Repryve James Campbell

Anent the petitione Given In to the Lords of his Majesties privy Councell Be James Campbell prisoner In the tolbooth of Edinburgh Sheuing That the supplicant being Condemned by the Lords of Justiciary to dye on the tuelvth Instant on his Judiciall Confessione to have been accessory to the robbing Sir John Clarks house Does with all deference and submissione acquiesce to the Justice of the Laues sentence and is so farr from Indeavouring to Lessen or extenuat his cryme that He is ready to express the deep sense of his guilt uith all the marks of sorrow and contritione that can be requyred in a sincere penitent and asking pardone of God almightie and all he hath Injured any manner of way to whom that in some measure he may make reparatione He is ready to make Immediat restitutione of all that he hath taken from them The petitioner does In the nixt place Humbly prostrat himself at their Lordships feet to Implore their Mercy Beseeching their Lordships to have Compassione upon him and to pity the easie simplicity and folly of his youth which hes in Lykely betrayed him to his cryme He is a stranger and come only from Ireland three years agoe He lived peacably in this Country uithout blemish to his lyfe or conversatione till mertimes last that he uas acquainted with some of that villanous society of whom He became so soon weary and began soe early to detest these abominable practises they had Insnared him Into That in December last he quyte abandoned them and did Enter himself to service In Sir Thomas Livingstouns regiment of dragoones He is very sensible that a Cryme of the nature of his deserves the punishment of death He only Informs their Lordships of the matter of Fact That he may not be thought more guilty then really he is And if yet ther remaines any place for favour to a poor penitent Criminall And therfore Humbly Craving their Lordships to take his sadd and deplorable Conditione to their serious Consideratione That they may be Graciously pleased aither to alter his sentence to Banishment or if he be not thought worthie to Live longer on Earth to Grant a repryvall for some weeks That he may Imploy the small remainder of his unfortunat Life In repenting the many sinns he hath been guilty off and making peace with God through the sake of his Redeemer And However their Lordships shall think fitt to dispose of him He shall never cease to pray as the said petitione bears The Saids Lords of their Majesties privy Councell Having Considered this petitione Given In to them be the above James Campbell They heirby Repryve the petitioner from the sentence of death pronunced against him by the Lords Commissioners of Justiciary untill the second teusday of May nixt being the nynth day of that month Inclusive And apoynts the magistrats of Edinburgh to see the sentence putt in executione upon the morrow after being wedensday the tenth of the said month sic subscribitur Tueeddale Cancell Linlithgow Breadalbane Tarbat Leven Cardross Carmichaell Ludovick Grant T Livingstoune

The Lords of their Majesties privie Councell Doe heirby Recommend to and authorize Sir Robert Sinclar of Steivensone, shirreff principall of Haddingtoune to appoynte a day and cause make publict Intimatione therof and to Call togither the Heretors Freeholders of the said shyre to elect and choyse a fitt and qualified persone to be one of the Commissioners Representing that shyre in the ensuing sessione of this currant Parliament In place of Adam Cockburne of Ormiestoune who was formerly one of the Commissioners of the said shyre and Is now advanced to be Lord Justice Clark

Letter From The Secretary Anent the pryces of Corne and straw Tuo Fryggotts to the Firth Comission for Searching Scotts Shipps and to process Calder

A letter from James Johnstoun Esquire secretary of state To the Lord High Chancellor Giving account that the Kings Majestie as to the Corne and straw and grass for the army hes wrote to the Thesaurie to Conclude with Broomhall That he hes referred the Justiciary of Highlands and jurisdictione of Innerlochie to the parliament That tuo frygotts uill be sent to the mouth of the firth and the Commissiones authorizing the search of scotts shipps under the pretence of traffiquing with France will be recalled And that It is the Kings pleasure that Mr Calder and all In such practises be proceeded against according to Law Redd and Recommended to the Lord Advocat to raise a process Conforme to the Letter And appoyntes Calder to be processed before the Lords of Justiciary.

The Lords of their Majesties privy Councell Doe heirby nominat and appoynte the Earle of Leven Lord Cardross and Lord Justice Clark or any tuo of them to be a Committie for examining Sir William Sharp of Staniehill lately come from France anent his deportment in that kingdome and before he went therto and since his returne therfrom and to report the same to the Councell at their nixt meeting And In the meantyme appoyntes the said Sir William to Give new Bond uith sufficient Cautione That he shall appear before the Councell the morrow or whensoever he shall be called for and that He shall live peacably as in his former Bond under the penaltie of tuo hundreth pounds Sterline In caise he shall transgress in any part of the premisses And upon Granting of this new bond ordaines the old one to be Given up
