Act Mr Thomas Douglas and Weightmen his assigney

Anent a Petition given in to the Lords of ther Majesties privy Councill be Mr Thomas Douglas minister of 2 Skirling3 and William Wightman merchant in Edinburgh his assigney Shewing That quher the petitioner haveing served the cure at the said kirk of Skirling untill Whitsunday Jaj vjc Eightie nyne as is evident by the oath and depositione of James Patersone Chamberland to Livetenant Generall Douglas heritor and patrin of the said parish And the petitioner haveing retired after the said terme of Whitsunday for some small time out of fear of the Comon troubles and for his necessary sustinance of himself and poor familly was necessitate to borrow money from William Weightman merchant in Edinburgh, and did assigne him the said half years stipend due and payable at the said terme of Whitsunday Jaj vjc Eightie nyne for his securitie of the soumes so advanced to the petitioner in his great straits and want for repayment of which soumes the petitioner is now Distressed and pursued In Respect the said James Patersone Chamberland to the estate of Skirling and the other heritors Lyable in payment of the said stipend Refuse to make payment therof to the petitioner or the said William Weightman his assigney without the saids Lords warrand and order for that effect, notwithstanding the said James Patersone acknowledges by his oath therwith produced that the said half years Stipend is still in his hands And Therfore Humbly Craveing the saids Lords in Consideratione that it is evident by the Chamberlands oath that the petitioner served till the Whitsunday Jaj vjc Eightie nyne and that the said termes stipend is still in his hand to ordaine the said Chamberland and heritors and others Lyable in payment therof To make payment of so much therof in the first place to the said William Weightman as will satisfie the soumes Contained in his assignatione and advanced be him to the petitioner in his distres and the supperplus of the said termes stipend to the petitioner for satisfieing of William Plenderleith of another Small Soume advanced be him to the petitioner in his deficulties to which the said William Wightman has also right as the petition bears. The Lords of their majesties privy Councill haveing Considered this petitione given in to them be Mr Thomas Douglas and William Weightman his assigney with the oath and depositione therin and produced therwith with a bond be the said Mr Thomas Douglas to the Said William Weightman Containeing ane hundreth and twentie thrie punds five shilling Eight penies principall Threttie punds of penaltie and annualrent after the date of the bond which is dated the twentie first day of February Jaj vjc Eightie nyne years and Containes ane assignatione to the above half years stipend Togither with one act of litis contestatione in the process to make arreisted goods furthcomeing before the Lords of Sessione at the instance of the said William Wightman against Livt James Douglas of Skirline and the said Mr Thomas Douglas for his intrest for payment of the soumes Contained in the above bond and assignatione and of the soume of Threttie six pounds scotts principall with five punds of penaltie and annualrents of the principall soume contained in ane bond granted be the seventh day of november Jaj vjc Eightie Eight years and in ane assignatione therof granted be the said William Plenderleith to the said William Wightman dated the first day of Aprill Jaj vjc nyntie years They heirby Declair that the said William Weightman as assigney Constitute be the said Mr Thomas Douglas has right to the stipend of the above kirk of Sterline for that terme therof 4 payable at Whitsunday Jaj vjc Eightie nyne And ordaines him as assigney forsaid to be readiely answered obeyed and payed thereof be the heritors wodsetters Lyfrenters titulars tacksmen of teynds tenants possessors and others Lyable in payment of the samen And Ordaines letters of horning under the Signet of Councill to be direct at the instance of the said assigney against the persones Lyable in payment of the said half years stipend he produceing a decreet of Locality and in case ther be no Decreet of Locallity ordaines these Lyable to make payment of their respective proportiones according as they shall be Decerned be the Judge ordinary.

