Warrand Comissaries of the Armie for ceitting and apprehending Laird of Pourie younger

Anent the petitione given in to the Lords of his majesties privy Councill by Sir James Oswald and James Dunlop Comissaries For the armie Shewing That where the Laird of Balnamoon on the petitioners account bought a quantity of Corne and fodder from a tenent of the Laird of Pourie younger when one of their subcomissaries was gone with carts to carrie the said cornes to the magazine at Forfar Pourie on pretence of the rent due to Him arreisted the Corns and stoped the Carts which arreistment being Loused and Cautione found by the Laird of Balnamoon to pay Pourie his rent Pourie against ordor of Law and in a2 Tumultary maner stopped the Carts and Hindred their subcommissioners to take the Cornes to Forfar wherthrough the Troope Lyeing there is disappoynted of Corne and fodder for a tyme And therfore Humbly craveing the said Lords That since the said Cornes are brought by the petitioners factor and the said tenent satisfied as to the pryce and also the master by sufficient Cautione secured for his Rent Their Lordships would be pleased to ordor the said troop at Forfar to assist their subcomissioners and factors to Carrie the said Cornes to the said magazine and to hinder any persone from stopeing their Carts that the forces may be provyded and in the meantyme to consider what Punishment aught to be inflicted on Pourie for impeading the publict business and furnishing of the troupe against all Law as the said petitione bears The Lords of his majesties privy Councill Haveing considered the foresaid petitione given in to them by the said Sir James Oswald and James Dunlop The Hereby grant warrant to the Clerks of Councill to give out Letters on the foresaid petitione against the said Laird of Pourie younger for ceitting him to appear before the Councill upon the […] day of […] to answere to the same and also for ceitting of witneses And in the meantyme Recomends to the Duke of Queensberry Commander in Cheiff for the tyme of his majesties forces within this Kingdome imediatly to dispatch a partie of his majesties forces to search for take and apprehend the persone of the said Laird of Pourie younger and to convoy Him to the Toune of Edinburgh and delyver him to the magistrats thereof Whom they appoynt to detaine Him untill he find sufficient Cautione acted in the books of privie Councill That He shall make answere to the foresaid petitione and satisfie and fulfill the sentance of Councill quhich shall be given therupon and that He shall appear and attend the Haill dyets of proces before the Councill from tyme to tyme in this affair And that He shall not depairt out of the Toune of Edinburgh and Liberties therof untill the said proces be discust and the sentance to be pronounced therein obtempered and fulfilled by Him

The Lords of his Majesties privy Councill being informed that Bessie Scott daughter to James Scot Coaler in Carterhaugh servitrix to Thomas Andersone in Howfoord is presently prisoner in the Tolbooth of Selkirk as alleadged guilty of murdering her murdering her2 owne Child in the moneth of August or September Last And considering it will be a great daill of Charges and expences to bring the said Bessie Scot to this place in ordor to a tryall before the Lords Commissioners of Justiciary besydes the severall inconveniencies that may arryse by her transportatione And the said Lords Lykewayes considering that the said cryme cannot be judged or tryed by any persones in the Countrey without a warrand and Commissione from their Lordships for that effect And the said Lords being desyrous to have the said matter brought to a tryall That the persone guilty may receive condigne punishment and others may be deterred from committing such ane unnaturall Cryme in tyme Comeing They doe Hereby give full power warrand and Commissione to James Pringle of Torwoodlie James Scot of Galla John Scott of Woolle John Scot of Gilmescleugh younger Francis Scot of […] Michaell Andersone of Tushilaw and James Mitchellhill present Baillie of Selkirk or any three of the said persons with Master John Murray Advocat Shirrif deput of Selkirk whom the said Lords doe hereby declare to be a Sufficient quorum to take tryall of and judge and doe justice upon the said Bessie Scot Prisoner in the said Tolbooth for the said horride cryme And in ordor thereto To meet and Conveen at Selkirk the tuenty one day of January next to Come and then to accept of this Commissione and upon their acceptance to administut the oaths of fidelity to the persone whome the Justice Clerk and James Montgomrie of Langshaw Clerk to the justice Court shall depute and substitut to be Clerk to this present Commission and if the said James Montgomerie shall neglect or delay to depute or substitute a Clerk as said is being requyred thereto With full power to the said Commissioners or ther said quorum to Choise their oune Clerk for whom they shall be answerable With full power lykewayes to the persones Hereby Commissionat or their said quorum to Create make and Constitut Serjants Dempsters and other members of the said Court and to issue out and raise precepts or lybells of indictment at the instance of Alexander Young procurator fiscall to the Shirriff Court of Selkirk procurator Fiscall for his majesties interest in the said matter against the said Bessie Scott for ceitting her the assesers and witneses in the ordinary maner and under the usuall pains and certificationes To compear before the said Commissioners or ther said quorum at Selkirk the eighteen day of February therefter With power also to them to amerciat and fyne the absent assesers and witneses and the amerciaments and fynenes to uplift for their owne use and behoove and to adjourne themselves from tyme to tyme to the effect that the pannall being fully heared The said Commissioners or ther said quorum may Judge and determine the relevancie of the Lybell and to call ane inqueist of fourty fyve persones who are to be ceitted on the assyse of the said persone and out of the said number to choise ane assyse of fyfteen and to administrat to them the ordinary oath in the usuall termes. and with power also to the said Commissioners or ther said quorum to examine the witneses in presence of the pannall and sworne inqueist upon the poynts that shall be admitted to probatione And therafter to remitt the said Lybell and interloquitor to be given by them anent the relevancie therof and the depositiones of the witneses to be taken in maner foresaid to the knowledge of the said inquest and assyse whom they appoynt to elect a Chanceller or precident with a Clark and after reading and peruseing of the said indictment interloquitor to be pronounced theron and depositions of the witneses to be taken in presence of the said pannall and assyse To find the lybell proven against the said pannall or to assoilzie Her according to Law as they will be answerable to God and a good Conscience That they draw up ther verdict accordingly and delyver the same sealled by the Hand of ther Chancellor or president to the said persones or ther said quorum whom they Hereby Authorize and Commissionate to advyse the haill proces and verdict of the inqueist with the depositions of the witneses and to give and pronounce sentance Condemnitor or absolvitor in the said matter according to justice and in case the said judges shall find the said pannall guilty of the said cryme Laid to her charge With power to the said Commissioners or their said quorum to act doe and performe all and sundrie things whatsomever Competent and incumbent to be acted done and performed by any Commissioners of justiciary hetherto nominated by the said Lords of privy Councill. Decreet his majesties Advocat q. Ministers etc

