed to be refined which refineing would be a Considerable Charge; And was certaien that it could neither fall on his Majestie nor upon the officers of the Mint His Majestie being oblidged only to give a free Coynage And Seing that the said expence of refining was Like to be considerable as hade been found by ane essey made of refineing about near Four pound of the said Bullion; Which could not be done for less then about ten pounds Sterling So that it was absolutly necessary That the Saids Lords would determine that preliminary questione as the petition bears The Lords of his Majesties privy Councill Haveing Considered the above petitione given in to them be the above Sir William Denholme of Westsheills They doe hereby Ordain the merchants presenters of the above Gold for Bullion to pay the expences of the said refineing And Doe hereby free the petitioner of takeing in the said Bullion untill either duely refined or that the presenters and in givers of the Said Bullion give Securitie to the Said petitioner for paying the expence of refineing the same.

Anent the petition given in to the Lords of his Majesties privy Councill by the Town Thesaurer Magistrats and Town Councill of the Burgh of Bamff Shewing That wher ther was ane testificat to ane accompt of Depursments made by the petitioners Subscrybed by the Earle of Findlater and other Commissioners of Supplie within the Shyre of Bamff Bearing that the petitioners hade been at Six hundred and thrie pound four shilling of expences in keeping ane extraordinary watch on severall Egyptians therin named Committed to their tolbooth by a Mittamus from the Viscount of Seafeild Shirriff principall of the Shyre; This was a publict Service tending to the great advantadge and Security of his Majesties Leidges for these profligate vagabounds Did Sorne all round the Countrey both South and North; Wheras now; Some of the Cheiff heads of that pestiferous Crew being Laid aside their followers might come to disperse But the petitioners were altogither unable to hold up under the forsaid expences for their tounes Common good was nothing and if they were not releived therof the present magistrats would demitt nor would ther be found any to Succeed them for fear of execution for debts And Therfore Humbly Supplicating the Saids Lords 2 according to the Shirrif principalls desyre Lay their caise before the saids Lords and the Saids Lords hade been in use to provide for the reimbursment of other burghs In caices wherto the petitioners might much more then pretend to be a paraleell In favor particularly in a caice of the burgh of Pearth And Therfore Humbly Craveing the Saids Lords to the aftermentioned The Lords of his Majesties privy Councill Haveing Considered the above petition given in to them by the above Town Thesaurer and toune Councill of Bamff They hereby Recommend to the Lords Commissioners of his Majesties thesaury To allow to the petitioners the Accompt of expensses produced for keeping the above extraordinary watches in the toune of Bamff upon Severall Egyptians Committed prisoners in their Tolbooth