The Lords of their Majesties privie Councell Doe Heirby Recommend to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdome To Cause convoy under a sufficient Guaird from the toune of Paslay to Edinburgh John Park serjant Thomas Wright Corporall and Alexander Lockhart and James Milne souldiers in Captan […] His Company in my Lord Strathnaver his Regiment who suffered Fergus Templetoune souldier In Captaine Home his Company in the said Lord Strathnaver his regiment to make his escape while he was prisoner for alleadged murdering of one of the Fewers of Dunlope And to delyver the saids serjant Corporall and souldiers to the Magistrats of Edinburgh and keeper of their tolbooth whom the saids Lords doe Heirby requyre to receave and detaine the saids persones prisoners in the said tolbooth untill farder ordor of Councell or till they be prosecute according to Law And Recommends to the said Sir Thomas Livingstoune to wryte to Captain Bruce to be at this place when the said serjant Corporall and souldiers shall be brought in

The lords of their majesties’ privy council do hereby recommend to Sir Thomas Livingstone, commander in chief of their majesties’ forces within this kingdom, to cause convoy under a sufficient guard from the town of Paisley to Edinburgh John Park, sergeant, Thomas Wright, corporal, and Alexander Lockhart and James Milne, soldiers in Captain […] his company in [William Gordon] my Lord Strathnaver his regiment who suffered Fergus Templeton, soldier in Captain Home his company in the said Lord Strathnaver his regiment, to make his escape while he was prisoner for alleged murdering of one of the feuars of Dunlop, and to deliver the said sergeant, corporal, and soldiers to the magistrates of Edinburgh and keeper of their tolbooth, whom the said lords do hereby require to receive and detain the said persons prisoners in the said tolbooth until further order of council, or till they be prosecuted according to law. And recommend to the said Sir Thomas Livingstone to write to Captain Bruce to be at this place when the said sergeant, corporal, and soldiers shall be brought in.

Act for liberating The Viscount of Oxfoord and Confyning him to his oune house

Anent the petitione Given in to the Lords of their Majesties privie Councell Be Robert Viscount of Oxenfoord Sheuing That the petitioner was Imprisoned in the Castle of Stirling in the begining of Junij last wher the petitioner had remained prisoner ever since not only to the great loss and prejudice of his affairs But to the ruine of his health which was mightily Impared by his Imprisonment as ane testificat under the hand of Mr Walter Stirline doctor of medicine theruith produced did testifie And therfore Humbly Supplicating the saids Lords to ordaine him to be sett at Liberty out of the said castle And if their Lordships showld think fitt to Confyne him to his oune house and ane mylle about the same He was Content to Give obedience therto And find Cautione as the said petitione Bears The Lords of their Majesties privie Councell Having Considered the forsaid petitione Given In to them Be the above Viscount of Oxenfoord uith the Certificat of his Indispositione mentioned therin and produced theruith They heirby Give ordor and warrand to Leivt Collonell John Erskine Leivt Governour of the Castle of Stirling and In his absence to the nixt Commanding officer ther to sett the petitioner at liberty furth therof And Confyne the said viscount to his oune house of Nether Cranstoune and a myll about the same In respect he hes Given bond and found sufficient Cautione acted in the books of privy Counsell That he shall repaire Straight from the said Castle to his oune house at Nether Cranstoune and shall remaine Confyned at the said house and a Myll about the same and not goe uithout the bounds of his said Confynment And that he shall re-enter himself prisoner uithin the said Castle betuixt and the last wedensday of February nixt to Come And in the mean tyme that he shall Live peacably under and uith all submissione to the present Government of their Majesties King William and Queen Mary And that he shall not Act consult nor Contryve any thing in prejudice therof nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords of privie Counsell at any tyme betuixt and the said last wedensday of Febrwary nixt to Come under the penalty of tuenty thousand merks scots In case he shall transgress in any pairt of the premisses