Anent the lybel or complaint raised and pursued before the Lords of his majesties privy Councill at the instance of his Majesties right trusty and welbeloved Sir2 James Stueart his Majesties Advocat for his Highness interest in the matter underwryten as also haveing ordor from the Lords of privy Councill for that effect That where by the sexth act of the parliament Jaj vjc nynty and three intituled, act for takeing the oath of alleadgeance and assureance It is statute and ordained That all preachers and ministers of the Gospel als weill as the other persones mentioned in the said act sweare the oath of alleadgeance and subscryve the same with the assurance as they are subjoyned to the said act and that betwixt and the tuenty day of June in the year foresaid Which day for the said preachers and ministers was by the therty seventh act of the same parliament prorogat to the tenth day of July then next to come ordaining them to give obedience to the foresaid act betwixt and the said day perremptorie And because That many of the said preachers and ministers did notwithstanding of the foresaid act and the dayes therein assigned neglect or delay to take and sweare the foresaid oath of alleadgeance and subscryve the same with the assureance It pleased his majestie with advyse and Consent of the Estates of parliament by another act of the sexteenth of July Last To allow all ministers that were at the tyme of his Majesties happy accessione to the Croune and Have since continowed actuall ministers in particular Paroches and noe sentance either of Depositione or therfore Have incurred the certificatione thereof And therefore they being ipso facto depryved from their kirks and stipends and the same declared vaccant as said is They and every one of them aught rebellione and putting of them to the Horne with certificatione etc as in the principall lybell or Complaint and executions thereof at lenth is contained The foresaid Lybell at the instance of the said Sir James Stueart his majesties Advocat against Mr Sylvester Lammie minister at Essie Mr […] Rait minister at Bervie Mr Alexander McKenzie minister at Newtyle Mr John Myln minister at Montrose and Mr. John Raitt minister at Innerkeillor for not takeing the oath of alleadgeance and assureance being this day called in presence of the said Lords of his majesties Privy Councill and his majesties Advocat and Sir James Oglivie his majesties Sollicitor Compearing personally as pursuers and the Haill fyve forenamed persons defenders Compearing also personally and being interrogat if they have taken the oath of alleadgeance and assureance as appoynted by the acts of parliament They all acknowledged in face of Councill that they have not taken the same and a petitione by the parichoners of Newtyle being read The said Lords of his majesties privy Councill refuise the desyre of the petitione and Have Depryved and Hereby Depryv’s the said Master Sylvester Lammie Mr Peter The Lords of his majesties privy Councill doe hereby give ordor and warrand to the Magistrats of Perth and keeper of their Tolbooth To delyver the persone of Angus McGrouth in Bochniny in the brae of Lochaber presently prisoner in the said Tolbooth pannalled before the Commissioners of Justiciary as the Stealler and away taker of tuelve Kows from Allane Stueart of Inchkerroch in November Jaj vjc eighty and nyne years To Captaine James Lindsay in2 Lord George Hamilton’s Regiment in his majesties Service at Flanders to be carried aboard by him as a Souldier in the said service He first inacting himself in the books of his majesties privy Councill That He shall goe abroad as a souldier in his majesties Service with the said Captaine Lindsay and that He shall never returne within this Kingdome without his Majesties or the Councills particular warrand for that effect under the paine of death