Act for liberating the viscount of Oxfuird and confining him to his own house

Concerning the petition given in to the lords of their majesties’ privy council by Robert [Makgill] viscount of Oxfuird, showing that the petitioner was imprisoned in the castle of Stirling in the beginning of June last, where the petitioner has remained prisoner ever since not only to the great loss and prejudice of his affairs, but to the ruin of his health, which was mightily impaired by his imprisonment, as a certificate under the hand of Mr Walter Stirling, doctor of medicine, therewith produced did testify, and therefore humbly supplicating the said lords to ordain him to be set at liberty out of the said castle. And if their Lordships should think fit to confine him to his own house and a mile about the same, he was content to give obedience thereto and find caution, as the said petition bears. The lords of their majesties’ privy council having considered the foresaid petition given in to them by the above viscount of Oxfuird, with the certificate of his indisposition mentioned therein and produced therewith, they hereby give order and warrant to Lieutenant Colonel John Erskine, lieutenant governor of the castle of Stirling, and in his absence to the next commanding officer there, to set the petitioner at liberty forth thereof, and confine the said viscount to his own house of Nether Cranston and a mile about the same, in respect he has given bond and found sufficient caution acted in the books of privy council that he shall repair straight from the said castle to his own house at Nether Cranston and shall remain confined at the said house and a mile about the same and not go without the bounds of his said confinement, and that he shall re-enter himself prisoner within the said castle between [now] and the last Wednesday of February next to come. And in the meantime that he shall live peaceably under and with all submission to the present government of their majesties King William and Queen Mary, and that he shall not act, consult, nor contrive anything in prejudice thereof, nor converse or correspond with any rebels. And that he shall appear before the said lords of privy council at any time between [now] and the said last Wednesday of February next to come under the penalty of 20,000 merks Scots in case he shall transgress in any part of the premisses.

Warrand for a Lybell Against persones In Orknay upon a Letter from Lapness

The Lords of their Majesties privie Councell Having heard a Letter direct to their Lordships from the Laird of Lapness steuart of Orknay Giving Account of severall disaffected persons uithin that steuartry and their deportment redd in their presence They Heirby Recommend to Sir James Steuart their Majesties Advocat to raise a Lybell before the Councell Against the Minister mentioned in the Letter And Lykewayes against Patrick Fea Leivt Lamb and the provost of Kirkwall for the Crymes mentioned in the Letter And appoyntes Sir James Ogilvie their Majesties Sollicitor to Cause transmitt the Lybell to the said steuart of Orknay whom the saids Lords appoints to see to and take Care that the same be deuly execute And appoynts the said Stewart to take sufficient security of the parties abovenamed That they shall appear before the Councell at the day to which they shall be Cited And that they shall attend all the dyetts of process And in case they refuise or shall not find Cautione Appoynts the steuart to seise their persones and make them prisoners And Cause transport them under a sufficient guaird to the nixt shyre and delyver them to the shirreff principall therof or their deputs And appoyntes them to be so transmitted from shirreff to shirreff under a Guaird untill they be brought to the Citty of Edinburgh And ordaines them to be delyvered to the magistrats of Edinburgh and by them to be Committed prisoners in their tolbooth till furder ordor of Councell And Recommends to the Lord Advocat to prepare ane Act of Councell Requyring Lapnes to take tryall whither the Magistrats of Kirkuall and the officers of the Militia in Orkney alse well burgh or Landuard be qualified in the termes of the Act of parliament by taking the oath of alleadgance and assurance And to returne Ane account to the Lords of privy Councell And Requyring Lapnes to take care of the peace That the same be preserved

Warrant for a libel against persons in Orkney upon a letter from Lopness

The lords of their majesties’ privy council having heard a letter directed to their lordships from the laird of Lopness, stewart of Orkney, giving account of several disaffected persons within that stewartry and their deportment read in their presence, they hereby recommend to Sir James Stewart, their majesties’ advocate, to raise a libel before the council against the minister mentioned in the letter, and likewise against Patrick Fea, Lieutenant Lamb, and the provost of Kirkwall for the crimes mentioned in the letter. And appoint Sir James Ogilvie, their majesties’ solicitor, to cause transmit the libel to the said stewart of Orkney, whom the said lords appoint to see to and take care that the same be duly executed. And appoint the said stewart to take sufficient security of the parties abovenamed that they shall appear before the council at the day to which they shall be cited, and that they shall attend all the diets of process. And in case they refuse or shall not find caution, appoint the stewart to seize their persons and make them prisoners and cause transport them under a sufficient guard to the next shire and deliver them to the sheriff principal thereof or their deputes, and appoint them to be so transmitted from sheriff to sheriff under a guard until they be brought to the city of Edinburgh. And ordain them to be delivered to the magistrates of Edinburgh and by them to be committed prisoners in their tolbooth till further order of council. And recommend to the lord advocate to prepare an act of council requiring Lopness to take trial whether the magistrates of Kirkwall and the officers of the militia in Orkney, as well burgh or landward, be qualified in the terms of the act of parliament by taking the oath of allegiance and assurance, and to return an account to the lords of privy council. And require Lopness to take care of the peace that the same be preserved.
